  1.                LIMITED USE SOFTWARE LICENSE AGREEMENT

  4. This Limited Use Software License Agreement (the "Agreement") is a legal
  5. agreement between you and Sensor Based Systems, Inc. (SBS).
  6.  
  7. BY INSTALLING THIS GAME EDITOR PROGRAM AND BY USING THE EDITOR YOU INDICATE
  8. YOUR AGREEMENT TO THE TERMS OF THIS LICENSE AGREEMENT.

  10. If you DO NOT agree to the terms of this Agreement, DO NOT use this program.

  13. SBS Software License
  14. ~~~~~~~~~~~~~~~~~~~~
  15. 1. SBS grants the end-user the right to use (1) copy of the SBS game programs
  16.    DeeP, HeeP and DeePbsp (the "Software"). You are permitted to load the
  17.    Program onto any storage device including RAM.
  18.  
  19.    You agree that you shall not modify, reverse compile, disassemble, or
  20.    reverse engineer the Program.
  21.  
  22. 2. Copyright.  The Software is owned by SBS and is protected by United
  23.    States copyright laws and international treaty provisions. You may
  24.  
  25.    (a) make one copy of the Software solely for back-up purposes, or
  26.    (b) transfer the Software to a single hard disk provided you keep the
  27.        original solely for back-up or archival purposes.
  28.  
  29.    You may not otherwise reproduce, copy or disclose to others, in whole or
  30.    in any part, the Software. You may not copy the written materials
  31.    accompanying the Software.

  34. LIMITED WARRANTY AND LIMITATION OF REMEDIES:

  37. SBS DOES NOT WARRANT THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED,
  38. ERROR FREE OR MEET LICENSEE'S SPECIFIC REQUIREMENTS.

  40. This Limited Warranty is void if failure of the Software has resulted
  41. in whole or in part from accident, abuse, misapplication or violation of this
  42. Agreement.
  43.  
  44. This warranty allocates risks of product failure between Licensee and SBS.
  45. SBS's product pricing reflects this allocation of risk and the limitations
  46. of liability contained in this warranty.
  47.  
  48. THERE ARE NO OTHER WARRANTIES OF ANY KIND (INCLUDING IMPLIED WARRANTIES OF
  49. MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE), EXPRESS OR IMPLIED,
  50. ARE MADE AS TO IT OR ANY MEDIUM IT MAY BE ON. OUR ENTIRE LIABILITY AND YOUR
  51. EXCLUSIVE REMEDY IS SUCH REPLACEMENT, AND UNDER NO CIRCUMSTANCES WILL WE
  52. PROVIDE ANY OTHER REMEDY FOR DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL,
  53. PUNITIVE, INCIDENTAL OR OTHER DAMAGES ARISING FROM IT, INCLUDING SUCH FROM
  54. NEGLIGENCE, STRICT LIABILITY, OR BREACH OF WARRANTY OR CONTRACT, EVEN AFTER
  55. NOTICE OF THE POSSIBILITY OF SUCH DAMAGES.

  57. General

  59. This Agreement and the program or materials to which they apply are not
  60. assignable and may not be sublicensed, except as described herein.  If any
  61. provision or portions of this Agreement are invalidated under any applicable
  62. statute or rule of law, they are to that extent to be deemed omitted without
  63. affecting the remaining provisions thereof.

  65. YOUR LICENSE IS AUTOMATICALLY TERMINATED if you fail to comply with any terms
  66. of this Agreement.

  68. YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT AND AGREE
  69. TO BE BOUND BY ITS TERMS WHEN YOU INSTALL THE SOFTWARE DESCRIBED HEREIN, AND
  70. FURTHER AGREE THAT IS IT THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT
  71. BETWEEN SBS AND YOU RELATING TO THE SUBJECT MATTER OF THIS AGREEMENT.

  73. This Agreement shall be interpreted in accordance with and governed by the
  74. laws of the State of Washington.
