  1. FLABBERGASTED! End User License Agreement ("EULA")

  3. You should carefully read the following terms and conditions before 
  4. using this software.  Unless you have a different license agreement 
  5. signed by Purple Planet Software legal representatives use of this 
  6. software indicates acceptance of this license agreement and warranty.

  9. LIMITED WARRANTY

  11. THIS SOFTWARE AND MANUAL ARE PROVIDED FOR EVALUATION ONLY, 
  12. ON AN "AS IS" BASIS.  Purple Planet Software, a division 
  13. of Alpine Development Associates DISCLAIMS ALL WARRANTIES 
  14. RELATING TO THIS SOFTWARE, WHETHER EXPRESSED OR IMPLIED, 
  15. INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF 
  16. MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. 
  17. NEITHER Purple Planet Software, a division of Alpine 
  18. Development Associates NOR ANYONE ELSE WHO HAS BEEN INVOLVED 
  19. IN THE CREATION, PRODUCTION, OR DELIVERY OF THIS SOFTWARE 
  20. SHALL BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, OR 
  21. INCIDENTAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO 
  22. USE SUCH SOFTWARE, EVEN IF Purple Planet Software, a 
  23. division of Alpine Development Associates HAS BEEN ADVISED 
  24. OF THE POSSIBILITY OF SUCH DAMAGES OR CLAIMS.  THE PERSON 
  25. USING THE SOFTWARE BEARS ALL RISK AS TO THE QUALITY AND 
  26. PERFORMANCE OF THE SOFTWARE.

  28. This agreement shall be governed by the laws of the State of 
  29. Utah and shall inure to the benefit of Purple Planet Software,
  30. a division of Alpine Development Associates and 
  31. any successors, administrators, heirs and assigns. Any 
  32. action or proceeding brought by either party against the 
  33. other arising out of or related to this agreement shall be 
  34. brought only in a STATE or FEDERAL COURT of competent 
  35. jurisdiction located in Utah County, Utah. The parties 
  36. hereby consent to in personam jurisdiction of said courts.

  39. PERSONAL USE LICENSE

  41. FLABBERGASTED! is NOT a public domain program.  It is 
  42. copyrighted by Purple Planet Software, a division of Alpine 
  43. Development Associates.  This software and accompanying 
  44. documentation are protected by United States copyright law 
  45. and also by international treaty provisions.

  47. Purple Planet Software, a division of Alpine Development 
  48. Associates grants you a limited license to use this software 
  49. for personal purposes only. 
  50.  
  51. You may not use, copy, rent, lease, sell, modify, decompile,
  52. disassemble, otherwise reverse engineer, or transfer the licensed
  53. program except as provided in this agreement.  Any such unauthorized
  54. use shall result in immediate and automatic termination of this 
  55. license. All rights not expressly granted here are reserved to 
  56. Purple Planet Software, a division of Alpine Development Associates.

  59. RESTRICTED DISTRIBUTION LICENSE

  61. User may distribute only the demo version of FLABBERGASTED!, 
  62. completely unaltered, without further permission.  This personal
  63. use version of FLABBERGASTED! is not redistributable.

  65. U.S. Government Information:  Use, duplication, or disclosure by the
  66. U.S. Government of the computer software and documentation in this
  67. package shall be subject to the restricted rights applicable to
  68. commercial computer software as set forth in subdivision (b)(3)(ii) of
  69. the Rights in Technical Data and Computer Software clause at
  70. 252.227-7013 (DFARS 52.227-7013).  The Contractor/manufacturer is
