  14.              SHAREWARE DESCRIPTION AND LICENSE AGREEMENT

  17. All users and distributors of TAXFORMS.EXE are deemed to have read
  18. and consented to this license agreement.
  19.  
  20. Any legal interpretation of and/or legal action brought on this
  21. license agreement will be subject to the laws of the Province of
  22. Ontario, Canada, and to the federal laws of Canada.
  23.

  25. DEFINITION OF SHAREWARE 
  26. -----------------------
  27.  
  28. Shareware distribution gives users a chance to try software before 
  29. buying it. If you try a Shareware program and continue using it, you
  30. are expected to register. Individual programs differ on details -- 
  31. some request registration while others require it, some specify a
  32. maximum trial period. With registration, you get anything from the 
  33. simple right to continue using the software to an updated program 
  34. with printed manual. 
  35.  
  36. Copyright laws apply to both Shareware and commercial software, and 
  37. the copyright holder retains all rights, with a few specific 
  38. exceptions as stated below. Shareware authors are accomplished 
  39. programmers, just like commercial authors, and the programs are of 
  40. comparable quality. (In both cases, there are good programs and bad 
  41. ones!) The main difference is in the method of distribution. The
  42. author specifically grants the right to copy and distribute the 
  43. software, either to all and sundry or to a specific group. For
  44. example, some authors require written permission before a commercial
  45. disk vendor may copy their Shareware.

  47. Shareware is a distribution method, not a type of software. You
  48. should find software that suits your needs and pocketbook, whether
  49. it's commercial or Shareware. The Shareware system makes fitting
  50. your needs easier, because you can try before you buy. And because
  51. the overhead is low, prices are low also. Shareware has the ultimate
  52. money-back guarantee -- if you don't use the product, you don't pay
  53. for it.

  56. DISCLAIMER - AGREEMENT

  59. Users of TAXFORMS.EXE must accept this disclaimer of warranty
  60. comprised of the following sub paragraphs numbered 1 through 6 and
  61. the "ADDITIONAL TERMS AND CONDITIONS OF USE" which follows those
  62. sub paragraphs.
  63.  
  64. 1.   Anthistle Systems & Programming Ltd. disclaims all warranties
  65.      relating to this software, whether express or implied,
  66.      including but not limited to any implied warranties of
  67.      merchantability and fitness for a particular purpose, and all
  68.      such warranties are expressly and specifically disclaimed.
  69.  
  70. 2.   Anthistle Systems & Programming Ltd. makes all software
  71.      available solely on an "as is" basis.
  72.  
  73. 3.   Neither Anthistle Systems & Programming Ltd. nor anyone else
  74.      who has been involved in the creation, production, or delivery
  75.      of this software shall be liable for any special, collateral,
  76.      indirect, consequential, or incidental damages arising out of
  77.      the purchase or use or inability to use such software even if
  78.      Anthistle Systems & Programming Ltd. has been advised of the
  79.      possibility of such damages or claims.

  81. 4.   Anthistle Systems & Programming Ltd. reserves the right to make
  82.      changes to any and all parts of this software, at any time,
  83.      without obligation to notify any person or entity of such
  84.      changes.
  85.  
  86. 5.   The sole and exclusive liability of Anthistle Systems &
  87.      Programming Ltd., regardless of the form of action, shall not
  88.      exceed the Purchase Price (excluding any Annual Update Fees)
  89.      Paid. Moreover, Anthistle Systems & Programming Ltd. shall not
  90.      be liable for any claim of any kind whatsoever by any other
  91.      party against the user of the programs.

  93. 6.   This agreement shall be governed by the laws of Canada and of
  94.      the Province of Ontario, Canada and shall inure to the benefit
  95.      of Anthistle Systems & Programming Ltd. and any successors,
  96.      administrators, heirs and assigns.  Any action or proceeding
  97.      brought by either party against the other arising out of or
  98.      related to this agreement shall be brought only in a Provincial
  99.      or Canadian Federal Court of competent jurisdiction located in
  100.      the Region of Halton, Ontario, Canada, or if action is brought
  101.      in a Federal Court and no such court is located in the Region
  102.      of Halton then the action will be brought in the Federal Court
  103.      located closest to the town of Oakville, Ontario. The parties
  104.      hereby consent to in personam jurisdiction of said courts.

  108. ADDITIONAL TERMS AND CONDITIONS OF USE
  109. --------------------------------------
  110.  
  111. TAXFORMS.EXE is a "shareware program" and is provided at no charge
  112. to the user for evaluation.  Feel free to share the shareware
  113. version with your friends, but please do not give it away altered or
  114. as part of another system.  The essence of "user-supported" software
  115. is to provide personal computer users with quality software without
  116. high prices, and yet to provide incentive for programmers to
  117. continue to develop new products.  If you find this program useful
  118. and find that you are using TAXFORMS.EXE and continue to use
  119. TAXFORMS.EXE after a reasonable trial period, you must make a
  120. registration payment of U.S.$50.00 to ANTHISTLE SYSTEMS &
  121. PROGRAMMING LTD.  The U.S.$50.00 registration fee will license one
  122. copy for use on any one computer at any one time.  You must treat
  123. this software just like a book.  An example is that this software
  124. may be used by any number of people and may be freely moved from one
  125. computer location to another, so long as there is no possibility of
  126. it being used at one location while it's being used at another. Just
  127. as a book cannot be read by two different persons at the same time.

  129. Users of TAXFORMS.EXE must register and pay for their copies of
  130. TAXFORMS.EXE within 30 days of first use or their license is
  131. withdrawn.  Continued use after that without payment is a violation
  132. of copyright laws.  Site-License arrangements may be made by
  133. contacting ANTHISTLE SYSTEMS & PROGRAMMING LTD.

  135. Anyone distributing TAXFORMS.EXE for any kind of remuneration must
  136. first contact ANTHISTLE SYSTEMS & PROGRAMMING LTD. at the address
  137. above for authorization. This authorization will be automatically
  138. granted to distributors recognized by the Association of Shareware
  139. Professionals (ASP) as adhering to its guidelines for shareware
  140. distributors, and such distributors may begin offering TAXFORMS.EXE
  141. immediately (However ANTHISTLE SYSTEMS & PROGRAMMING LTD. must still
  142. be advised so that the distributor can be kept up-to-date with the
  143. latest version of TAXFORMS.EXE.).
  144.  
  145. You are encouraged to pass a copy of TAXFORMS.EXE along to your
  146. friends for evaluation.  Please encourage them to register their
  147. copy if they find that they can use it.  All registered users will
  148. receive a copy of the latest version of the TAXFORMS.EXE system.
