  1.                LIMITED USE SOFTWARE LICENSE AGREEMENT

  4. This Limited Use Software License Agreement (the "Agreement") is a legal
  5. agreement between you and Sensor Based Systems, Inc. (SBS).
  6.  
  7. BY COPYING, USING OR DISTRIBUTING THIS SHAREWARE PROGRAM, YOU INDICATE
  8. YOUR AGREEMENT TO THE TERMS OF THIS LICENSE AGREEMENT.

  11. SBS Software License
  12. ~~~~~~~~~~~~~~~~~~~~
  13. 1. SBS grants the end-user the right to use the SBS shareware versions of
  14.    DeeP, HeeP and DeePbsp (the "Program"). You are permitted to load the
  15.    Program onto any storage device including RAM.
  16.  
  17.    You agree that you shall not modify, reverse compile, disassemble, or 
  18.    reverse engineer the Program.
  19.  
  20. 2. SBS grants a non-exclusive license to distribute the Program on IBM 
  21.    compatible media or Electronic Distribution royalty free under the 
  22.    following conditions:
  23.  
  24.   a) No copyright or trademark information may be removed.
  25.  
  26.   b) You cannot distribute any version of the Program with unauthorized 
  27.      changes, such as "hacking" or changing the contents of the ZIP file.
  28.  
  29.   c) The software must be distributed as a complete set including all
  30.      related documentation and files, including this Agreement.
  31.  
  32.   d) We are not liable for damage, loss and expense arising directly or 
  33.      indirectly from your acts and omissions in copying and distributing
  34.      the Program, including from any installation routine that you may add.
  35.  
  36. Except to the extent expressly licensed, Sensor Based Systems, Inc. (SBS)
  37. reserves the exclusive right to distribute the Program. Its content, 
  38. layout and format are the property of Sensor Based Systems to the extent 
  39. permitted by law.
  40.  
  41. If you intend to charge for copies of the Program, you must:
  42.  
  43.   a) Clearly market the Program as shareware.
  44.       
  45.   b) Include the your name, address and phone number on the packaging and 
  46.      in any added documentation.  This can be imprinted on the package or 
  47.      may be in the form of a label affixed to the box, carton or folder. 
  48.  
  49.   c) Any description of the Program included in a re-sellers catalog, sales 
  50.      brochure or other media must include reference to Sensor Based System 
  51.      Inc. being the creator of the Program, for example,  
  52.      including "Published by Sensor Based Systems, Inc."
  53.  
  54.   d) Sell only the newest version of the Program to your knowledge. 
  55.  
  56. If you wish to include the Program as part of a software bundle you must
  57. first obtain signed written permission from Sensor Based Systems Inc.
  58.  
  59.  
  60. LIMITED WARRANTY AND LIMITATION OF REMEDIES:

  62. If Sensor Based Systems Inc. provides a physically defective copy of the 
  63. Program, Sensor Based Systems Inc. will replace it after the defective copy 
  64. has been received.

  66. THE PROGRAM IS PROVIDED "AS-IS", AND NO WARRANTIES OF ANY KIND (INCLUDING 
  67. IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE), 
  68. EXPRESS OR IMPLIED, ARE MADE AS TO IT OR ANY MEDIUM IT MAY BE ON. OUR ENTIRE 
  69. LIABILITY AND YOUR EXCLUSIVE REMEDY IS SUCH REPLACEMENT, AND UNDER NO 
  70. CIRCUMSTANCES WILL WE PROVIDE ANY OTHER REMEDY FOR DIRECT, INDIRECT, SPECIAL,
  71. CONSEQUENTIAL, PUNITIVE, INCIDENTAL OR OTHER DAMAGES ARISING FROM IT,
  72. INCLUDING SUCH FROM NEGLIGENCE, STRICT LIABILITY, OR BREACH OF WARRANTY OR 
  73. CONTRACT, EVEN AFTER NOTICE OF THE POSSIBILITY OF SUCH DAMAGES.

  75. General

  77. This Agreement and the program or materials to which they apply are not
  78. assignable and may not be sublicensed, except as described herein.  If any
  79. provision or portions of this Agreement are invalidated under any applicable
  80. statute or rule of law, they are to that extent to be deemed omitted without
  81. affecting the remaining provisions thereof.

  83. YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT AND AGREE
  84. TO BE BOUND BY ITS TERMS WHEN YOU INSTALL THE SOFTWARE DESCRIBED HEREIN, AND 
  85. FURTHER AGREE THAT IS IT THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT 
  86. BETWEEN SBS AND YOU RELATING TO THE SUBJECT MATTER OF THIS AGREEMENT.
  87.  
  88. This Agreement shall be interpreted in accordance with and governed by the 
  89. laws of the State of Washington.
