  7. This file, LICENSE.DOC, describes the only terms by which Carric Moor Games
  8. permits other parties to distribute this program throughout the USA.
  9.  
  10. General terms:

  12. 1. Distribution by modem:
  13.  
  14. Carric Moor Games allows and encourages all bulletin board systems and 
  15. online services to distribute this game by modem as long as no files are 
  16. altered or removed.  If a distribution fee is charged for this software, 
  17. you must additionally ensure that:
  18.  
  19. A. Carric Moor Games is credited as the publisher of the file.
  20. B. The file is identified as shareware.
  21. C. The shareware concept is explained adequately elsewhere online.
  22. D. You charge less than $5 for downloading this shareware program.

  25. 2. Distribution of single programs by floppy disk:
  26.  
  27. Shareware vendors may distribute this program alone on a floppy disk if the
  28. following conditions are met:
  29.  
  30. A. You explain the shareware concept and describe this program as shareware.
  31.    (Shareware is "try-before-you-buy" software, and the price paid by users
  32.    for shareware is a distribution charge only).
  33. B. You credit Carric Moor Games as the publisher of this software in all
  34.    catalog descriptions and any other written descriptions.
  35. C. You sell the software for less that $5, and only sell the most current
  36.    version of it.
  37. D. If you want, you may include your own installation routines with
  38.    this program.
  39. E. Other than installation routines, no other programs may be included on
  40.    the floppy disk that contains this program, i.e. no bundling or multi-
  41.    program diskettes.
  42. F. No files are modified or deleted.

  45. 3. CD-Roms and multi-disk packs:

  47. If you wish to commercially distribute this program on a CD-Rom or a pack of
  48. several disks (through mail-order, wholesale, retail, or any other channels),
  49. you need to follow these terms and conditions:

  51. A. You explain the shareware concept and describe this program as shareware.
  52. B. You credit Carric Moor Games as the publisher of this software in all
  53.    catalogs and program descriptions.
  54. C. The front-cover packaging must contain the word "Shareware" in large type.
  55. D. No files may be modified or deleted.
  56. E. You must send us a copy of the CD-Rom as soon as it has been manufactured.

  59. 4. Any distribution in a retail environment:

  61. Any party wishing to sell Carric Moor Games products in a retail
  62. environment must meet all of the above conditions that apply, in addition
  63. to the following:

  65. A. The following must be included in large type on the front cover of all
  66.    packaging:  The name "Carric Moor Games", the name of this program, and
  67.    the word "Shareware".
  68. B. You must send us a copy of your packaging for every Carric Moor Games
  69.    program you distribute as soon as the packaging has been manufactured.

  72. 5. Bundling with hardware:

  74. You may bundle Carric Moor Games shareware products with new hardware 
  75. (computers, sound cards, etc) as long as you don't modify or delete any 
  76. program files, and as long as you provide the shareware programs free of 
  77. charge (i.e. at no additional cost) to the user when the hardware is 
  78. purchased.

  81. 5. Other distribution opportunities:

  83. Please contact us if you would like to distribute our shareware products
  84. in a new and unique way.  We are open to new opportunities, and we
  85. appreciate new and unique forms of distribution as a way of reaching
  86. new customers.

  89. 6. Violation of the agreement:

  91. If you distribute this software in violation of the terms of this agreement,
  92. you are liable to Carric Moor Games for damages of not less than $1 per copy
  93. distributed or the registration fee, whichever is greater.

  96. 7. Other terms and conditions:

  98. A. Trademarks: "Trademarks" refers to the name of this program and the
  99.    name Carric Moor Games,  which are trademarks of Carric Moor Games.
  100. B. Ownership: Except as expressly licensed by Carric Moor Games, we have 
  101.    and reserve the exclusive copyright and all other rights, title and
  102.    interest to distribute this program, and to use Trademarks in
  103.    connection with them.
  104. C. Current version: All previous versions of this program have been withdrawn
  105.    from shareware.  This version replaces any previous versions.
  106. D. Your right to distribute under this license is personal, and does not
  107.    include any right to sublicense the Program. 
  108. E. THE PROGRAM IS PROVIDED "AS-IS".  NO WARRANTIES OF ANY KIND,
  109.    EXPRESS OR IMPLIED, ARE MADE AS TO IT OR ANY MEDIUM IT MAY BE ON.
  110.    WE WILL PROVIDE NO REMEDY FOR INDIRECT, CONSEQUENTIAL, PUNITIVE
  111.    OR INCIDENTAL DAMAGES ARISING FROM IT, INCLUDING SUCH FROM
  112.    NEGLIGENCE, STRICT LIABILITY, OR BREACH OF WARRANTY OR CONTRACT,
  113.    EVEN AFTER NOTICE OF THE POSSIBILITY OF SUCH DAMAGES.
  114. F. TERM:  This License may be terminated by Carric Moor Games by giving a
  115.    30 day advance written notice.
  116. G. With respect to every matter arising under this License, you
  117.    consent to the exclusive jurisdiction and venue of the state
  118.    and federal courts sitting in New York State, and to service
  119.    by certified mail, return receipt requested, or as otherwise
  120.    permitted by law.

  123. 8. Thanks:  We thank you for distributing Carric Moor Games shareware 
  124.    products in accordance with the terms of this agreement.
