  9. 1. License.  The application, demonstration, and other software

  12. are licensed to you by Spiderweb.  You own the disk on which the 
  13. Software is recorded but Spiderweb and/or Spiderwebs═s Licensor(s) 
  14. retain title to the Software and related documentation.  This License 
  15. allows you to use the Software on more than one computer, provided 
  16. there is no chance it will be used simultaneously on more than one 
  17. computer.  This License allows you to make as many copies of the 
  18. Software in machine-readable form as you need for backup purposes 
  19. only.  You must reproduce on such copy the Spiderweb copyright 
  20. notice and any other proprietary legends that were on the original 
  21. copy of the Software.  You may also transfer all your license rights 
  22. in the Software, the backup copy of the Software, the related

  33. upon the Software in whole or in part.  You may not distribute the 
  34. Software for profit in any form, including, but not limited to, 
  35. electronic information service distribution, bulletin board 
  36. distribution, and magnetic or optical medium distribution, unless 
  37. explicitly stated in writing and signed by a duly authorized 
  38. representative of Spiderweb.  Non-profit distribution of the software 
  39. is permissible without prior written notice, providing that the 
  40. Software is not modified in any way, and the complete works of the 
  41. Software are included in the distribution package.

  43. 3. Termination.  This License is effective until terminated.  You 
  44. may terminate this License at any time by destroying the Software 
  45. and related documentation and all copies thereof.  This License 
  46. will terminate thirty (30) days after receipt of the Software, unless 
  47. the Software is registered with Spiderweb with appropriate 
  48. compensation and registration information.  This License will 
  49. terminate immediately without notice from Spiderweb if you fail 
  50. to comply with any provision of this License.  Upon termination 
  51. you must destroy the Software and related documentation and all 
  52. copies thereof.

  54. 4. Export Law Assurances.  You agree and certify that neither the 
  55. Software nor any other technical data received from Spiderweb, nor 
  56. the direct product thereof, will be exported outside the United 
  57. States except as authorized and as permitted by the laws and 
  58. regulations of the United States.  If the Software has been 
  59. rightfully obtained by you outside of the United States, you 
  60. agree that you will not re-export the Software nor any other 
  61. technical data received by Spiderweb, nor the direct product 
  62. thereof, except as permitted by the laws and regulations of the 
  63. United States and the laws and regulations of the jurisdiction in 
  64. which you obtained the Software.

  66. 5. Government End Users.  If you are acquiring the Software on 
  67. behalf of any unit or agency of the United States Government, 
  68. the following provisions apply.  The Government agrees:
  69.     (i) if the Software is supplied to the Department of 
  70. Defense (DoD), the Software is classified as 'Commercial Computer 
  71. Software' and the Government is acquiring only 'restricted rights' 
  72. in the Software and its documentation as that term is defined in 
  73. Clause 252.227-7013(c)(1) of the DFARS; and
  74.     (ii) if the Software is supplied to any unit or agency of 
  75. the United States Government other than the DoD, the Government═s 
  76. rights in the Software and it documentation will be as defined in 
  77. Clause 52.227-19(c)(2) of the FAR or, in the case of NASA, in Clause 
  78. 18-52.227-86(d) of the NASA Supplement to the FAR.

  80. 6. Disclaimer of Warranty on Software.  You expressly acknowledge 
  81. and agree that use of the Software is at your sole risk.  The 
  82. Software and related documentation is provided 'AS IS' and without 
  83. warranty of any kind and Spiderweb and Spiderwebs═ Licensor(s) (for 
  84. the purposes of provisions 7 and 8, Spiderweb and F Spiderwebs═ 
  85. Licensor(s) shall be collectively referred to as 'Spiderweb') 
  86. EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, 
  87. BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND 
  88. FITNESS FOR A PARTICULAR PURPOSE.  SPIDERWEB DOES NOT WARRANT THAT 
  89. THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL MEET YOUR REQUIREMENTS, 
  90. OR THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR 
  91. ERROR-FREE, OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED.  
  92. FURTHERMORE, SPIDERWEB DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS 
  93. REGARDING THE USE OR THE RESULTS OF THE USE OF THE SOFTWARE OR RELATED 
  94. DOCUMENTATION IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR 
  95. OTHERWISE.  NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY SPIDERWEB
  96.  OR A SPIDERWEB AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY OR 
  97. IN ANY WAY INCREASE THE SCOPE OF THIS WARRANTY.  SHOULD THE SOFTWARE 
  98. PROVE DEFECTIVE, YOU (AND NOT SPIDERWEB OR A SPIDERWEB AUTHORIZED 
  99. REPRESENTATIVE) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, 
  100. REPAIR OR CORRECTION.  SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION 
  101. OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

