  3. PLEASE READ THIS LICENSE CAREFULLY BEFORE USING THE 
  4. SOFTWARE.  BY USING THE SOFTWARE, YOU 
  5. ARE AGREEING TO BE BOUND BY THE TERMS OF THIS LICENSE.  IF YOU 
  6. DO NOT AGREE TO THE TERMS OF THIS LICENSE, YOU ARE NOT 
  7. AUTHORIZED TO USE THIS SOFTWARE.

  9. 1.    License.  The application, demonstration, system and other 
  10. software accompanying this License, whether on disk, in read only 
  11. memory, or on any other media (the "Imagine Software") and related 
  12. documentation are licensed to you by Imagine.  You own the disk on 
  13. which the Imagine Software is recorded but Imagine and/or Imagine's 
  14. Licensor(s) retain title to the Imagine Software and related 
  15. documentation.  This License allows you to use the Imagine Software 
  16. on a single computer and make one copy of the Imagine 
  17. Software in machine-readable form for backup purposes only.  You 
  18. must reproduce on such copy the Imagine copyright notice and any 
  19. other proprietary legends that were on the original copy of the Imagine 
  20. Software.  You may also transfer all your license rights in the Imagine 
  21. Software, the backup copy of the Imagine Software, the related 
  22. documentation and a copy of this License to another party, provided 
  23. the other party reads and agrees to accept the terms and conditions 
  24. of this License.

  26. 2.    Restrictions.  The Imagine Software contains copyrighted material, 
  27. trade secrets and other proprietary material and in order to protect 
  28. them you may not decompile, reverse engineer, disassemble or 
  29. otherwise reduce the Imagine Software to a human-perceivable form.  
  30. You may not modify, network, rent, lease, loan, distribute or create 
  31. derivative works based upon the Imagine Software in whole or in part.  
  32. You may not electronically transmit the Imagine Software from one 
  33. computer to another or over a network.

  35. 3.    Termination.  This License is effective until terminated.  You 
  36. may terminate this License at any time by destroying the Imagine 
  37. Software and related documentation and all copies thereof.  This 
  38. License will terminate immediately without notice from Imagine if you 
  39. fail to comply with any provision of this License.  Upon termination 
  40. you must destroy the Imagine Software and related documentation and 
  41. all copies thereof.

  43. 6.    Disclaimer of Warranty on Imagine Software.  You expressly 
  44. acknowledge and agree that use of the Imagine Software is at your sole 
  45. risk.  The Imagine Software and related documentation are provided 
  46. "AS IS" and without warranty of any kind and Imagine and Imagine's 
  47. Licensor(s) (for the purposes of provisions 7 and 8, Imagine and 
  48. Imagine's Licensor(s) shall be collectively referred to as "Imagine") 
  49. EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, 
  50. INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF 
  51. MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.  
  52. APPLE DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN 
  53. THE IMAGINE SOFTWARE WILL MEET YOUR REQUIREMENTS, OR THAT 
  54. THE OPERATION OF THE IMAGINE SOFTWARE WILL BE UNINTERRUPTED 
  55. OR ERROR-FREE, OR THAT DEFECTS IN THE IMAGINE SOFTWARE WILL 
  56. BE CORRECTED.  FURTHERMORE, APPLE DOES NOT WARRANT OR MAKE 
  57. ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE 
  58. USE OF THE APPLE SOFTWARE OR RELATED DOCUMENTATION IN 
  59. TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR 
  60. OTHERWISE.  NO ORAL OR WRITTEN INFORMATION OR ADVICE 
  61. GIVEN BY APPLE OR AN APPLE AUTHORIZED REPRESENTATIVE 
  62. SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE 
  63. OF THIS WARRANTY.  SHOULD THE IMAGINE SOFTWARE PROVE 
  64. DEFECTIVE, YOU (AND NOT IMAGINE OR AN IMAGINE AUTHORIZED 
  65. REPRESENTATIVE) ASSUME THE ENTIRE COST OF ALL NECESSARY 
  66. SERVICING, REPAIR OR CORRECTION.  SOME STATES DO NOT ALLOW 
  67. THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE 
  68. EXCLUSION MAY NOT APPLY TO YOU.

  70. 7.    Limitation of Liability.  UNDER NO CIRCUMSTANCES INCLUDING 
  71. NEGLIGENCE, SHALL IMAGINE BE LIABLE FOR ANY INCIDENTAL, 
  72. SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE 
  73. OR INABILITY TO USE THE IMAGINE SOFTWARE OR RELATED 
  74. DOCUMENTATION, EVEN IF IMAGINE OR AN IMAGINE AUTHORIZED 
  75. REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH 
  76. DAMAGES.  SOME STATES DO NOT ALLOW THE LIMITATION OR 
  77. EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL 
  78. DAMAGES SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT 
  79. APPLY TO YOU.

  81. 8.    Controlling Law and Severability.  This License shall be governed 
  82. by and construed in accordance with the laws of the United States 
  83. and the State of California, as applied to agreements entered into and 
  84. to be performed entirely within California between California 
  85. residents.  If for any reason a court of competent jurisdiction finds 
  86. any provision of this License, or portion thereof, to be unenforceable, 
  87. that provision of the License shall be enforced to the maximum 
  88. extent permissible so as to effect the intent of the parties, and the 
  89. remainder of this License shall continue in full force and effect.

  91. 9.    Complete Agreement.  This License constitutes the entire 
  92. agreement between the parties with respect to the use of the Imagine 
  93. Software and related documentation, and supersedes all prior or 
  94. contemporaneous understandings or agreements, written or oral, 
  95. regarding such subject matter.  No amendment to or modification of 
  96. this License will be binding unless in writing and signed by a duly 
  97. authorized representative of Imagine.
