  11. BY INSTALLING AND EXECUTING THE DataPage Maker(tm) SOFTWARE 
  12. ACCOMPANYING THIS LICENSE, YOU ARE CONSENTING TO BE BOUND 
  13. BY AND ARE BECOMING A PARTY TO THIS AGREEMENT. IF YOU DO NOT 
  14. AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, YOU MUST DELETE 
  15. THE DataPage Maker SOFTWARE FROM YOUR HARDDRIVE.

  17. EVALUATION LICENSE.  Entity Master Systems hereby grants you
  18. a non exclusive license to use its DataPage Maker software
  19. product ("Software") free of charge for non-commercial, 
  20. educational, evaluation or personal purposes only.  The 
  21. evaluation period is active for 30 days.
  22.  
  23. REGISTERED LICENSE.  Entity Master Systems hereby grants you
  24. a non exclusive license to use its DataPage Maker software
  25. product ("Software") with payment of the Registration Fee
  26. for any purposes, except for the restrictions described below.
  27.  
  28. LIMITATIONS.  Please note that your use under this license 
  29. is strictly limited.  You may not: sell the Software or license 
  30. it for any consideration, permit other individuals to use the 
  31. Software except under the terms listed above; modify, translate, 
  32. reverse engineer, decompile, disassemble (except to the extent 
  33. applicable laws specifically prohibit such restriction), or 
  34. create derivative works based on the Software; copy the 
  35. Software (except for back-up purposes); rent, lease, transfer 
  36. or otherwise transfer rights to the Software; or remove any 
  37. proprietary  notices or labels on the Software.
  38.  
  39. TITLE. Title, ownership rights, and intellectual property rights 
  40. in and to the Software shall remain with Entity Master Systems 
  41. and/or its suppliers. The Software is protected by the copyright 
  42. laws of the United States and international copyright treaties.  
  43. Title, ownership rights, and intellectual property rights in and 
  44. to the content accessed through the Software is the property of 
  45. the applicable content owner and may be protected by applicable 
  46. copyright or other law. This License gives you no rights to such 
  47. content.  
  48.  
  49. DISCLAIMER OF WARRANTY.  The Software is provided for evaluation
  50. on an "AS IS" basis, without warranty of any kind, including 
  51. without limitation the warranties of merchantability, fitness 
  52. for a particular purpose and non-infringement. The entire risk 
  53. as to the quality and performance of the Software is borne by 
  54. you.  Should the Software prove defective, you and not Entity 
  55. Master System assume the entire cost of any service and repair.  
  56. This disclaimer of warranty constitutes an essential part of the 
  57. agreement.

  59. SOME STATES DO NOT ALLOW EXCLUSIONS OF AN IMPLIED WARRANTY,     
  60. SO THIS DISCLAIMER MAY NOT APPLY TO YOU AND YOU MAY HAVE        
  61. OTHER LEGAL RIGHTS THAT VARY FROM STATE TO STATE OR BY  
  62. JURISDICTION.
  63.  
  64. LIMITATION OF LIABILITY. IN NO EVENT SHALL ENTITY MASTER 
  65. SYSTEMS BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, 
  66. OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT 
  67. LIMITATION, THOSE RESULTING FROM LOSS OF USE, DATA, OR PROFITS, 
  68. WHETHER OR NOT ENTITY MASTER SYSTEMS HAS BEEN ADVISED OF THE 
  69. POSSIBILITY OF DAMAGE, OR ON ANY THEORY OF LIABILITY, ARISING 
  70. OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THIS 
  71. SOFTWARE.
  72.  
  73. TRADEMARKS.  Entity Master System (EMS), the EMS logo, and 
  74. DataPage Maker are trademarks of Entity Master System, a DBA 
  75. registered in Galveston County, Texas.  All other trademarks 
  76. are the property of their respective owners.
  77.  
  78. TERMINATION.  This license will terminate automatically if 
  79. you fail to comply with the limitations described above.  
  80. On termination, you must destroy all copies of the Software.
  81.  
  82. EXPORT CONTROLS.  None of the Software or underlying information 
  83. or technology may be downloaded or otherwise exported or 
  84. reexported:
  85.  
  86. a.  into (or to a national or resident of) Cuba, Iraq, Libya, 
  87. Yugoslavia, North Korea, Iran, Syria or any other country to which 
  88. the U.S. has embargoed goods; or 
  89.  
  90. b.  to anyone on the U.S. Treasury Department's list of Specially 
  91. Designated Nationals or the U.S. Commerce Department's Table of 
  92. Deny Orders. 
  93.  
  94. By downloading or using the Software, you are agreeing to the 
  95. foregoing and you represent and warrant that you are not located 
  96. in, under the control of, or a national or resident of any such 
  97. country or on any such list.
