  6. THIS IS A CONTRACT.  BY INSTALLING THIS SOFTWARE YOU ACCEPT ALL THE
  7. TERMS AND CONDITIONS OF THIS AGREEMENT. THIS SOFTWARE IS ALSO
  8. AVAILABLE FOR EVALUATION (DEMO) AND IS SUBJECT TO AN EXPIRATION
  9. DATE WHEN USED AS A DEMO. FULLY LICENSED VERSIONS OF THIS SOFTWARE
  10. ARE AVAILABLE FOR PURCHASE FROM WHITE PINE'S STOREFRONT ON THE
  11. WORLD WIDE WEB (http://www.cuseeme.com) OR FROM YOUR LOCAL
  12. SOFTWARE RETAIL STORE.

  14. This White Pine Software, Inc. ("White Pine") End User License
  15. Agreement accompanies a White Pine software product and related
  16. explanatory written materials  ("Software").  The term "Software"
  17. shall also include any upgrades, modified versions or updates of
  18. the Software licensed to you by White Pine.  This copy of the
  19. Software is licensed to you as the end user. Please read this
  20. Agreement carefully.
  21.  
  22.         *  TO ACCEPT THIS AGREEMENT, PRESS YES AND INSTALL.
  23.  
  24.         *  TO DECLINE THIS AGREEMENT, PRESS NO AND QUIT, AND YOU
  25.              WILL NOT BE ABLE TO USE THE SOFTWARE.

  28. 1. White Pine  grants to you a non-exclusive, non-sublicensable,
  29. license to use this Software in binary executable form.
  30.  
  31. YOU MAY NOT USE, COPY, MODIFY, OR TRANSFER THE PROGRAM OR
  32. DOCUMENTATION, OR ANY COPY EXCEPT AS EXPRESSLY PROVIDED IN THIS
  33. AGREEMENT.

  35. 2. WHITE PINE MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY OF
  36. THIS SOFTWARE OR ABOUT ANY CONTENT OR INFORMATION MADE ACCESSIBLE
  37. BY THE SOFTWARE, FOR ANY PURPOSE.  THE SOFTWARE IS PROVIDED 'AS IS'
  38. WITHOUT EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF
  39. MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OR
  40. NONINFRINGEMENT.  THIS SOFTWARE IS PROVIDED GRATUITOUSLY AND,
  41. ACCORDINGLY, WHITE PINE SHALL NOT BE LIABLE UNDER ANY THEORY OR
  42. ANY DAMAGES SUFFERED BY YOU OR ANY USER OF THE SOFTWARE.  WHITE
  43. PINE WILL NOT SUPPORT THIS SOFTWARE AND WILL NOT ISSUE UPDATES TO
  44. THIS SOFTWARE.

  46. 3. While White Pine intends to distribute a commercial release of
  47. the Software, White Pine reserves the right at any time not to
  48. release a commercial release of the Software or, if released, to
  49. alter prices, features, specifications, capabilities, functions,
  50. licensing terms, release dates, general availability or other
  51. characteristics of the commercial release.

  53. 4. Title, ownership rights, and intellectual property rights in and
  54. to the Software shall remain in White Pine and/or its suppliers.
  55. You agree to abide by the copyright law and all other applicable
  56. laws of the United States including, but not limited to, export
  57. control laws.  You acknowledge that the Software in source code
  58. form remains a confidential trade secret of White Pine and/or its
  59. suppliers and therefore you agree not to modify the Software or
  60. attempt to decipher, decompile, disassemble or reverse engineer the
  61. Software, except to the extent applicable laws specifically
  62. prohibit such restriction.
  63.  
  64. 5.  Copyright.  The Software is owned by White Pine and its
  65. suppliers, and its structure, organization and code are the
  66. valuable trade secrets of White Pine and its suppliers.  The
  67. Software is also protected by United States Copyright Law and
  68. International Treaty provisions.  You agree not to modify, adapt,
  69. translate, reverse engineer, decompile, disassemble or otherwise
  70. attempt to discover the source code of the Software.  You may use
  71. trademarks only to identify printed output produced by the
  72. Software, in accordance with accepted trademark practice, including
  73. identification of trademark owner's name.  Such use of any
  74. trademark does not give you any rights of ownership in that
  75. trademark.  Except as stated above, this Agreement does not grant
  76. you any intellectual property rights in the Software.

  78. 6. White Pine  may terminate this License at any time by delivering
  79. notice to you and you may terminate this License at any time by
  80. destroying or erasing your copy of the Software.  Upon termination
  81. of this License, or in any event within thirty (30) days following
  82. White Pine's release of a commercial version of the Software, you
  83. agree to destroy or erase the Software.  In the event of
  84. termination, the following sections of this License will survive:
  85. 2, 3, 4, 5 and 6.  This License is personal to you and you agree
  86. not to assign your rights herein.  This License shall be governed
  87. by and construed in accordance with the laws of the State of New
  88. Hampshire and, as to matters affecting copyrights, trademarks and
  89. patents, by U.S.  federal law.  This License sets forth the entire
  90. agreement between you and White Pine.
  91.  
  92. 7. WHITE PINE OR ITS SUPPLIERS SHALL NOT BE LIABLE FOR (a)
  93. INCIDENTAL, CONSEQUENTIAL, SPECIAL OR INDIRECT DAMAGES OF ANY
  94. SORT, WHETHER ARISING IN TORT, CONTRACT OR OTHERWISE, EVEN IF 
  95. WHITE PINE HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES,
  96. OR (b) FOR ANY CLAIM BY ANY OTHER PARTY. THIS LIMITATION OF 
  97. LIABILITY SHALL NOT APPLY TO LIABILITY FOR DEATH OR PERSONAL 
  98. INJURY TO THE EXTENT APPLICABLE LAW PROHIBITS SUCH LIMITATION. 
  99. FURTHERMORE, SOME STATES DO NOT ALLOW THE EXCLUSION OR 
  100. LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS 
  101. LIMITATION AND EXCLUSION MAY NOT APPLY TO YOU.

  103. 8. ACKNOWLEDGEMENT: YOU ACKNOWLEDGE THAT YOU HAVE READ THIS
  104. AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND
  105. CONDITIONS. YOU ALSO AGREE THAT THIS AGREEMENT IS THE COMPLETE AND
  106. EXCLUSIVE STATEMENT OF AGREEMENT BETWEEN THE PARTIES AND 
  107. SUPERSEDES ALL PROPOSALS OR PRIOR AGREEMENTS, VERBAL OR WRITTEN,
  108. AND ANY OTHER COMMUNICATIONS BETWEEN THE PARTIES RELATING TO THE 
  109. SUBJECT MATTER OF THIS AGREEMENT.
