  25.         We belive that QuickBBS is the finest software of its kind
  26.         available at any price.  It will continue to improve in the
  27.         future with continued support of people like yourself, who have
  28.         demonstrated your faith and support in QuickBBS by purchasing
  29.         the GOLD KEY registration.  We believe your faith will have
  30.         been rewarded and that you feel and will continue to feel, that
  31.         your investment has been worthwhile.

  33.         A note on the contents of these diskettes.  These are your
  34.         GOLD releases and are not quite the same as the distribution
  35.         release, in that they do not have the conversion software such
  36.         as 266to275.exe in them.  In that sense, they are incomplete
  37.         and therefore should NOT be distributed.  The 'missing' software
  38.         is not required as you are already running a version of 2.75
  39.         and should not have to convert again.
  40.  
  41.         We will be making an announcement regarding the termination
  42.         or modification of the GOLD KEY program in about 30 days.
  43.         This announcement is NOT for you!  You will be given the option
  44.         to renew or extend your GOLD KEY at a reduced price because
  45.         you had enough faith in us to send your money even when we didn't
  46.         have a product.

  57. PEGASUS SOFTWARE hereby grants [_GOLD KEY HOLDER_] a site LICENSE for
  58. one (1) computer for the use of the following software programs:

  68. as contained in the GOLD RELEASE version 2.75 and specifically released as
  69. GOLD275a.zip and GOLD275b.zip.

  71.      Provided a fee has been paid to PEGASUS SOFTWARE and a signed order form
  72.      has been tendered and for the version(s) and packages registered:

  74. This is a perpetual LICENSE for the use of the registered software within your
  75. private domicile, and is not transferable.  This LICENSE allows internal
  76. use and copying of the software by as many users/ machines as contracted for.
  77. Individual, Non-commercial users are entitled to run QuickBBS on ONE machine
  78. regardless of how many nodes are running.  Users running on LAN's in a
  79. non-commercial environment may run QuickBBS on as many nodes as they desire
  80. as long as the software resides only on one node/server.  You may make
  81. reasonable backups of the installed software, PROVIDED you do not distribute
  82. said installed software IN ANY FORM to any other entity, or run said
  83. software on any other machine, whether your machine or not except as noted
  84. above regarding LAN operation.

  86. GENERAL RESTRICTIONS and TERMS of this LICENSE
  87.  
  88. Modification in any form of any of the software LICENSED herein is specifically
  89. prohibited, except with written permission of PEGASUS SOFTWARE.  If
  90. modification is authorized, said modified software may not be distributed to
  91. any 3rd party.
  92.  
  93. Disassembly, or reverse engineering of any of the LICENSED software is
  94. prohibited, except with written permission of PEGASUS SOFTWARE.
  95.  
  96. Distribution, repackaging, or reselling of the software or documentation
  97. to third parties, is not allowed under this agreement in any form.
  98.  
  99. This LICENSE is revokable by PEGASUS SOFTWARE if payment for the registration
  100. is not made, or if a check or credit card charge is dishonored.  It is
  101. also revokable if this software product is used for, or facilitates any
  102. illegal act as defined by Federal, State, or local laws.  Violation of any
  103. of the terms of this LICENSE automatically voids the LICENSE, and it
  104. shall be considered revoked and null and void at the time of the violation
  105. with, or without formal notice from PEGASUS SOFTWARE.
  106.  
  107. The LICENSOR warrants that it is sole owner of the software and has full 
  108. power and authority to grant this LICENSE herein without consent of any
  109. other party.
  110.  
  111. PEGASUS SOFTWARE hereby disclaims all warranties relating to this software,
  112. whether express or implied, including without limitation any implied 
  113. warranties of merchantability or fitness for a particular purpose. 
  114. PEGASUS SOFTWARE will not be liable for any special, incidental, consequential,
  115. indirect or similar damages due to loss of data or any other reason, 
  116. even if PEGASUS SOFTWARE or an agent of PEGASUS SOFTWARE has been advised
  117. of the possibility of such damages.  In no event shall PEGASUS SOFTWARE's
  118. liability for any damages ever exceed the price paid for the LICENSE to
  119. use the software, regardless of the form of the claim.  The person
  120. using the software bears all risk as to the quality and performance
  121. of the software.
  122.  
  123. This agreement shall be construed and enforced in accordance with the 
  124. laws of the STATE OF FLORIDA.  Any action or proceeding brought by
  125. either party against the other arising out of or related to this 
  126. agreement shall be brought only in a STATE or FEDERAL COURT of competent 
  127. jurisdiction located in ORANGE county, FLORIDA.  The parties hereby
  128. consent to in personam jurisdiction of said courts.
  129.  
  130. This LICENSE superceeds all terms and conditions contrary to those contained
  131. in the document 'LICENSE.DOC' as contained elsewhere in this release package.
  132. All other terms of the document 'LICENSE.DOC' not in conflict with this
  133. QUICKBBS GOLD LICENSE, are incorporated herein by referance.
