T-Mail License
(C) Copyright 1993, 1994, 1995 by Andy Elkin, hereinafter called
the author. All rights reserved.
COMMERCIAL DISTRIBUTION AND/OR USE PROHIBITED WITHOUT WRITTEN
PERMISSION OF THE COPYRIGHT HOLDER.
T-Mail is distributed as shareware. This means:
1. All copyrights to T-Mail are exclusively owned by the author.
2. Anyone may use this software during a test period of 60 days.
Following this test period of 60 days or less, if you wish to
continue to use T-Mail, you MUST register.
Two type of usage license are issued, at the current time:
.. Non-Commercial license. A system which is operating on not more
than TWO simultaneous lines AND which is NOT engaged, either
directly or indirectly, in attempting to make a profit. If you
collect fees for services provided, then you ARE a commercial
enterprise, whether you actually make a profit or not.
.. Commercial license. A system which is operating on THREE or
more simultaneous lines OR which is engaged, either directly or
indirectly, in making a profit.
3. Once registered, the user is granted a non-exclusive license to use
T-Mail on one computer (i.e. a single cpu) at a time, according to
the version/type of mailer license purchased. The registered T-Mail
software may not be rented or leased, but may be permanently
transferred, if the person receiving it agrees to the terms of this
license. If the software is an update, the transfer must include
the update and all previous versions.
4. T-Mail, unregistered shareware version, may be freely distributed,
provided the distribution package is not modified. No person or
company may charge a fee for the distribution of T-Mail without
written permission of the copyright holder.
5. To register you must complete the registration form and send it,
with the registration fee, to one of the authorized registration
sites, see REG_SITE.TXT.
6. WE PROVIDE ABSOLUTELY NO WARRANTY. EXCEPT WHEN OTHERWISE STATED IN
WRITING, THE AUTHOR AND/OR OTHER PARTIES PROVIDE T-MAIL "AS IS"
WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED,
INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF
MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE
RISK AS TO THE QUALITY AND PERFORMANCE OF T-MAIL, AND THE ACCURACY
OF ITS ASSOCIATED DOCUMENTATION, IS WITH YOU. SHOULD T-MAIL OR ITS
ASSOCIATED DOCUMENTATION PROVE DEFECTIVE, YOU ASSUME THE COST OF ALL
NECESSARY SERVICING, REPAIR OR CORRECTION.
IN NO EVENT WILL THE AUTHOR AND/OR ANY OTHER PARTY WHO MAY
REDISTRIBUTE T-MAIL AS PERMITTED ABOVE, BE LIABLE TO YOU FOR
DAMAGES, INCLUDING ANY LOST PROFITS, LOST MONIES, OR OTHER SPECIAL,
INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR
INABILITY TO USE (INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR DATA
BEING RENDERED INACCURATE OR LOSSES SUSTAINED BY THIRD PARTIES OR A
FAILURE OF THE PROGRAM TO OPERATE WITH ANY OTHER PROGRAMS) T-MAIL,
EVEN IF THE AUTHOR OR ANY OF HIS AGENTS HAVE BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY.
7. Installing and using T-Mail signifies acceptance of these terms and
conditions of the license.
8. If you don't agree with the terms of this license you must remove
all T-Mail files from your storage devices and cease to use the
product.
