  1. 1.  END-USER LICENSE AGREEMENT (Shareware) FOR WWIV SOFTWARE

  3. WWIV v4.30 is distributed as SHAREWARE.
  4.  
  5. Definition of SHAREWARE: Shareware is a software distribution method that
  6. allows the end user to install, use and conduct a thorough evaluation of
  7. the software for a specified period of time to determine if the software
  8. meets the needs of the user and its fitness for continued use.
  9.

  11.     1.1 GENERAL.  READ CAREFULLY: This End-User License Agreement
  12.         (EULA) is a binding legal agreement between you and WWIV Software
  13.         Services, LLC (WSS) and applies to WWIV v4.30 which includes all
  14.         software and documentation contained in the distribution archives
  15.         as provided by WSS (SOFTWARE).  WSS prosecutes violators of this
  16.         license agreement to the fullest extent of both federal and state
  17.         civil and criminal laws and statutes.

  19.     1.2 SOFTWARE LICENSE.
  20.  
  21.         IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS EULA, DO
  22.         NOT INSTALL OR USE THIS SOFTWARE! YOU ARE BOUND BY, AND INDICATE
  23.         YOUR EXPLICIT ACCEPTANCE OF, THE TERMS AND CONDITIONS OF THIS
  24.         AGREEMENT UPON FIRST EXECUTION OF INIT.EXE FILE.

  26.         THIS SOFTWARE IS PROTECTED BY US COPYRIGHT LAWS AND INTERNATIONAL
  27.         COPYRIGHT TREATIES, AS WELL AS INTELLECTUAL PROPERTY LAWS AND
  28.         TREATIES.

  30.         THIS SOFTWARE IS LICENSED, NOT SOLD.

  32.         a. General License Grant. WSS grants to you a personal, non
  33.            exclusive license to install one operational copy of the
  34.            SOFTWARE.  This installation is for the sole purposes of
  35.            evaluating the capabilities and features of the SOFTWARE for a
  36.            trial period not to exceed sixty (60) days.
  37.  
  38.         b. Termination of License.  Your license to use the SOFTWARE
  39.            terminates on the sixtieth day following the date of first
  40.            installation of the SOFTWARE unless sooner registered.  Upon
  41.            such termination, you must remove all operational copies of the
  42.            SOFTWARE you installed and discontinue all use of the SOFTWARE.

  44.         c. Documentation. This EULA grants you, as an individual, a
  45.            personal, nonexclusive license to make, use, and make available
  46.            for electronic download, an unlimited number of copies of the
  47.            documentation included in the distribution archive provided such
  48.            copies are not modified in any way and contain the original
  49.            copyright information.

  51.         d. Storage and Electronic Transfer of Distribution Archives. You
  52.            may store and make available for electronic download, in
  53.            unmodified form, a copy of the WWIV v4.30 Shareware archive
  54.            as distributed by WSS containing the original PKZip(r)
  55.            Authenticity Verification #XLD658
  56.  
  57.         e. De-compilation and Reverse Engineering.  You agree not to make
  58.            any attempts to de-compile, reverse engineer, or disassemble
  59.            the executable portions of the SOFTWARE to avoid the
  60.            requirement to register, modify copyright displays, or the
  61.            operational aspects of the SOFTWARE.

  64.     1.3 LIMITED WARRANTY.
  65.  
  66.         a. WSS warrants that the SOFTWARE will perform as described in the
  67.            included documentation for a period of sixty (60) days from the
  68.            date of first installation.  Any technical support provided by
  69.            WSS shall be as described in the included documentation
  70.            provided to you in the distribution archive.  WSS will make
  71.            reasonable efforts to solve any problem not covered in the
  72.            included documentation. To the maximum extent allowed by
  73.            applicable law, implied warranties on the SOFTWARE, if any, are
  74.            limited to sixty (60) days.

  76.         b. No other warranties are expressed or implied. To the maximum
  77.            extent allowed by applicable law, WSS disclaims all other
  78.            warranties and conditions, either express or implied, including
  79.            but not limited to, implied warranties, merchantability and/or
  80.            fitness for a particular purpose, with regard to the SOFTWARE
  81.            and the provision of or failure to provide support. This
  82.            limited warranty gives you specific legal rights. You may have
  83.            other rights, which vary from jurisdiction to jurisdiction.

  85.     1.4 CUSTOMER REMEDIES.  Your exclusive remedy shall be to notify WSS
  86.            of a suspected failure to meet the specifications of the
  87.            LIMITED WARANTY. WSS's entire liability will be replacement of
  88.            the SOFTWARE with an updated version if available.
