  4. TERMS AND CONDITION OF END-USER
  5. BULLETIN BOARD SERVICE USE

  7. S3 PROVIDES THIS BBS SO THAT YOU MAY DOWNLOAD S3 DRIVERS ("THE
  8. SOFTWARE") FOR USE WITH AN S3 GRAPHICS ACCELERATOR CHIP (THE S3 CHIP).
  9. S3 IS WILLING TO PROVIDE YOU WITH ACCESS TO THE BBS AND
  10. LICENSE THE SOFTWARE TO YOU ONLY UPON THE CONDITION THAT YOU
  11. AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS.  BY
  12. ACCESSING THE BBS YOU AGREE TO BE BOUND BY THE FOLLOWING
  13. TERMS AND CONDITIONS.  IF YOU DO NOT AGREE WITH THE TERMS
  14. AND CONDITIONS YOU SHOULD PROMPTLY EXIT THIS SERVICE.  YOU MAY NOT
  15. DUPLICATE ALL OR ANY PART OF THE ITEMS CONTAINED IN THE BBS, INCLUDING
  16. THE SOFTWARE(THE "BBS ITEMS") OR CREATE DERIVATIVE WORKS BASED IN WHOLE
  17. OR IN PART ON THE BBS ITEMS, EXCEPT AS EXPRESSLY SET FORTH IN THESE TERMS
  18. AND CONDITIONS, SE RESERVES THE RIGHT TO DENY ACCESS TO THE BBS TO
  19. ANYONE FOR ANY REASON AND AT ANY TIME.

  22. Software License.  Except as otherwise provided by an S3
  23. License Agreement to which you are a party, you (i) may only
  24. use the Software on a single system that contains the S3
  25. Chip that the Software is designed for, (ii) may not use the
  26. Software for any other purpose or reproduce, decompile,
  27. reverse engineer, disassemble or otherwise reduce the
  28. Software to human-readable from, (iii) may make one copy of
  29. the Software for backup purposes only, and (iv) acknowledge
  30. that all copies of the Software in whatever form provided
  31. are the sole property of S3, and that you have no right,
  32. title or interest in the Software or any copies of the
  33. Software, except as expressly provided in these Terms and
  34. Conditions.

  36. Warranty; No Liability for Damages.  YOUR USE OF THE SOFTWARE
  37. IS AT YOUR OWN RISK, AND THE SOFTWARE IS PROVIDED "AS IS",
  38. WITHOUT WARRANTY OF ANY KIND, INCLUDING, BUT NOT LIMITED TO,
  39. THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
  40. IN NO EVENT SHALL S3 BE LIABLE FOR ANY DAMAGES WHATSOEVER
  41. (INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS
  42. PROFITS.  CONSEQUENTIAL OR INCIDENTAL DAMAGES)  ARISING FROM
  43. THE USE OF OR INABILITY TO USE THE SOFTWARE. IN NO EVENT WILL
  44. S3'S ENTIRE LIABILITY TO YOU FOR ALL DAMAGES, LOSSES AND CAUSES
  45. OF ACTION EXCEED THE AMOUNT PAID BY YOU FOR THE SOFTWARE.

  47. Export Restrictions; Entire Agreement; Term.  You agree that
  48. you will not, directly or indirectly, export the BBS Items
  49. including the Software to any country to which such export is
  50. restricted by applicable U.S. export control laws without the
  51. prior consent, if required, of the U.S. Department of Commerce
  52. or such other governmental entity as any have jurisdiction over
  53. such export.  These Terms and Conditions constitute the
  54. entire agreement between you and S3 with respect to the use
  55. of the BBS and the BBS Items including the Software. These
  56. Terms and Conditions are effective until terminated.  These
  57. Terms and Conditions will terminate immediately without any
  58. notice from S3 if you fail to comply with any provision of
  59. these Terms and Conditions.  Upon termination, you must
  60. destroy BBS Items including the Software and any related
  61. documentation that you may have.
