  9.      Bah. I say that to journalism when I read some of the shit they print
  10. and expect us to believe. In this case I have no doubt that 90% of who
  11. read the following article believed it. They don't know better, but a few
  12. of us who know the guys and actually took interest in what the hell really
  13. happened know that this article is complete bullshit. This was printed in
  14. the Texas Tech UD which is ditributed campus-wide and is basically free to
  15. the students. Read it through real quick.

  19.                    TWO TECH SOPHOMORES FACING FRAUD CHARGES

  21. Two Texas Tech Students face federal and state prosecution and a former Tech   
  22. student faces federal charges for computer fraud after the Secret Service 
  23. confiscated $5,000 of computer equipment and $20,000 of software Dec.15 on 
  24. the second floor of Sneed Hall.
  25.     Tech's Housing and Dining Services requested that one of the suspects 
  26. move out of Sneed Hall because of rule violations detailed in the residence 
  27. hall contract, Housing and Dining Director James Burkhalter said.
  28.     According to the contract, the University reserves the right to cancel
  29. the contract when a student "disrupts the orderly administration and 
  30. function of the university and any of its activities."
  31.     "Any violation of the Code of Student Conduct and the housing policies
  32. require that the students face either a residence hall disciplinary   
  33. committee or a university committee," Assistand Director of Housing and 
  34. Dining Services LeQuice Lancaster said. "The hearings determine whether 
  35. the students  have behaved in a manner which requires removal from the 
  36. residence hall."
  37.     Secret Service Agent Dave Freriks said, "Computer fraud is going  to 
  38. become  major target for government law enforcement.  Although this was not a 
  39. big raid for the Secret Service, it was signifigant for the west texas area.
  40.     Computer fraud costs software companies about $500 million per year, 
  41. Freriks said.  A signifigant portion of computer hacking occurs at 
  42. universities because students have time to work on computers and have access 
  43. to computer networks, he said.
  44.     "This problem is quite prevalent on university campuses." Freriks said. 
  45. "In this case, the students just wanted the games and the progrms and couldn't 
  46. afford them."
  47.     The Secret Service investigation began in May when Tech's academic 
  48. computing services could not use the computer system' disks because they were 
  49. full.
  50.     The two 21-year-old sophomores accessed Tech's mainframe computer by using 
  51. account numbers giving to them by the Tech Library.  The mainframe 
  52. electronically transmitted a  worldwide computer bulletin board that was used 
  53. to request and receive pirated computer programs.
  54.     The former Tech student used a campus organization's computer access code 
  55. to enter the Tech system, said University News and Publications Assistant 
  56. Director Steve Kauffman.
  57.     The former student confessed to pirating $6,000 worth of software during 
  58. summer 1992.  He was expelled in July for misusing the Tech computer system.
  59.     The students also used the computer to contact people in Belguim, 
  60. Australia, and Israel, Freriks said. The students probably have been breaking 
  61. into the computer system since Nov.1991, he said.
  62.     According to "Computers, the Law, and You." an academic Computng Services 
  63. publication, students are expected to use Tech computers ethically. Tech 
  64. reserves the right to  monitor all accounts to ensure the software and 
  65. computer equipment are used properly.
  66.     Copying , adapting, and electronically transmitting computer software if 
  67. forbidden unless the purpose of the copies is archival, or the copier receives 
  68. written permission from the copyright  holder, the publication states.
  69.     "Many network resources are provided by the U.S. Government," the 
  70. publication states."Abuse of the system thus becomes a federal matter above 
  71. and beyond simple professional ethics."

  81.         Ok. Harmless enough right? Well, one of the two sophomores they
  82. are talking about sorta wrote an article in response to it. He simply 
  83. points out some of the mistakes of the article and corrects a few facts
  84. that were wrong. Read his reply.

