  3. NAConsulting StockTick
  4. Trial Version 3.0
  5.  
  6. This License Agreement ("Agreement") for NAConsulting StockTick 3.0 trial 
  7. version software is your proof of license.
  8.  
  9. LICENSE TERMS: Subject to your compliance with the terms of this agreement,
  10. NAConsulting grants to you a personal, nonexclusive and nontransferable
  11. license to install and use the StockTick 3.0 software and data, together
  12. referred to as the "Product" in this agreement, solely for the purpose of
  13. testing and evaluation by you.  The product may be installed only on a single
  14. computer used by you.  This agreement and the license granted in it shall
  15. continue until NAConsulting announces its termination.  Upon termination
  16. you agree to destroy all copies of the product and any related materials
  17. in any form.
  18.  
  19. COPYRIGHT:  The StockTick 3.0 Product is owned by NAConsulting and are
  20. protected by the United States copyright laws and international treaty
  21. provisions.  Any data provided with and during the course of use of
  22. StockTick 3.0 are also owned by NAConsulting.
  23.  
  24. Any software products and updates you access using StockTick 3.0 may be
  25. owned by their respective vendors and may be similarly protected by
  26. copyrights laws and international treaty provisions.  You agree to comply
  27. with these laws and treaty provisions and the terms of any license
  28. agreements the vendors may impose on the use of their software products
  29. and updates.
  30.  
  31. NO WARRANTIES OR LIABILITIES:  You expressly acknowledge and 
  32. agree that use of the Product is at your own risk and that the Product is
  33. provided "AS IS" without any warranties whatsoever.
  34.  
  35. NAConsulting disclaims any express or implied warranties as to the
  36. accuracy, completeness, correctness, noninfringement, merchantability
  37. or fitness for particular use of the software products and updates
  38. accessed using StockTick 3.0.
  39.  
  40. GOVERNMENT RESTRICTED RIGHTS:  The Product and related materials are
  41. provided with RESTRICTED RIGHTS.  Use, duplication or disclosure by the
  42. Government is subject to the restrictions as set forth in subparagraph
  43. (c) (1) (ii) of the Right in Technical Data and Computer Software clause
  44. at DFARS 252.227-7013 or subparagraph (c) (1) and (2) of the Commercial
  45. Computer Software -- Restricted Rights 48 CFR 52.227-19, as applicable.
  46. Manufacturer is NAConsulting.
  47.  
  48. CHANGED TERMS:  NAConsulting shall have the right at any time to change
  49. the terms of this agreement or require new terms.  Such changes shall
  50. be effective immediately upon distribution by any means which give you
  51. actual knowledge of them, and any use by you of the Product after such
  52. notice shall be deemed acceptance of them by you.
  53.  
  54. GENERAL:  This agreement will be governed by the laws of the State of
  55. Washington in the United States of America.  This agreement is the entire 
  56. agreement between NAConsulting and you and supersedes any other 
  57. communications or advertising with respect to the Product.  If any 
  58. provision of this agreement is held invalid, the remainder of this 
  59.
