  2.              Binary Code License Agreement
  3.  
  4. READ THE TERMS OF THIS AGREEMENT AND ANY PROVIDED
  5. SUPPLEMENTAL LICENSE TERMS (COLLECTIVELY "AGREEMENT")
  6. CAREFULLY BEFORE OPENING THE SOFTWARE MEDIA PACKAGE.  BY
  7. OPENING THE SOFTWARE MEDIA PACKAGE, YOU AGREE TO THE TERMS
  8. OF THIS AGREEMENT.  IF YOU ARE ACCESSING THE SOFTWARE
  9. ELECTRONICALLY, INDICATE YOUR ACCEPTANCE OF THESE TERMS BY
  10. SELECTING THE "ACCEPT" BUTTON AT THE END OF THIS
  11. AGREEMENT.  IF YOU DO NOT AGREE TO ALL THESE TERMS,
  12. PROMPTLY RETURN THE UNUSED SOFTWARE TO YOUR PLACE OF
  13. PURCHASE FOR A REFUND OR, IF THE SOFTWARE IS ACCESSED
  14. ELECTRONICALLY, SELECT THE "DECLINE" BUTTON AT THE END OF
  15. THIS AGREEMENT.
  16.  
  17. 1.  LICENSE TO USE.  Sun grants you a non-exclusive and
  18. non-transferable license for the internal use only of the
  19. accompanying software and documentation and any error
  20. corrections provided by Sun (collectively "Software"), by
  21. the number of users and the class of computer hardware for
  22. which the corresponding fee has been paid.
  23.  
  24. 2.  RESTRICTIONS.  Software is confidential and
  25. copyrighted. Title to Software and all associated
  26. intellectual property rights is retained by Sun and/or its
  27. licensors.  Except as specifically authorized in any
  28. Supplemental License Terms, you may not make copies of
  29. Software, other than a single copy of Software for archival
  30. purposes.  Unless enforcement is prohibited by applicable
  31. law, you may not modify, decompile, or reverse engineer
  32. Software.  Licensee acknowledges that Licensed Software is
  33. not designed or intended for use in the design,
  34. construction, operation or maintenance of any nuclear
  35. facility. Sun Microsystems, Inc. disclaims any express or
  36. implied warranty of fitness for such uses.   No right,
  37. title or interest in or to any trademark, service mark,
  38. logo or trade name of Sun or its licensors is granted under
  39. this Agreement.

  41. 3. LIMITED WARRANTY.  Sun warrants to you that for a period
  42. of ninety (90) days from the date of purchase, as evidenced
  43. by a copy of the receipt, the media on which Software is
  44. furnished (if any) will be free of defects in materials and
  45. workmanship under normal use.  Except for the foregoing,
  46. Software is provided "AS IS".  Your exclusive remedy and
  47. Sun's entire liability under this limited warranty will be
  48. at Sun's option to replace Software media or refund the fee
  49. paid for Software.

  51. 4.  DISCLAIMER OF WARRANTY.  UNLESS SPECIFIED IN THIS
  52. AGREEMENT, ALL EXPRESS OR IMPLIED CONDITIONS,
  53. REPRESENTATIONS AND WARRANTIES, INCLUDING ANY IMPLIED
  54. WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
  55. PURPOSE OR NON-INFRINGEMENT ARE DISCLAIMED, EXCEPT TO THE
  56. EXTENT THAT THESE DISCLAIMERS ARE HELD TO BE LEGALLY
  57. INVALID.
  58.  
  59. 5.  LIMITATION OF LIABILITY.  TO THE EXTENT NOT PROHIBITED
  60. BY LAW, IN NO EVENT WILL SUN OR ITS LICENSORS BE LIABLE FOR
  61. ANY LOST REVENUE, PROFIT OR DATA, OR FOR SPECIAL, INDIRECT,
  62. CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES, HOWEVER
  63. CAUSED REGARDLESS OF THE THEORY OF LIABILITY, ARISING OUT
  64. OF OR RELATED TO THE USE OF OR INABILITY TO USE SOFTWARE,
  65. EVEN IF SUN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
  66. DAMAGES.  In no event will Sun's liability to you, whether
  67. in contract, tort (including negligence), or otherwise,
  68. exceed the amount paid by you for Software under this
  69. Agreement.  The foregoing limitations will apply even if
  70. the above stated warranty fails of its essential purpose.

  72. 6.  Termination.  This Agreement is effective until
  73. terminated.  You may terminate this Agreement at any time
  74. by destroying all copies of Software.  This Agreement will
  75. terminate immediately without notice from Sun if you fail
  76. to comply with any provision of this Agreement.  Upon
  77. Termination, you must destroy all copies of Software.
  78.  
  79. 7. Export Regulations. All Software and technical data
  80. delivered under this Agreement are subject to US export
  81. control laws and may be subject to export or import
  82. regulations in other countries.  You agree to comply
  83. strictly with all such laws and regulations and acknowledge
  84. that you have the responsibility to obtain such licenses to
  85. export, re-export, or import as may be required after
  86. delivery to you.

