  2.                LIMITED WARRANTY

  6. LIMITED MEDIA WARRANTY: Amiga Library Services warrants to the original
  7. purchaser only, that the storage media on which this material is recorded
  8. shall be free from defects in material and workmanship only for a period of
  9. ninety (90) days from the date of original purchase.  The duration of any
  10. statutorily implied warranty not excluded hereunder shall in no event
  11. exceed this ninety (90) day period.

  13. This warranty does not include defects arising from accident, abuse, or
  14. misapplication.  If a defect covered by this warranty occurs during this
  15. 90-day warranty period, and the media is returned to the dealer from whom
  16. it was acquired not later than five (5) days of the end of such 90-day
  17. period, the dealer may at his option replace the storage media with new
  18. media and return the defective media to Amiga Library Services for
  19. replacement.  If the dealer is unable or unwilling to replace the defective
  20. media under this media warranty, it can be returned directly to Amiga
  21. Library Services for replacement.

  23. This warranty gives you specific rights, you may have other rights which
  24. vary from state to state.  Some states do not allow limitations on how long
  25. an implied warranty lasts, so the above limitations may not apply to you.

  27. DISCLAIMER: EXCEPT AS SET FORTH ABOVE, THIS MATERIAL IS PROVIDED "AS IS"
  28. WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, STATUTORY OR
  29. OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF
  30. NONINFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.  THE
  31. ENTIRE RISK AS TO THE USE, RESULTS, AND PERFORMANCE OF THIS MATERIAL IS
  32. ASSUMED BY YOU AND IF THE PRODUCT SHOULD PROVE TO BE DEFECTIVE, YOU ASSUME
  33. THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR OTHER REMEDIATION.

  35. LIMITATION OF LIABILITY: THE LIABILITY OF AMIGA LIBRARY SERVICES IS LIMITED
  36. SOLELY TO THE REPAIR OR REPLACEMENT OF THE APPLICABLE STORAGE MEDIA.  IN NO
  37. EVENT SHALL AMIGA LIBRARY SERVICES AND/OR THE INDIVIDUAL AUTHORS BE LIABLE
  38. FOR ANY PROPERTY DAMAGE, PERSONAL INJURY, LOSS OF USE, OR OTHER INDIRECT,
  39. INCIDENTAL, OR CONSEQUENTIAL COSTS, EXPENSES OR DAMAGES, INCLUDING WITHOUT
  40. LIMITATION, ANY DAMAGES FOR LOST PROFITS, BUSINESS INTERRUPTION, OR DATA
  41. WHICH MAY BE LOST OR RENDERED INACCURATE, EVEN IF AMIGA LIBRARY SERVICES
  42. AND/OR THE INDIVIDUAL AUTHORS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH
  43. DAMAGES.

  45. Some states do not allow limitations of consequential or incidental
  46. damages, or exclusions of implied warranties, so these limitations or
  47. exclusions may not apply to you.
