  32. CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS. IF YOU DO NOT AGREE  
  33. TO THE TERMS OF THIS AGREEMENT, PROMPTLY REMOVE THE SOFTWARE  
  34. TOGETHER WITH ALL COPIES FROM YOUR COMPUTER.  USER'S USE OF THIS  
  35. SOFTWARE IS CONDITIONED UPON COMPLIANCE BY USER WITH THE TERMS OF  
  36. THIS AGREEMENT. THE SOFTWARE MAY BE EVALUATED FOR THIRTY  DAYS  
  37. ON A ROYALTY FREE BASIS. CONTINUED USE AFTER EVALUATION IS CONDITIONED  
  38. UPON PAYMENT BY USER OF THE REGISTRATION FEE SPECIFIED IN THE FILE:  
  39. REGISTER.TXT FROM MCAFEE, INC. ("MCAFEE").

  41. 1. LICENSE GRANT. McAfee grants to you a non-exclusive, non-transferable  
  42.    right to use the SOFTWARE on file servers connected to a maximum  
  43.    number of user computers, or on a maximum number of user computers,  
  44.    not exceeding the number of user computers specified on the packaging  
  45.    for this product. This license to use the SOFTWARE is conditioned  
  46.    upon your compliance with the terms of this Agreement. You agree you  
  47.    will only copy the SOFTWARE into any machine-readable or printed form  
  48.    as necessary to use it in accordance with this license or for backup  
  49.    purposes in support of your use of the SOFTWARE. This license  
  50.    is effective until terminated. You may terminate it at any point by  
  51.    destroying the SOFTWARE together with all copies of the SOFTWARE.  
  52.    Also, McAfee has the option to terminate if you fail to comply with  
  53.    any term or condition of this Agreement. You agree upon such  
  54.    termination to destroy the SOFTWARE together with all copies of  
  55.    the SOFTWARE.  
  56.   
  57. 2. COPYRIGHT. The SOFTWARE is protected by United States copyright law  
  58.    and international treaty provisions. You acknowledge that no title to  
  59.    the intellectual property in the SOFTWARE is transferred to you. You  
  60.    further acknowledge that title and full ownership rights to the  
  61.    SOFTWARE will remain the exclusive property of McAfee or its  
  62.    suppliers, and you will not acquire any rights to the SOFTWARE  
  63.    except as expressly set forth in this license. You agree that any  
  64.    copies of the SOFTWARE will contain the same proprietary notices  
  65.    which appear on and in the SOFTWARE.  
  66.   
  67. 3. REVERSE ENGINEERING. You agree that you will not attempt to reverse  
  68.    compile, modify, translate, or disassemble the SOFTWARE in whole or  
  69.    in part.  
  70.   
  71. 4. LIMITED WARRANTY. McAfee warrants that the SOFTWARE will perform  
  72.    substantially in accordance with the accompanying written materials  
  73.    for a period of thirty (30) days from the date of purchase. Any  
  74.    implied warranties relating to the SOFTWARE are limited to thirty  
  75.    (30) days.  
  76.   
  77. 5. CUSTOMER REMEDIES. If the SOFTWARE does not conform to the limited  
  78.    warranty in Section 4 above ("Limited Warranty"), McAfee's entire  
  79.    liability and your sole remedy shall be, at McAfee's option, either  
  80.    to (a) correct the error or (b) help you work around or avoid the  
  81.    error. The Limited Warranty is void if failure of the SOFTWARE has  
  82.    resulted from accident, abuse, or misapplication. Any replacement  
  83.    SOFTWARE will be warranted for the remainder of the original Limited  
  84.    Warranty period.

  86. 6. NO OTHER WARRANTIES. McAfee DOES NOT WARRANT THAT THE SOFTWARE IS  
  87.    ERROR FREE. EXCEPT FOR THE EXPRESS LIMITED WARRANTY IN SECTION 4  
  88.    ("LIMITED WARRANTY"), McAfee DISCLAIMS ALL OTHER WARRANTIES WITH  
  89.    RESPECT TO THE SOFTWARE, EITHER EXPRESS OR IMPLIED, INCLUDING BUT  
  90.    NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANT ABILITY, FITNESS FOR  
  91.    A PARTICULAR PURPOSE AND NONINFRINGEMENT OF THIRD PARTY RIGHTS.  
  92.    SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES  
  93.    OR LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY MAY LAST, OR THE  
  94.    EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES,  
  95.    SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.  
  96.    THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO  
  97.    HAVE OTHER RIGHTS WHICH VARY FROM JURISDICTION TO JURISDICTION.

  99. 7. SEVERABILITY. In the event of invalidity of any provision of this  
  100.    license, the parties agree that such invalidity shall not affect the  
  101.    validity of the remaining portions of this license.

  103. 8. NO LIABILITY FOR CONSEQUENTIAL DAMAGES. IN NO EVENT SHALL MCAFEE OR  
  104.    ITS SUPPLIERS BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, SPECIAL,  
  105.    INCIDENTAL OR INDIRECT DAMAGES OF ANY KIND ARISING OUT OF THE  
  106.    DELIVERY, PERFORMANCE OR USE OF THE SOFTWARE, EVEN IF MCAFEE HAS  
  107.    BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT  
  108.    WILL McAfeeÆs LIABILITY FOR ANY CLAIM, WHETHER IN CONTRACT,  
  109.    TORT OR ANY OTHER THEORY OF LIABILITY, EXCEED THE LICENSE FEE  
  110.    PAID BY YOU, IF ANY.  
  111.   
  112. 9. GOVERNING LAW. This license will be governed by the laws of the  
  113.    State of California as they are applied to agreements between  
  114.    California residents entered into and to be performed entirely  
  115.    within California. The United Nations Convention on Contracts  
  116.    for the International Sale of Goods is specifically disclaimed.  
  117.   
  118. 10. ENTIRE AGREEMENT. This is the entire agreement between you and  
  119.    McAfee which supersedes any prior agreement or understanding,  
  120.    whether written or oral, relating to the subject matter of this  
  121.    license.

  123. U.S. GOVERNMENT RESTRICTED RIGHTS  
  124. If this product is acquired under the terms of a (i) Civilian Agency  
  125. Contract - use, reproduction or disclosure is subject to  
  126. FAR 52.227-19(a) through (d) and restrictions set forth in the  
  127. accompanying end user agreement; and (ii) DoD Contract - use,  
  128. duplication or disclosure by the Government is subject to the  
  129. terms of this license unless superseded by 252.227-7013(c)(1)(ii).