  90.      I am writing in response to a front page article on
  91. Jan. 21 titled "Two Tech Sophomores Facing Fraud Charges,"
  92. written by Sandra Pulley.  It disturbs me as to where some of
  93. Ms. Pulley's fact originate from.
  94.      Ms. Pulley says that "the Secret Service confiscated
  95. $5000 of computer equipment and $20,000 of software Dec. 15
  96. on the second floor of Sneed Hall."  First of all, the raid
  97. occurred on Monday, December 14th, not the 15th.  Also, U.S.
  98. Department of the Treasury, Secret Service Resident Agent R.
  99. David Freriks said at the Dec. 15th press conference in the
  100. Lubbock Federal Building, that a dollar amount could not be
  101. placed on the confiscated equipment, the value of the
  102. software found, nor the actual loss to the software
  103. manufacturers.  The Texas Tech Department for Police Services
  104. released a dollar amount of $3000 for the equipment
  105. confiscated.  No dollar amount has been released for the
  106. value of the software, nor the loss to the software
  107. manufactures by any source other than the University Daily in
  108. the mentioned article.  Also, all of the confiscations from
  109. the room in Sneed Hall were handled by the Texas Tech Police,
  110. not the Secret Service as stated in the article.
  111.     Farther down in the article Housing and Dining Assistant
  112. Director LeQuice Lasater is quoted as saying, "`Any violation
  113. of the Code of Student Conduct and the housing policies
  114. require [sic] that a student face either a residence hall
  115. disciplinary hearing committee or a university committee.'"
  116. The student that was "requested to move out of Sneed Hall"
  117. was not given a hearing of any kind, so far, and was not
  118. "requested" to leave; his contract with Housing and Dining
  119. was terminated and he was given 72 hours to move off campus.
  120.     The article states that the students received account
  121. numbers from the Tech Library.  Granted that the Advanced
  122. Technology Learning Center (ATLC) is housed below the
  123. library, but they are an individual entity, not a part of the
  124. library.  There are several other inaccuracies in the said
  125. article, but since the other mistakes were also made in the
  126. Associated Press story, according to the Houston Chronicle's
  127. Special Projects writer, Joe Abernathy, I will not bore you
  128. with the details.
  129.      I do not mean to attack Sandra Pulley's abilities as a
  130. news writer, I just want her and the other UD writers to be a
  131. little more accurate and careful with their facts.

  135.         Ok. Simple, to the point, and factual. No prob right? Well, the
  136. UD decided it wouldn't print that for the following reasons according
  137. to the person who wrote the response to the article.

  141. They refused the letter because I spent too much space "attacking the writer" 
  142. and not enough "dealing with the facts" that were released in the article...

  144. Pardon me, but I did not put one bit of personal knowledge, I wrote that 
  145. letter from the AP wire report, the press conference transcript, and the press 
  146. releases from the school...   (the same sources a reporter should use!!!)  and 
  147. I never used the numbers and facts that the prosecuting attorney have, or 
  148. those that my lawyer and I have estimated...  those are for private ears 
  149. only...    so I am kinda suspicious that the UD is afraid that I might ruin 
  150. the credibility of an up and coming journalist...  looks to me that maybe she 
  151. has no credibility to be ruined...

  153.     In the journalists defence, she swears up and down that Freriks gave her 
  154. those numbers, but he says he has given no information out, except at the 
  155. press conferenc and the official press releases...   so I am still 
  156. wondering....

  160.         Ok. You ask why the hell I am writing this file? It is one word 
  161. against the other? Hmm. Don't think so. I think that the reporter just 
  162. needed an article and printed what s/he could to get it in on time and
  163. didn't bother too much with facts. If that is the case then you need to 
  164. think about other papers. These college reporters are the ones that later
  165. grow up and write for the bigger papers, the shit your parents read. Now
  166. if those papers are full of people that don't bother with the facts too much
  167. then we have a serious problem. The paper wouldn't print the letter to the
  168. editor. Why? He is right. They are scared of getting a bad name. But why
  169. does it matter? It is a free paper and students will read it regardless of
  170. reputation most likely.
  171.         It all begins here. Point of this file is to make you realize that
  172. newspapers and TV news shows might not be as factual as you think. They are
  173. just as biased as the people that write for them. Think about what you read
  174. and hear from them, and do NOT take things for fact all the time.
