  34. Conditions of access to ADULT section:
  35.  
  36. (The term GIF is a generic term describing digitized images or
  37. movies which are in a form capable of being transmitted over
  38. modems and viewed with appropriate software by a computer.)
  39.  
  40. The ADULT section may contain GIF pictures of nudity or sexual acts.
  41. USER desires access to such materials. Accordingly, the USER
  42. agrees:
  43.  
  44. A) The BBS will not grant ADULT access to any person below the age
  45. of 18, and, may refuse access to any person who cannot be
  46. verified as to age.
  47.  
  48. B) That USER will not share their password and other access
  49. information, and will take reasonable steps to insure that their
  50. password cannot be found by other users of their computer. If a
  51. family uses the same computer, the BBS will provide a separate
  52. password for adult users who are signatories to an application
  53. and for under age applicants.

  55.  
  56. C) The USER will indemnify the BBS system from any and all claims
  57. related to files which USER downloads or uploads from or to the
  58. BBS. That USER will take reasonable steps to insure that the
  59. files cannot be viewed by persons below the age of 18. Such
  60. reasonable steps could consist of, but are not limited to:
  61.  
  62. 1) locking disks containing the files in a secure area, or,
  63.  
  64. 2) using encryption so that GIF images received from this BBS are
  65. enciphered and not accessible by others, or,
  66.  
  67. 3) using password or other protection of access to the system,
  68. or,
  69.  
  70. 4) physically limiting access to the computer (ie., locking the
  71. computer in a room or area not open to others).
  72.  
  73. 4) That USER will not sell or otherwise commercially exploit the
  74. files and their images received through this BBS.
  75.  
  76. 5) In the event that USER uploads GIF's, the USER shall insure
  77. that all persons depicted are over 18 years of age. Further,  that
  78. USER will verify that such files are properly distributable  (ie.,
  79. do not violate copyright).
  80.  
  81. 6) That in the event USER has reasonable cause to believe that
  82. any GIF viewed depicts scenes in violation of the law, that USER
  83. will erase the same on their system and advise the BBS through a
  84. private message to the systems operator (SYSOP) of USER's
  85. concerns.

  87. 7) That user will take all legal responsibility for any materials
  88. downloaded from this BBS and that if said materials are indeed deemed
  89. inap
  90. propriate in USER's state that said USER will take any and ALLlegal responsibility for such transfer. The Cat's Den BBS is NOT
  91. responsible for ANY files downloaded by USER.

  93. 8) The BBS may bar a USER from the system for violation of these
  94. rules. The BBS may in addition refer to appropriate authorities
  95. any user transmitting unlawful sexually explicit pictures of
  96. children. The BBS may discontinue provision of a GIF section at
  97. any time in its sole discretion.

  215.     agreement  by the user to abide by ALL Rules & Policies outlined below  as
  216.     well  as updated rules,  policies, and responsibilities that may come into
  217.     effect  in the future.   In Return, THE CAT'S DEN BBS will, at its
  218.     convenience, Provide the named user access to its computer equipment and
  219.     services via modem.

  221. Rules, Policies, and Responsibilities;

  224.     1.  The User does not and will not hold THE CAT'S DEN BBS or other users
  225.     responsible for fit or fitness of any files or programs downloaded  from
  226.     this system,  for any or all damage incurred while  using said programs,
  227.     or time, damages, losses, either direct or consequential as a  result of
  228.     connection to/with the BBS.  FURTHER, every  user  explicitly acknowledges
  229.     that all information  obtained  from  THE  CAT'S  DEN BBS is provided
  230.     "as is" without  warranty  of  any  kind,  either expressed  or  implied,
  231.     including,  but  not  limited  to,  the   implied warranties  of
  232.     merchantability and fitness for a particular purpose and that the entire
  233.     risk of acting on information  obtained  from  THE CAT'S DEN BBS,
  234.     including the entire costs of all necessary remedies, is with those who
  235.     choose to act on such.

  237.     2. User's access to the BBS is solely at the discretion of THE CAT'S DEN
  238.     BBS system operator. Violation(s) of rules and policies set forth  herein
  239.     may result in the user being  denied  access,  temporary  or  permanent,
  240.     regardless of previous user subscription/security status.

