  1. By installing, copying, or otherwise using this Software product,
  2. you agree to be bound by the limitations set out below.

  4. LIMITED WARRANTY
  5.  
  6. Empire Interactive warrants that the software will perform substantially
  7. in accordance with the accompanying written materials for a period of
  8. ninety (90) days from the date of receipt. Any implied warranties on the
  9. software are limited to ninety (90) days, unless the effect of this clause
  10. has been specifically excluded by applicable law.

  12. CUSTOMER REMEDIES
  13.  
  14. Empire Interactive's entire liability and your exclusive remedy shall be,
  15. at Empire Interactive's option, either (a) return of the price paid,
  16. or (b) replacement of the software or hardware that does not meet this
  17. Limited Warranty and which is returned to the place of purchase with a
  18. copy of your receipt. This Limited Warranty is void if failure of the
  19. software has resulted from accident, abuse, or misapplication. Any
  20. replacement software will be warranted for the remainder of the original
  21. warranty or thirty (30) days, whichever is longer.

  23. NO OTHER WARRANTIES

  25. To the maximum extent permitted by applicable law, Empire Interactive and
  26. its suppliers disclaim all other representations, warranties, conditions or
  27. other terms, either express or implied, including, but not limited to
  28. implied warranties and/or conditions of merchantability and fitness for a
  29. particular purpose, with regard to the software and the accompanying written
  30. materials.

  32. NO LIABILITY FOR CONSEQUENTIAL DAMAGES
  33.  
  34. To the maximum extent permitted by applicable law, in no event shall Empire
  35. Interactive or its suppliers be liable for any damages whatsoever (including
  36. without limitation, direct or indirect damages for personal injury, loss of
  37. business profits, business interruption, loss of business information, or any
  38. other pecuniary loss) arising out of the use of or inability to use this product,
  39. even if Empire Interactive has been advised of the possibility of such damages.
  40. In any case, Empire Interactive's and its suppliers' entire liability under any
  41. provision of this agreement shall be limited to the amount actually paid by you
  42. for the software, unless the effect of this clause has been specifically excluded
  43. by applicable law.

  46. This Software Licence Agreement is governed by the law of the laws of England.