  103. 7. Limitation of Liability.  UNDER NO CIRCUMSTANCES INCLUDING 
  104. NEGLIGENCE, SHALL SPIDERWEB BE LIABLE FOR ANY INCIDENTAL, SPECIAL 
  105. OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OR INABILITY TO 
  106. USE THE SOFTWARE OR RELATED DOCUMENTATION, EVEN IF SPIDERWEB OR A 
  107. SPIDERWEB AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE 
  108. POSSIBILITY OF SUCH DAMAGES.  SOME JURISDICTIONS DO NOT ALLOW 
  109. THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR 
  110. CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITATION OR EXCLUSION MAY 
  111. NOT APPLY TO YOU.  In no event shall Spiderwebs═ total liability 
  112. to you for all damages, losses, and causes of action (whether in 
  113. contract, tort (including negligence) or otherwise) exceed the 
  114. amount paid by you for the Software.

  116. 8. Controlling Law and Severability.  This License shall be 
  117. governed by and construed in accordance with the laws of the 
  118. United States and the State of Washington, as applied to 
  119. agreements entered into and to be performed entirely within 
  120. Washington between Washington residents.  If for any reason 
  121. a court of competent jurisdiction finds any provision of this 
  122. License, or portion thereof, to be unenforceable, that provision 
  123. of the License shall be enforced to the maximum extent permissible 
  124. so as to effect the intent of the parties, and the remainder of 
  125. this License shall continue in full force and effect.

  127. 9. Complete Agreement.  This License constitutes the entire 
  128. agreement between the parties with respect to the use of the 
  129. Software and related documentation, and supersedes all prior 
  130. or contemporaneous understandings or agreements, written or 
  131. oral, regarding such subject matter.  No amendment to or 
  132. modification of this License will be binding unless in writing 
  133. and signed by a duly authorized representative of Spiderweb.

  144. - Right to place any and all scenarios created in whole or in part 
  145. by the Blades of Exile Scenario Editor for download on our web site 
  146. without prior approval of the author.

  148. - Right to place any and all scenarios created in whole or in part 
  149. by the Blades of Exile Scenario Editor on 3.5" disks, CD-ROMs, or 
  150. similar media for distribution and sale, without prior approval of 
  151. the author. Fees charged for said media will not be part of or be 
  152. construed as part of any shareware fees set forth by individual 
  153. authors. All fees are for production and distribution of the media 
  154. only.

  156. YOU MAY:

  158. - Freely distribute scenarios you create using the Blades of Exile 
  159. Scenario Editor.
  160.  
  161. - Ask for donations from the users of your scenarios, as long as a 
  162. payment is in no way required to access portions of the scenario.

  164. YOU MAY NOT:

  166. - Charge any sort of fee or shareware fee for any scenarios created 
  167. by or for use with this Program.

  169. - Reverse engineer, derive source code of, modify, decompile, 
  170. disassemble, or create derivative works of this Program, in whole 
  171. or in part. You may not modify any of the scenarios "Valley of Dying 
  172. Things," Small Rebellion," or "Za-Khazi Run."

  174. - Use the registered version of this Program, or permit use of   
  175. the registered version of this Program, on more than one computer, 
  176. computer terminal, or workstation at any time.
  177.  
  178. - Make copies of the registered version of this Program or any part 
  179. thereof, or make copies of the materials accompanying the registered 
  180. version of this Program.

  182. - Remove, disable, or circumvent any proprietary notices or labels