  242.     3.  Pursuant to the Electronics and Communications Act of 1986,  Title 18,
  243.     United  States  Code,  Section  2510,  notice  is  hereby  given  that  no
  244.     facilities  are provided by this BBS  for  user-to-user  sending/receiving
  245.     private,  privileged  and/or   confidential   electronic   communications,
  246.     including,  but  not  limited  to:  credit  card  numbers  for  telephone/
  247.     telegraph common carriers, bank numbers or codes, pirated software, etc.

  249.     4.   User will not upload any files/programs that are designed to  hinder,
  250.     damage,  or disrupt this BBS,  another user or another  BBSs'  hardware  /
  251.     software   operation.    This   included   VIRUS,   TROJAN,    or    other
  252.     malicious  software.  Attempting to upload such a file/program to the  BBS
  253.     (even  if no damage has resulted)  will result in immediate denial to  the
  254.     BBS  and direct legal actions between THE CAT'S DEN BBS and the user  using
  255.     all applicable state/national/local laws.

  257.     5.  User will not allow any other person to use his/her name and  password
  258.     to gain access to the BBS.  Registered users will take full responsibility
  259.     for all actions, direct or indirect from said person(s).

  261.     6.   User will not attempt to mislead or defraud THE CAT'S  DEN BBS system
  262.     operator by using aliases (other  than  where  aliases  are  allowed) or
  263.     provided  misleading information (phone number, address, AGE,  etc.)  to
  264.     acquire higher BBS access or other privileges.

  266.     7.   THE CAT'S DEN BBS reserves the right to delete, set and/or change the
  267.     status of any message left on the BBS.  THE CAT'S DEN BBS does not guarantee
  268.     privacy  on  any  message  left  by  the  user.  User understands  that this
  269.    BBS is/was not intended for any  communication for which  the sender intends
  270.    only  the  communications messages on the BBS.

  272.     8.   User waives all claims against THE CAT'S DEN BBS, legal  or otherwise,
  273.    which may be incurred through the use and/or registration for the use of the
  274.    BBS.

  276.     9.  User will not constantly be offensive,  disruptive, or abusive towards
  277.     the  BBS, its users and its SysOp.  "offensive, disruptive and abusive" is
  278.     strictly  that which the system operator deems is  "offensive,  disruptive
  279.     and abusive."  We all have a bad day. Lets all just try and get along.

  281.     10.  Actively encourage and promote the free exchange  and  discussion  of
  282.     information, ideas & opinions, except when the content would break rule #9
  283.     (above)  and or compromise the national  security  of  the  United  States
  284.     violate proprietary rights,  personal privacy, or applicable state/federal
  285.     and  local  laws  and   regulations   affecting   telecommunications;   or
  286.     constitutes a crime or libel.

  288.     10a.  User are encouraged to read,  and contribute to the  public  message
  289.     bases.   Messages will be of quality and not deliberately offensive in any
  290.     way.  Users are given access to Net Mail  Conferences  based  on  age  and
  291.     access  levels and will be denied access to the on-line games,  and may be
  292.     DENIED  access, temporary or permanent,  to the BBS if  caught  trying  to
  293.     access areas not currently available to you.

  295.     10b.   If you are employed by any local, state, or federal law enforcement
  296.     agency for the purpose of entrapping the Sysops/Owners of THE CAT'S DEN

  300.     11.  User will contribute, as well as receive, quality software so long as
  301.     it does not violate proprietary copyright laws. Do not upload any software
  302.     product  unless  it  is  either  Public  Domain,  Freeware  or  Shareware.
  303.     Knowingly uploading a non-authorized commercial product without publishers
  304.     written authority and permission of THE CAT'S DEN BBS  is a  violation of
  305.     United  States copyright laws as well as a  violation of these Policies,
  306.     Rules & Regulations of THE CAT'S DEN BBS.

  308.     12.  It is each user's responsibility to report to  the  SysOp  any  known
  309.     violations  of any of the above Rules and  Policies.  In  addition,  users
  310.     should report any information deemed useful to other users and/or the  BBS
  311.     concerning fit & fitness for any file/program located on this BBS.

  313.     All Users MUST read, and agree to the above notices for access to this BBS
