  10. PART 17--ENDANGERED AND THREATENED WILDLIFE AND PLANTS

  13.  
  14. Section 17.11 Endangered and threatened wildlife.
  15.  
  16.     (a) The list in this section contains the names of all species of
  17. wildlife which have been determined by the Services to be Endangered or
  18. Threatened.  It also contains the names of species of wildlife treated as
  19. Endangered or Threatened because they are sufficiently similar in
  20. appearance to Endangered or Threatened species (see Section 17.50 #et
  21. seq^.).
  22.  
  23.     (b) The columns entitled ``Common Name,'' ``Scientific Name,'' and
  24. ``Vertebrate Population Where Endangered or Threatened'' define the species
  25. of wildlife within the meaning of the Act.  Thus, differently classified
  26. geographic populations of the same vertebrate subspecies or species shall
  27. be identified by their differing geographic boundaries, even though the
  28. other two columns are identical.  The term ``Entire'' means that all
  29. populations throughout the present range of a vertebrate species are
  30. listed.  Although common names are included, they cannot be relied upon for
  31. identification of any specimen, since they may vary greatly in local usage.
  32.  
  33. The Services shall use the most recently accepted scientific name.  In
  34. cases in which confusion might arise, a synonym(s) will be provided in
  35. parentheses.  The Services shall rely to the extent practicable on the
  36. #International Code of Zoological Nomenclature.
  37.  
  38.     (c) In the ``Status'' column the following symbols are used: ``E'' for
  39. Endangered, ``T'' for Threatened, and ``E [or T] (S/A)'' for similarity of
  40. appearance species.
  41.  
  42.     (d) The other data in the list are nonregulatory in nature and are
  43. provided for the information of the reader.  In the annual revision and
  44. compilation of this title, the following information may be amended without
  45. public notice: the spelling of species' names, historical range, footnotes,
  46. references to certain other applicable portions of this title, synonyms,
  47. and more current names.  In any of these revised entries, neither the
  48. species, as defined in paragraph (b) of this section, nor its status may be
  49. changed without following the procedures of Part 424 of this title.
  50.  
  51.     (e) The ``historic range'' indicates the known general distribution of
  52. the species or subspecies as reported in the current scientific literature.
  53. The present distribution may be greatly reduced from this historic range. 
  54. This column does not imply any limitation on the application of the
  55. prohibitions in the Act or implementing rules.  Such prohibitions apply to
  56. all individuals of the species, wherever found. 
  57.  
  58.     (f)(1) A footnote to the #Federal Register^ publication(s) listing or
  59. reclassifying a species is indicated under the column ``When listed.''
  60. Footnote  numbers to Sections 17.11 and 17.12 are in the same numerical
  61. sequence, since plants and animals may be listed in the same #Federal
  62. Register^ document.  That document, at least since 1973, includes a
  63. statement indicating the basis for the listing, as well as the effective
  64. date(s) of said listing.
  65.  
  66.     (2) The ``Special rules'' and ``Critical habitat'' columns provide a
  67. cross reference to other sections in Parts 17, 222, 226, or 227.  The
  68. ``Special rules'' column will also be used to cite the special rules that
  69. describe experimental populations and determine if they are essential or
  70. nonessential.  Separate listing will be made for experimental populations,
  71. and the status column will include the following symbols: ``XE'' for an
  72. essential experimental population and ``XN'' for a nonessential
  73. experimental population.  The term ``NA'' (not applicable) appearing in
  74. either of these two columns indicates that there are no special rules
  75. and/or critical habitat for that particular species.  However, all other
  76. appropriate rules in Parts 17, 217 through 227, and 402 still apply to that
  77. species.  In addition, there may be other rules in this title that relate
  78. to such wildlife, e.g., port-of-entry requirements.  It is not intended
  79. that the references in the ``Special rules'' column list all the
  80. regulations of the two Services which might apply to the species or to the
  81. regulations of other Federal agencies or State or local governments.
  82.  
