  10. Corporate and Governmental Site License

  12. This is a license for use of the software within your company or
  13. government agency, and is not transferable.  This allows internal
  14. use and copying of the software for as many sites / computers as
  15. contracted for.  (See the ORDER FORM for Site License price schedule).
  16. Allows copying of the software for internal use by your company or
  17. government agency.  Distributing, repackaging, or reselling of the
  18. software to third parties is not allowed.  All licenses are prepaid.

  23. This license is not necessary for clubs or user groups distributing 
  24. the software on a SHAREWARE basis, providing that the entire 
  25. PKZFIND/PKZOOM package with accompanying documentation files is included
  26. in the distribution, and no more than a nominal fee (not to exceed
  27. $10) is charged for such distribution.

  52. company, and is not transferable.  This license allows internal use and 
  53. copying of the software by as many users/ machines as contracted for.  
  54. Distribution, repackaging, or reselling of the software, to third 
  55. parties, is not allowed under this agreement.

  57. The LICENSOR warrants that it is sole owner of the software and has full 
  58. power and authority to grant this license herein without consent of any 
  59. other party.

  61. PKWARE hereby disclaims all warranties relating to this software, 
  62. whether express or implied, including without limitation any implied 
  63. warranties of merchantability or fitness for a particular purpose. 
  64. PKWARE will not be liable for any special, incidental, consequential, 
  65. indirect or similar damages due to loss of data or any other reason, 
  66. even if PKWARE or an agent of PKWARE has been advised of the possibility 
  67. of such damages.  In no event shall PKWARE's liability for any damages 
  68. ever exceed the price paid for the license to use the software, 
  69. regardless of the form of the claim.  The person using the software 
  70. bears all risk as to the quality and performance of the software.

  72. This agreement shall be construed and enforced in accordance with the 
  73. laws of the STATE OF WISCONSIN.  Any action or proceeding brought by 
  74. either party against the other arising out of or related to this 
  75. agreement shall be brought only in a STATE or FEDERAL COURT of competent 
  76. jurisdiction located in Milwaukee county, Wisconsin.  The parties hereby 
  77. consent to in personam jurisdiction of said courts.
