  16. Happy Birthday, Happy Birthday to Phrack.  November 17th, 1993 marks
  17. the eighth year of Phrack Magazine.  Amazing, ain't it?  Seems like
  18. only a few years.  Makes me feel old.  Damn.
  19.  
  20. I have been a busy boy since I put out 43.  I've been to Boston,
  21. Amsterdam, Las Vegas, Philadelphia, and numerous points in between.
  22. I've been slaving at the day job, consulting and speaking about
  23. security on the side, working on other ventures you could not
  24. possibly conceive of without proper initiation, and piecing together
  25. this magazine.  (Listening for applause)
  26.  
  27. It's a big pain in the butt to do a magazine like this, especially
  28. when people who SAY they are going to write something, don't.  I know,
  29. it's a typical hacker cop-out to start something and then get
  30. side-tracked by other projects.  I'm as guilty of that as is any of
  31. you, but I'm trying to get better.  So should those of you who are
  32. hiding your faces in shame...you know who you are.
  33.  
  34. Every day I get bombarded with "When's the next Phrack coming out?"
  35. It started the day I released 43 on IRC.  THE SAME DAY!  43 hadn't even
  36. gone out over the mailing list yet, and people were already asking
  37. when the next one was due out!  I know they didn't read all 1.2
  38. megs of 43 before they started in on me.  Geez, that gets old.
  39. For those of you who ever consider asking me such a thing, the answer
  40. is, "When it's done."
  41.  
  42. Alas, still no new corporate registrations.  A few people
  43. have expressed an interest, but never followed through.
  44. We have gotten a number of non-corporate registrations from
  45. people who I guess just wanted to send me mail.  Listen
  46. guys, I love to hear from you all, but unless you are a corporate,
  47. federal, or law enforcement reader complying with our registration
  48. requirements and paying the fee, you don't have to send in the form.
  49.  
  50. We've got a few nifty things in this issue.  Phrack never really
  51. included much more than text.  Last month's inclusion of the Novell
  52. utilities uuencoded was a departure from the norm, and I decided to
  53. do somthing like that again.  In this issue you will find a small
  54. photo collection that might make you smile.
  55.  
  56. If you can't figure out how to use uudecode, I suggest
  57. you close this file, and spend a few moments perusing the man page
  58. entries on that command, or consulting a good book on unix.  And
  59. for you whiners that don't have accounts on UNIX boxes, uuencode
  60. and uudecode programs are available for DOS, Mac, Amiga and
  61. virtually any platform you care to use.  (Although if you are using
  62. MVS, CICS, TSO or 400/OS, you reap what you sow.)

  64. A lot of conferences went on during the time that has passed since our
  65. last issue.  It's nice to see that the community is making itself
  66. a louder voice in the world, although seeing the word "Cyber" on
  67. nearly every magazine in the Western Hemisphere is making me
  68. rather nauseous, and if Billy Idol gets on another TV show (aside from
  69. The Hollywood Squares, which would mean his career was OVER)
  70. I may have to sell everything electronic I own.  Hell, there
  71. was even hacking on Melrose Place.  Anyway, back to the point, as is
  72. the case with every gathering, we've got it covered.
  73.  
  74. You might notice that there are a lot of files dealing with people
  75. and places rather than strictly items of hardcore technical info.
  76. I know some may disagree with me, but I really feel that its
  77. important to document and chronicle things that relate to the
  78. personalities of this community.  I mean, how entertaining is it
  79. to read "HOW TO HACK TOPS-20" ten years later?
  80.  
  81. Don't get me wrong and think we're not dealing with anything meaty.
  82. This issue we've also got operating system guides, cell & bell stuff,
  83. Van Eck info, and MORE MORE MORE.

  115. withhold Phrack from anyone whose occupations are not in conflict

  120. Phrack Magazine corporate/institutional/government agreement
  121.  
  122.    Notice to users ("Company"):  READ THE FOLLOWING LEGAL
  123. AGREEMENT.  Company's use and/or possession of this Magazine is
  124. conditioned upon compliance by company with the terms of this
  125. agreement.  Any continued use or possession of this Magazine is
  126. conditioned upon payment by company of the negotiated fee
  127. specified in a letter of confirmation from Phrack Magazine.
  128.  
  129.    This magazine may not be distributed by Company to any
  130. outside corporation, organization or government agency.  This
  131. agreement authorizes Company to use and possess the number of copies
  132. described in the confirmation letter from Phrack Magazine and for which
  133. Company has paid Phrack Magazine the negotiated agreement fee.  If
  134. the confirmation letter from Phrack Magazine indicates that Company's
  135. agreement is "Corporate-Wide", this agreement will be deemed to cover
  136. copies duplicated and distributed by Company for use by any additional
  137. employees of Company during the Term, at no additional charge.  This
  138. agreement will remain in effect for one year from the date of the
  139. confirmation letter from Phrack Magazine authorizing such continued use
  140. or such other period as is stated in the confirmation letter (the "Term").
  141. If Company does not obtain a confirmation letter and pay the applicable
  142. agreement fee, Company is in violation of applicable US Copyright laws.

  144.     This Magazine is protected by United States copyright laws and
  145. international treaty provisions.  Company acknowledges that no title to
  146. the intellectual property in the Magazine is transferred to Company.
  147. Company further acknowledges that full ownership rights to the Magazine
  148. will remain the exclusive property of Phrack Magazine and Company will
  149. not acquire any rights to the Magazine except as expressly set
  150. forth in this agreement.  Company agrees that any copies of the
  151. Magazine made by Company will contain the same proprietary
  152. notices which appear in this document.

  154.     In the event of invalidity of any provision of this agreement,
  155. the parties agree that such invalidity shall not affect the validity
  156. of the remaining portions of this agreement.

  158.     In no event shall Phrack Magazine be liable for consequential, incidental
  159. or indirect damages of any kind arising out of the delivery, performance or
  160. use of the information contained within the copy of this magazine, even
  161. if Phrack Magazine has been advised of the possibility of such damages.
  162. In no event will Phrack Magazine's liability for any claim, whether in
  163. contract, tort, or any other theory of liability, exceed the agreement fee
  164. paid by Company.

  166.     This Agreement will be governed by the laws of the State of Texas
  167. as they are applied to agreements to be entered into and to be performed
  168. entirely within Texas.  The United Nations Convention on Contracts for
  169. the International Sale of Goods is specifically disclaimed.

  171.     This Agreement together with any Phrack Magazine
  172. confirmation letter constitute the entire agreement between
  173. Company and Phrack Magazine which supersedes any prior agreement,
  174. including any prior agreement from Phrack Magazine, or understanding,
  175. whether written or oral, relating to the subject matter of this
  176. Agreement.  The terms and conditions of this Agreement shall
  177. apply to all orders submitted to Phrack Magazine and shall supersede any
  178. different or additional terms on purchase orders from Company.
