  1. The AOL employee who threatened 16-year-old James Egelhof with a lawsuit
  2. because of his AOL Sucks Web page now figures prominently in a plan to
  3. "TOS" Web sites distributing AOHell, along with threats of contacting the
  4. FBI. (Mitchell's earlier actions are documented at Egelhof's homepage at
  5. http://www.cloud9.net/~jegelhof.)

  7. The plan is AOL's latest attempt to combat hackers distributing the
  8. program AOHell.  Several employees are discussing the best way respond.
  9.  
  10. Ironically, their accounts were hacked, and the e-mail posted to internet 
  11. newsgroups.

  15. alt.aol-sucks.

  45. basis, and keeping a report of this.

  60. Gentlemen:
  61.  
  62. I have provided Ellen Kirsh and Dave Phillips a short memo recommending
  63. the following (in light of our meeting with the FBI last week) which is
  64. pretty much what we are doing in any case and adds the Fed component:
  65.  
  66. (1) Webmaster and TOS will monitor newsgroups/web sites for AOHell
  67. distribution and will pass on the information to the Legal Department.  
  68.  
  69. (2) If its a web page distributing AOHell or a posting offering AOHell,
  70. Legal will contact the com/org/edu and notify them that their services is
  71. being used to distribute illegal hacking software.  Thus far, every
  72. com/org/edu has terminated the web site.  Postmasters at com/org/edus will
  73. determine whether the userid should be terminated pursuant to their
  74. applicable "TOS".  This is the best way for us to take action.  When we
  75. get our crimes specialist, he/she will undertake this effort.  In the
  76. meantime, I have been calling and have enlisted Preston Green's assistance
  77. in tracking things down and making certain calls.
  78.  
  79. (3) We will inform the com/org/edu that we are forwarding the info the FBI
  80. and they may be contacted soon.  Thus far, Agent McLean has been
  81. contacting those com/org/edus I have identified.  Thus, the FBI can
  82. investigate and do the leg work of tracking down Da Chronic.
  83.  
  84. Through this procedure we can take action ourselves to immediately (a) get
  85. the site/posting deleted and (b) get the perpetrator's service provider
  86. involved and perhaps terminate his/her userid.  Further, with the FBI, DOJ
  87. and US Attys. offices involved, they can handle the investigation better
  88. than we can as far as compiling a file of all names associated with
  89. distribution and tracking Da Chronic. Already I have been told that people
  90. are screaming (in some newsgroups) for AOHell 4 because web sites have
  91. been deleted (some I think through our efforts).

  93. Pete and Webmaster should coordinate monitoring activities.  For now, info
  94. should be sent to me and I'll divvy it out for action as per above.  Going
  95. forward, we should have monthly status meetings.  I will let you know
  96. about setting one up for next month when we can discuss our finalized and
  97. approved policy.