  88. 8.   U.S. Government Restricted Rights.  If Software is
  89. being acquired by or on behalf of the U.S. Government or by
  90. a U.S. Government prime contractor or subcontractor (at any
  91. tier), then the Government's rights in Software and
  92. accompanying documentation will be only as set forth in
  93. this Agreement; this is in accordance with 48 CFR 227.7201
  94. through 227.7202-4 (for Department of Defense (DOD)
  95. acquisitions) and with 48 CFR 2.101 and 12.212 (for non-DOD
  96. acquisitions).

  98. 9.  Governing Law.  Any action related to this Agreement
  99. will be governed by California law and controlling U.S.
  100. federal law.  No choice of law rules of any jurisdiction
  101. will apply.
  102.  
  103. 10.  Severability. If any provision of this Agreement is
  104. held to be unenforceable, this Agreement will remain in
  105. effect with the provision omitted, unless omission would
  106. frustrate the intent of the parties, in which case this
  107. Agreement will immediately terminate.
  108.  
  109. 11.  Integration.  This Agreement is the entire agreement
  110. between you and Sun relating to its subject matter.  It
  111. supersedes all prior or contemporaneous oral or written
  112. communications, proposals, representations and warranties
  113. and prevails over any conflicting or additional terms of
  114. any quote, order, acknowledgment, or other communication
  115. between the parties relating to its subject matter during
  116. the term of this Agreement.  No modification of this
  117. Agreement will be binding, unless in writing and signed by
  118. an authorized representative of each party.

  120. JAVATM 2 RUNTIME ENVIRONMENT (J2RE), STANDARD EDITION,
  121. VERSION 1.4.1_X SUPPLEMENTAL LICENSE TERMS
  122.  
  123. These supplemental license terms ("Supplemental Terms") add
  124. to or modify the terms of the Binary Code License Agreement
  125. (collectively, the "Agreement"). Capitalized terms not
  126. defined in these Supplemental Terms shall have the same
  127. meanings ascribed to them in the Agreement. These
  128. Supplemental Terms shall supersede any inconsistent or
  129. conflicting terms in the Agreement, or in any license
  130. contained within the Software.
  131.  
  132. 1. Software Internal Use and Development License Grant.
  133. Subject to the terms and conditions of this Agreement,
  134. including, but not limited to Section 4 (Java Technology
  135. Restrictions) of these Supplemental Terms, Sun grants you a
  136. non-exclusive, non-transferable, limited license to
  137. reproduce internally and use internally the binary form of
  138. the Software complete and unmodified for the sole purpose
  139. of designing, developing and testing your Java applets and
  140. applications intended to run on the Java platform
  141. ("Programs").
  142.  
  143. 2. License to Distribute Software. Subject to the terms and
  144. conditions of this Agreement, including, but not limited to
  145. Section 4 (Java Technology Restrictions) of these
  146. Supplemental Terms, Sun grants you a non-exclusive,
  147. non-transferable, limited license to reproduce and
  148. distribute the Software, provided that (i) you distribute
  149. the Software complete and unmodified (unless otherwise
  150. specified in the applicable README file) and only bundled
  151. as part of, and for the sole purpose of running, your
  152. Programs, (ii) the Programs add significant and primary
  153. functionality to the Software, (iii) you do not distribute
  154. additional software intended to replace any component(s) of
  155. the Software (unless otherwise specified in the applicable
  156. README file), (iv) you do not remove or alter any
  157. proprietary legends or notices contained in the Software,
  158. (v) you only distribute the Software subject to a license
  159. agreement that protects Sun's interests consistent with the
  160. terms contained in this Agreement, and (vi) you agree to
  161. defend and indemnify Sun and its licensors from and against
  162. any damages, costs, liabilities, settlement amounts and/or
  163. expenses (including attorneys' fees) incurred in connection
  164. with any claim, lawsuit or action by any third party that
  165. arises or results from the use or distribution of any and
  166. all Programs and/or Software. (vi) include the following
  167. statement as part of product documentation (whether hard
  168. copy or electronic), as a part of a copyright page or
  169. proprietary rights notice page, in an "About" box or in any
  170. other form reasonably designed to make the statement
  171. visible to users of the Software: "This product includes
  172. code licensed from RSA Security, Inc.", and (vii) include
  173. the statement, "Some portions licensed from IBM are
  174. available at http://oss.software.ibm.com/icu4j/".

