  21.                   LEGISLATIVE COUNSEL'S DIGEST
  22. SJR 8, Mello: Controlled substances cannabis/marijuana
  23.   This measure would memorialize the President and the Congress
  24. of the United States to enact appropriate legislation to permit
  25. cannabis/marijuana to be prescribed by licensed physicians and to
  26. ensure a safe and affordable supply of cannabis/marijuana for
  27. medical use

  30.   WHEREAS, Scientific and medical studies by the National Academy
  31. of Science have shown cannabis/marijuana to be a safe and
  32. effective medicine with very low toxicity compared to most
  33. prescription drugs and it has been shown to be effective in the
  34. treatment of glaucoma, epilepsy, muscle spasticity, arthritis,
  35. the nausea, vomiting, and appetite loss associated with
  36. chemotherapies;anxiety and depression and the symptoms of
  37. withdrawal from alcohol and narcotics and
  38.   WHEREAS studies show that one-third of all cancer patient
  39. discontinue potentially life-saving chemotherapy due to the
  40. severe and debilitating side effects and the same is true for
  41. many AIDS patients receiving AZT or other (sinlilal- ) therapies
  42. and
  43.   WHEREAS, Most physicians surveyed said that they would
  44. prescribe cannabis/marijuana if legally available, and one-half
  45. of all cancer specialists surveyed said that they have already
  46. encouraged at least one of their patients to break the law and
  47. use cannabis/marijuana to ease the violent nausea and vomiting
  48. associated with their current treatments and
  49.   WHEREAS, In May of 1991, the United Nations Narcotic Control
  50. Board voted overwhelmingly to reclassify cannabis/marijuana,
  51. placing it back on Schedule II, and making it availabIe by
  52. prescription, and, the United States representative to this board
  53. voted in favor of the rescheduling and
  54.   WHEREAS, Despite a federal court order recognizing the "clearly
  55. established medical valuc" of cannabis/marijuana, and mandating
  56. that it be reclassified to Schedule II and made available by
  57. prescription, the federal government continues to deny access to
  58. this safe and effective medicine and
  59.   WHEREAS, By its own admission, the federal government continues
  60. to deny access to cannabis/marijualla for political rather than
  61. medical reasons, and are using patients as pawns in the ever-
  62. escalating war on drugs by following current policies which place
  63. message before medicine, convenience before compassion,and
  64. politics before patients now, therefore, be it
  65.   Resolved by the Senate and Assembly of the State of
  66. California,jointly, That the Legislature of the State of
  67. California respectfully memorializes the President and the
  68. Congress of the United States to enact appropriate legislation to
  69. permit cannabis/marijuana to be prescribed by licensed physicians
  70. and to ensure a safe and affordable supply of cannabis/marijuana
  71. for medical use; and be it further
  72.   Resolved, That the Secretary of the Senate transmit copies of
  73. this resolution to the President and Vice President of the United
  74. States, to the Speaker of the House of Representatives, and to
  75. each Senator and Representative from California in the Congress
  76. of the United States.