  83.     (g) The listing of a particular taxon includes all lower taxonomic
  84. units.  For example, the genus #Hylobates^ (gibbons) is listed as
  85. Endangered throughout its entire range (China, India, and SE Asia);
  86. consequently, all species, subspecies, and populations of that genus are
  87. considered listed as Endangered for the purposes of the Act.  In 1978 (43
  88. FR 62306233) the species #Haliaeetus leucocephalus^ (bald eagle) was listed
  89. as Threatened in ``USA (WA, OR, MN, WI, MI)'' rather than its entire
  90. population; thus, all individuals of the bald eagle found in those five
  91. States are considered listed as Threatened for the purposes of the Act.
  92.  
  93.     (h) The ``List of Endangered and Threatened Wildlife'' is provided
  94. below:

  455. plants which have been determined by the Services to be Endangered or
  456. Threatened. It also contains the names of species of plants treated as
  457. Endangered or Threatened because they are sufficiently similar in
  458. appearance to Endangered or Threatened species (see Section 17.50 #et
  459. seq^.)(b) The columns entitled ``Scientific name'' and ``Common name''
  460. define the species of plant within the meaning of the Act.  Although common
  461. names are included, they cannot be relied upon for identification of any
  462. specimen, since they may vary greatly in local usage.  The Services shall
  463. use the most recently accepted scientific name.  In cases in which
  464. confusion might arise, a synonym(s) will be provided in parentheses.  The
  465. Services shall rely to the extent practicable on the International Code
  466. of Botanical Nomenclature.
  467.  
  468.     (c) In the ``Status'' column the following symbols are used: ``E'' for
  469. Endangered, ``T'' for Threatened, and ``E [or T] (S/A)'' for similarity of
  470. appearance species.
  471.  
  472.     (d) The other data in the list are nonregulatory in nature and are
  473. provided for the information of the reader.  In the annual revision and
  474. compilation of this title, the following information may be amended without
  475. public notice: the spelling of species' names, historical range, footnotes,
  476. references to certain other applicable portions of this title, synonyms,
  477. and more current names.  In any of these revised entries, neither the
  478. species, as defined in paragraph (b) of this section, nor its status may be
  479. changed without following the procedures of Part 424 of this title.
  480.  
  481.     (e) The ``Historic range'' indicates the known general distribution of
  482. the species or subspecies as reported in the current scientific literature.
  483.  
  484. The present distribution may be greatly reduced from this historic range. 
  485. This column does not imply any limitation on the application of the
  486. prohibitions in the Act or implementing rules.  Such prohibitions apply to
  487. all individuals of the plant species, wherever found.
  488.  
  489.     (f)(1) A footnote to the #Federal Register^ publication(s) listing or
  490. reclassifying a species is indicated under the column ``When listed.''
  491. Footnote numbers to Sections 17.11 and 17.12 are in the same numerical
  492. sequence, since plants and animals may be listed in the same #Federal
  493. Register^ document.  That document, at least since 1973, includes a
  494. statement indicating the basis for the listing, as well as the effective
  495. date(s) of said listing.
  496.  
  497.     (2) The ``Special rules'' and ``Critical habitat'' columns provide a
  498. cross reference to other sections in Parts 17, 222, 226, or 227.  The
  499. ``Special rules'' column will also be used to cite the special rules which
  500. describe experimental populations and determine if they are essential or
  501. nonessential.  Separate listings will be made for experimental populations,
  502. and the status column will include the following symbols: ``XE'' for an
  503. essential experimental population and ``XN'' for a nonessential
  504. experimental population.  The term ``NA'' (not applicable) appearing in
  505. either of these two columns indicates that there are no special rules
  506. and/or critical habitat for that particular species.  However, all other
  507. appropriate rules in Parts 17, 217 through 227, and 402 still apply to that
  508. species.  In addition, there may be other rules in this title that relate
  509. to such plants, e.g., port-of-entry requirements.  It is not intended that
  510. the references in the ``Special rules'' column list all the regulations of
  511. the two Services which might apply to the species or to the regulations of
  512. other Federal agencies or State or local governments.
  513.  
  514.     (g) The listing of a particular taxon includes all lower taxonomic
  515. units (see Section 17.11(g) for examples).
  516.