  176. 3. License to Distribute Redistributables. Subject to the
  177. terms and conditions of this Agreement, including but not
  178. limited to Section 4 (Java Technology Restrictions) of
  179. these Supplemental Terms, Sun grants you a non-exclusive,
  180. non-transferable, limited license to reproduce and
  181. distribute those files specifically identified as
  182. redistributable in the Software "README" file
  183. ("Redistributables") provided that: (i) you distribute the
  184. Redistributables complete and unmodified (unless otherwise
  185. specified in the applicable README file), and only bundled
  186. as part of Programs, (ii) you do not distribute additional
  187. software intended to supersede any component(s) of the
  188. Redistributables (unless otherwise specified in the
  189. applicable README file), (iii) you do not remove or alter
  190. any proprietary legends or notices contained in or on the
  191. Redistributables, (iv) you only distribute the
  192. Redistributables pursuant to a license agreement that
  193. protects Sun's interests consistent with the terms
  194. contained in the Agreement, (v) you agree to defend and
  195. indemnify Sun and its licensors from and against any
  196. damages, costs, liabilities, settlement amounts and/or
  197. expenses (including attorneys' fees) incurred in connection
  198. with any claim, lawsuit or action by any third party that
  199. arises or results from the use or distribution of any and
  200. all Programs and/or Software, (vi) include the following
  201. statement as part of product documentation (whether hard
  202. copy or electronic), as a part of a copyright page or
  203. proprietary rights notice page, in an "About" box or in any
  204. other form reasonably designed to make the statement
  205. visible to users of the Software: "This product includes
  206. code licensed from RSA Security, Inc.", and (vii) include
  207. the statement, "Some portions licensed from IBM are
  208. available at http://oss.software.ibm.com/icu4j/".

  210. 4. Java Technology Restrictions. You may not modify the
  211. Java Platform Interface ("JPI", identified as classes
  212. contained within the "java" package or any subpackages of
  213. the "java" package), by creating additional classes within
  214. the JPI or otherwise causing the addition to or
  215. modification of the classes in the JPI.  In the event that
  216. you create an additional class and associated API(s) which
  217. (i) extends the functionality of the Java platform, and
  218. (ii) is exposed to third party software developers for the
  219. purpose of developing additional software which invokes
  220. such additional API, you must promptly publish broadly an
  221. accurate specification for such API for free use by all
  222. developers.  You may not create, or authorize your
  223. licensees to create, additional classes, interfaces, or
  224. subpackages that are in any way identified as "java",
  225. "javax", "sun" or similar convention as specified by Sun in
  226. any naming convention designation.
  227.  
  228. 5. Notice of Automatic Software Updates from Sun.  You
  229. acknowledge that the Software may automatically download,
  230. install, and execute applets, applications, software
  231. extensions, and updated versions of the Software from Sun
  232. ("Software Updates"), which may require you to accept
  233. updated terms and conditions for installation. If
  234. additional terms and conditions are not presented on
  235. installation, the Software Updates will be considered part
  236. of the Software and subject to the terms and conditions of
  237. the Agreement.

  239. 6. Notice of Automatic Downloads. You acknowledge that, by
  240. your use of the Software and/or by requesting services that
  241. require use of the Software, the Software may automatically
  242. download, install, and execute software applications from
  243. sources other than Sun ("Other Software").  Sun makes no
  244. representations of a relationship of any kind to licensors
  245. of Other Software. TO THE EXTENT NOT PROHIBITED BY LAW, IN
  246. NO EVENT WILL SUN OR ITS LICENSORS BE LIABLE FOR ANY LOST
  247. REVENUE, PROFIT OR DATA, OR FOR SPECIAL, INDIRECT,
  248. CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES, HOWEVER
  249. CAUSED REGARDLESS OF THE THEORY OF LIABILITY, ARISING OUT
  250. OF OR RELATED TO THE USE OF OR INABILITY TO USE OTHER
  251. SOFTWARE, EVEN IF SUN HAS BEEN ADVISED OF THE POSSIBILITY
  252. OF SUCH DAMAGES.
  253.  
  254. 7. Trademarks and Logos. You acknowledge and agree as
  255. between you and Sun that Sun owns the SUN, SOLARIS, JAVA,
  256. JINI, FORTE, and iPLANET trademarks and all SUN, SOLARIS,
  257. JAVA, JINI, FORTE, and iPLANET-related trademarks, service
  258. marks, logos and other brand designations ("Sun Marks"),
  259. and you agree to comply with the Sun Trademark and Logo
  260. Usage Requirements currently located at
  261. http://www.sun.com/policies/trademarks. Any use you make of
  262. the Sun Marks inures to Sun's benefit.

  264. 8. Source Code. Software may contain source code that is
  265. provided solely for reference purposes pursuant to the
  266. terms of this Agreement.  Source code may not be
  267. redistributed unless expressly provided for in this
  268. Agreement.
  269.  
  270. 9. Termination for Infringement. Either party may terminate
  271. this Agreement immediately should any Software become, or
  272. in either party's opinion be likely to become, the subject
  273. of a claim of infringement of any intellectual property
  274. right.
