  8. 1.0 Throughout this license, "the original archive" refers to the set of files
  9.     originally distributed by Glenn Fiedler (a.k.a Gaffer) as the Prometheus
  10.     Truecolor System Version 051 and all proceeding versions.
  11.  
  12. 1.1 This license revokes all previous licenses released for prior versions of
  13.     the Prometheus Truecolor System, and replaces them in entirety.
  14.  
  15. 1.2 Parties to this agreement include the licensor Gaffer (referring to the
  16.     sole owner of the Prometheus Truecolor System including all of its source
  17.     code and design), and the licensee "using" the Prometheus Truecolor
  18.     System, yourself (from here on referred to as "you"). "using" the
  19.     Prometheus Truecolor System includes linking the Prometheus Truecolor
  20.     System with your own code to form a "program". This "program" is referred
  21.     to as a "program using the Prometheus Truecolor System".

  23. 1.3 This license applies to all files distributed in the original archive,
  24.     including all source code, binaries and documentation, unless otherwise
  25.     stated in the file in its original, unmodified form as distributed in the
  26.     original archive. If you are unsure whether or not a particular file is
  27.     covered by this license, you must contact Gaffer to verify this.

  29. 1.4 The Prometheus Truecolor System is copyrighted material. Only this license
  30.     grants you the right to use it. Therefore, by "using" the Prometheus
  31.     Truecolor System, you indicate that you understand and accept all the
  32.     terms of this license.

  39. 2.0 Prometheus Truecolor System may freely be distributed (whereby
  40.     "distributed" refers to the act of transportation of the Prometheus
  41.     Truecolor System by any manner). The Prometheus Truecolor System can only
  42.     be distributed in its original, unmodified form as long as no fee is
  43.     charged for the Prometheus Truecolor System itself.

  45. 2.1 A fee, not exceeding 10USD, may be charged for the physical act of
  46.     copying, as long as it is clearly stated, that the Prometheus Truecolor
  47.     System itself is free and will always be distributed free of charge under
  48.     this license.

  50. 2.2 Whenever the Prometheus Truecolor System is distributed, this license must
  51.     be included in an unmodified form.

  53. 2.3 The Prometheus Truecolor System, or portions of it, may not be printed in
  54.     commercial publications, including, but not limited to, magazines, books
  55.     and newspapers without prior written permission from Gaffer.

  62. 3.0 Prometheus Truecolor System, or portions of it, may not be included as
  63.     parts of a commercial software package (including shareware), in source
  64.     code, object module or any other form. If you wish to use the Prometheus
  65.     Truecolor System commercially, you must contact Gaffer to arrange a
  66.     commercial license and a professional version of the Prometheus Truecolor
  67.     System.

  69. 3.1 Under this license, no "program using the Prometheus Truecolor System"
  70.     may be sold for any price, and neither may any fee be charged for the
  71.     right to use the program. The program and its documentation must clearly
  72.     state that it uses the Prometheus Truecolor System and that it may only be
  73.     freely used and distributed.

  78. PROMETHEUS TRUECOLOR SYSTEM IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND,
  79. EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF
  80. FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT WILL GAFFER BE LIABLE FOR ANY
  81. DAMAGES CAUSED BY THE USE OR INABILITY TO USE THE PROMETHEUS TRUECOLOR SYSTEM.
