  9. NOTICE TO USER: You should carefully read the following terms and conditions 
  10. before using this software.  Use of this software indicates you agree to be bound 
  11. by the terms of this Agreement. The Space Screen Saver package contains software 
  12. ("Software") - and includes all files supplied in the package including any 
  13. images, "applets", photographs, animations, video, audio, music and text 
  14. incorporated into the Software. The term "Software" shall also include any 
  15. upgrades, modified versions, updates, additions and copies of the Software 
  16. licensed to you by Image Factory Software. This Agreement applies to both the 
  17. unregistered version of Space Screen Saver ("Unregistered Version") - a trial 
  18. version for which no payment has yet been made - and the registered version for 
  19. which payment has been made ("Registered Version"). Image Factory Software 
  20. grants to you a nonexclusive license to use the Software provided that you agree to 
  21. the following:

  24. 1. Use of the Software.

  26. Unregistered Version. You may -
  27. Install the Software on as many locations as you wish and trial the Software for 
  28. evaluation purposes without charge. The Software will run in full operation 
  29. mode for 10 days from installation - allowing you to make a full evaluation of 
  30. the software. After this trial period the Space Screen Saver will run in read only 
  31. mode - allowing you to view any data you have entered but not to enter any new 
  32. data. Similarly, the screen saver will no longer run in full operation mode - 
  33. showing only one image at a time before returning to the original screen - rather 
  34. than cycling through the image collection. To operate as the full version of the 
  35. software a registration fee is required. The site from which you downloaded the 
  36. Software has full details about the registration fee - and how to pay the fee.

  38. Please include the full "licence" number when making the payment - and a 
  39. contact point (Internet or Compuserve address). Your "licence" number is 
  40. unique and can be easily found at the top of the "Registration Details" box or 
  41. the "About" box in the Space Screen Saver "Settings" panel - and starts with 
  42. "X..." eg  "X2915-9255/47-30/000"). Your "licence" number requires a 
  43. similarly unique "registration" number which will be sent to you (to the 
  44. foregoing contact point). When you receive the "registration" number simply 
  45. press the button marked "Register" at the top right of the "Registration Details" 
  46. box in the Space Screen Saver "Settings" panel - and follow the instructions. Once 
  47. registered the Space Screen Saver and Screen Saver will run indefinitely - in full 
  48. operation mode.

  50. Registered Version. You may-
  51.   Install the Software in a single location on a hard disk or other storage 
  52. device.
  53.   Make one backup copy of the Software, provided your backup copy is not 
  54. installed or used on any computer.

  57. 2. Copyright - Unregistered and Registered Versions. 
  58.  
  59. The Software is the intellectual property of Image Factory Software and its 
  60. suppliers and is protected by copyright law, international treaty provisions, and 
  61. applicable laws of the country in which it is being used. The structure, 
  62. organization and code of the Software are the valuable trade secrets and 
  63. confidential information of Image Factory Software and its suppliers. Therefore 
  64. you must treat the Software just as you would any other copyrighted material 
  65. such as a book. In other words you may not copy the Software except as set 
  66. forth in the "Use of the Software" section. Any copies that you are permitted to 
  67. make pursuant to this Agreement must contain the same copyright and other 
  68. proprietary notices which appear on or in the Software. You agree not to 
  69. modify, adapt, translate, reverse engineer, decompile, disassemble or otherwise 
  70. attempt to discover the source code of the Software. Trademarks shall be used 
  71. in accordance with accepted trademark practice, including identification of 
  72. trademark owner's name. Trademarks can only be used to identify printed 
  73. output produced by the Software. The use of any trademark as herein 
  74. authorized does not give you any rights of ownership in that trademark. Except 
  75. as stated above, this Agreement does not grant you any rights to intellectual 
  76. property rights in the Software. To the extent that local laws grants you the 
  77. right to decompile the Software in order to obtain information necessary to 
  78. render the Software interoperable with other software, you shall first request 
  79. Image Factory Software to provide you with the necessary information. Image 
  80. Factory Software has the right to impose reasonable conditions such as a 
  81. reasonable fee for doing so.

  84. 3. Transfer. - Unregistered and Registered Versions.

  86. You may not rent, lease, sublicense, or lend the Software. You may, however, 
  87. transfer all your rights to use the Software to another person or legal entity 
  88. provided that you transfer this Agreement and transfer (or destroy), the 
  89. Software, including all copies, updates and prior versions, to such person or 
  90. entity and provided that you retain no copies, including copies stored on your 
  91. computer.

  94. 4. Disclaimer of Warranty - Unregistered and Registered Versions.

  96. THIS SOFTWARE IS SOLD "AS IS". IMAGE FACTORY SOFTWARE AND 
  97. ITS SUPPLIERS DO NOT AND CANNOT WARRANT THE 
  98. PERFORMANCE OR RESULTS YOU MAY OBTAIN BY USING THE 
  99. SOFTWARE. IMAGE FACTORY SOFTWARE AND ITS SUPPLIERS 
  100. MAKE NO WARRANTIES, EXPRESS OR IMPLIED, AS TO 
  101. NONINFRINGEMENT OF THIRD-PARTY RIGHTS, MERCHANTABILITY, 
  102. OR FITNESS FOR ANY PARTICULAR PURPOSE.

  105. 5. Limitation of Liability - Unregistered and Registered Versions.

  107. ANY LIABILITY OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO 
  108. PRODUCT REPLACEMENT OR REFUND OF PURCHASE PRICE. IN NO 
  109. EVENT WILL IMAGE FACTORY SOFTWARE OR ITS SUPPLIERS BE 
  110. LIABLE TO YOU FOR ANY CONSEQUENTIAL, INCIDENTAL OR 
  111. SPECIAL DAMAGES, INCLUDING ANY LOST PROFITS OR LOST 
  112. SAVINGS, EVEN IF AN IMAGE FACTORY SOFTWARE 
  113. REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF 
  114. SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY.

  117. 6. Governing Law and General Provisions. - Unregistered and Registered 
  118. Versions.

  120. This Agreement will be governed by the laws in force in West Australia 
  121. excluding the application of its conflicts of law rules. This Agreement will not 
  122. be governed by the United Nations Convention on Contracts for the 
  123. International Sale of Goods, the application of which is expressly excluded. If 
  124. any part of this Agreement is found void and unenforceable , it will not affect 
  125. the validity  of the balance of the Agreement, which shall remain valid and 
  126. enforceable according to its terms. This Agreement shall automatically 
  127. terminate upon failure by you to comply with its terms. This Agreement may 
  128. only be modified in writing signed by an authorized officer of Image Factory 
  129. Software.
