  1. SOCKMONSTERS LTD DEMO LICENSE

  3. LICENSE FOR 'demoXox.prc' ('THE SOFTWARE')
  4.  
  5. PLEASE READ THE FOLLOWING TERMS AND CONDITIONS. 
  6.  
  7. Sockmonsters Ltd licenses THE SOFTWARE to you only upon condition
  8. that you accept all of the terms and conditions contained in this
  9. license agreement. These terms and conditions are accepted by 
  10. installing THE SOFTWARE on a compatible device. If you do not
  11. agree to these terms and conditions then you must not use THE 
  12. SOFTWARE and should delete all copies from your system. No 
  13. adjustment or alteration to these terms & conditions will be 
  14. accepted.

  16. Whilst Sockmonsters Ltd endeavours to produce high quality, 
  17. reliable software you accept that no software can be free of
  18. error, and use of THE SOFTWARE is entirely at your own risk. 
  19. Sockmonsters Ltd cannot be held responsible for any loss or 
  20. corruption of data or software, lost profits or other incidental,
  21. indirect or consequential damages arising from the use or misuse 
  22. of THE SOFTWARE.

  24. 'THE SOFTWARE' includes the main program identified above, any 
  25. attached documentation and all associated works of art, music, 
  26. text, animation, photographs and sound effects.
  27.  
  28. You acknowledge that you have read this agreement, understand it 
  29. and agree to be bound by its terms and conditions. This agreement
  30. is governed by the law of England and Wales.

  32. DEMO SOFTWARE LICENSE AGREEMENT 
  33.  
  34. 1) GRANT OF LICENSE 
  35. Sockmonsters Ltd grants you a nonexclusive and limited license to
  36. use THE SOFTWARE, in object code form only, including associated 
  37. documentation provided by in connection therewith solely in 
  38. accordance with the terms and conditions of this License
  39. Agreement. THE SOFTWARE is licensed, not sold, to you. You may
  40. install and use THE SOFTWARE on any number of handhelds in the
  41. United Kingdom and any other country to which THE SOFTWARE is
  42. legally exported. THE SOFTWARE is "in use" on a handheld when it 
  43. is resident in memory or other storage medium accessible from the
  44. handheld.

  46. 2) DISTRIBUTION
  47. You may freely distribute THE SOFTWARE to third parties in its 
  48. original form. No right to distribute derivative works of THE 
  49. SOFTWARE is granted. Licensing or renting THE SOFTWARE or any 
  50. derivative work to third parties for a fee (whether direct or
  51. indirect) is strictly prohibited. Each time you distribute THE 
  52. SOFTWARE the recipient automatically receives this license to use,
  53. copy, and distribute THE SOFTWARE subject to these terms and 
  54. conditions.

  56. 3) MODIFICATION
  57. Except as expressly permitted by this License Agreement, you 
  58. hereby acknowledge and agree that you will not modify, reverse 
  59. engineer, disassemble or decompile THE SOFTWARE or any portion 
  60. thereof or translate THE SOFTWARE object code in any way. 
  61. You will not attempt to circumvent any limitations or copy 
  62. protection in THE SOFTWARE.

  64. 4) TECHNICAL SUPPORT 
  65. The provision of technical support for THE SOFTWARE is entirely 
  66. at the discretion of Sockmonsters Ltd. If available, such support 
  67. will be provided only via e-mail unless otherwise determined by 
  68. Sockmonsters Ltd technical support. The technical support email is
  69. support@sockmonsters.com 
  70.  
  71. 5) COPYRIGHT
  72. THE SOFTWARE is copyrighted by Sockmonsters Ltd and is protected
  73. by English and international copyright laws. You may not copy THE
  74. SOFTWARE except: (a) to provide a single backup copy on a desktop 
  75. computer; (b) as necessary for the execution of THE SOFTWARE. You 
  76. must reproduce and include all copyright notices, trademarks or 
  77. other proprietary legends of Sockmonsters Ltd in any copy of THE 
  78. SOFTWARE made by you. Any and all other copies of THE SOFTWARE 
  79. and/or the documentation made by you are in violation of this 
  80. License Agreement.

  82. 6) OWNERSHIP
  83. You agree that Sockmonsters Ltd retains all right, title and 
  84. interest in and to THE SOFTWARE and all copies at all times, 
  85. regardless of the form or media in or on which the original or 
  86. other copies may subsequently exist. You agree that you neither 
  87. own nor hereby acquire any claim or right of ownership to THE 
  88. SOFTWARE or to any related patents, copyrights, trademarks or 
  89. other intellectual property. You agree to use your best efforts 
  90. to prevent and protect the contents of THE SOFTWARE from 
  91. unauthorised disclosure or use.  Sockmonsters Ltd reserve all 
  92. rights not expressly granted to you by this license.

  94. 7) TERM AND TERMINATION 
  95. This License Agreement is effective until terminated. Sockmonsters
  96.  Ltd may terminate this License Agreement  if you fail to comply
  97. with the terms and conditions. In such event, you must destroy all
  98. copies of THE SOFTWARE. You may terminate this License Agreement
  99. at any time by providing Sockmonsters Ltd with written notice, 
  100. provided that you have complied with the destruction policy 
  101. outlined below. This License Agreement will automatically 
  102. terminate if you fail to comply with its terms and conditions. You
  103. agree that, upon any termination, you will destroy all copies of 
  104. THE SOFTWARE and certify to Sockmonsters Ltd, in writing, that all
  105. copies and partial copies thereof have been completely destroyed 
  106. and are no longer being used. 
  107.  
  108. DISCLAIMER OF WARRANTY 
  109.  
  110. BECAUSE THE SOFTWARE IS PROVIDED FREE OF CHARGE, THERE IS NO 
  111. WARRANTY FOR THE SOFTWARE. TO THE MAXIMUM EXTENT PERMITTED BY 
  112. APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS" WITHOUT 
  113. WARRANTIES, CONDITIONS, REPRESENTATIONS OR GUARANTIES OF ANY KIND,
  114. EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY 
  115. IMPLIED WARRANTIES OR CONDITIONS OR MERCHANTABILITY, SATISFACTORY
  116. OR MERCHANTABLE QUALITY, TITLE, NONINFRINGEMENT OR FITNESS FOR A 
  117. PARTICULAR PURPOSE. SOCKMONSTERS LTD DOES NOT WARRANT THAT THE 
  118. OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR FREE. 
  119. THIS DISCLAIMER OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THIS
  120. LICENSE AGREEMENT. YOUR STATUTORY RIGHTS ARE UNAFFECTED.
