  112. If either party becomes aware of a potential infringement of the
  113. licensed patents, they shall immediately notify the other party
  114. of the same.

  118. potential infringement. If the parties cannot agree as to a
  119. common strategy for the same, then the parties shall be free to
  120. bring litigation in accordance with the applicable laws for a
  121. resolution of the potential infringement.

  126. The parties may from time to time exchange confidential
  127. information. All such information if written shall be marked
  128. "Confidential" or "Trade Secret" or other clear indication of its

  131. send a written notice to the other party specifying which
  132. information is claimed to be confidential.

  135. The parties shall use reasonable efforts not to disclose the same
  136. for a period of @111 months after the termination of this

  141. fault of the parties hereto;

  145. whichever is earlier.

  149. prior to the disclosure, then that party shall not be bound to
  150. keep the same confidential.

  155. In the event that the patents licensed hereunder are found to be
  156. invalid in an order for which no further appeal is taken, or from
  157. which no further appeal is possible, the license shall then

  159. license does not conflict with any agreements to which INVENTOR
  160. is a party.

  163. INVENTOR and his legal or accounting representatives shall have
  164. the right to inspect business records of LICENSEE to verify the
  165. payment of royalties.
