  8. BY INSTALLING AND EXECUTING THE DataPage Maker(tm) SOFTWARE 
  9. ACCOMPANYING THIS LICENSE, YOU ARE CONSENTING TO BE BOUND 
  10. BY AND ARE BECOMING A PARTY TO THIS AGREEMENT. IF YOU DO NOT 
  11. AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, YOU MUST DELETE 
  12. THE DataPage Maker SOFTWARE FROM YOUR HARDDRIVE.

  14. LICENSE.  Entity Master Systems hereby grants you a non 
  15. exclusive license to use its DataPage Maker software product 
  16. ("Software") free of charge for non-commercial, educational, 
  17. evaluation or personal purposes only.
  18.  
  19. LIMITATIONS.  Please note that your use under this license 
  20. is strictly limited.  You may not: sell the Software or license 
  21. it for any consideration, permit other individuals to use the 
  22. Software except under the terms listed above; modify, translate, 
  23. reverse engineer, decompile, disassemble (except to the extent 
  24. applicable laws specifically prohibit such restriction), or 
  25. create derivative works based on the Software; copy the 
  26. Software (except for back-up purposes); rent, lease, transfer 
  27. or otherwise transfer rights to the Software; or remove any 
  28. proprietary  notices or labels on the Software.

  31. TITLE. Title, ownership rights, and intellectual property rights 
  32. in and to the Software shall remain with Entity Master Systems 
  33. and/or its suppliers. The Software is protected by the copyright 
  34. laws of the United States and international copyright treaties.  
  35. Title, ownership rights, and intellectual property rights in and 
  36. to the content accessed through the Software is the property of 
  37. the applicable content owner and may be protected by applicable 
  38. copyright or other law. This License gives you no rights to such 
  39. content.  
  40.  
  41. DISCLAIMER OF WARRANTY.  The Software is provided free of charge 
  42. on an "AS IS" basis, without warranty of any kind, including 
  43. without limitation the warranties of merchantability, fitness 
  44. for a particular purpose and non-infringement. The entire risk 
  45. as to the quality and performance of the Software is borne by 
  46. you.  Should the Software prove defective, you and not Entity 
  47. Master System assume the entire cost of any service and repair.  
  48. This disclaimer of warranty constitutes an essential part of the 
  49. agreement.

  51. SOME STATES DO NOT ALLOW EXCLUSIONS OF AN IMPLIED WARRANTY,     
  52. SO THIS DISCLAIMER MAY NOT APPLY TO YOU AND YOU MAY HAVE        
  53. OTHER LEGAL RIGHTS THAT VARY FROM STATE TO STATE OR BY  
  54. JURISDICTION.
  55.  
  56. LIMITATION OF LIABILITY. IN NO EVENT SHALL ENTITY MASTER 
  57. SYSTEMS BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, 
  58. OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT 
  59. LIMITATION, THOSE RESULTING FROM LOSS OF USE, DATA, OR PROFITS, 
  60. WHETHER OR NOT ENTITY MASTER SYSTEMS HAS BEEN ADVISED OF THE 
  61. POSSIBILITY OF DAMAGE, OR ON ANY THEORY OF LIABILITY, ARISING 
  62. OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THIS 
  63. SOFTWARE.
  64.  
  65. TRADEMARKS.  Entity Master System (EMS), the EMS logo, and 
  66. DataPage Maker are trademarks of Entity Master System, a DBA 
  67. registered in Galveston County, Texas.  All other trademarks 
  68. are the property of their respective owners.
  69.  
  70. TERMINATION.  This license will terminate automatically if 
  71. you fail to comply with the limitations described above.  
  72. On termination, you must destroy all copies of the Software.
  73.  
  74. EXPORT CONTROLS.  None of the Software or underlying information 
  75. or technology may be downloaded or otherwise exported or 
  76. reexported:
  77.  
  78. a.  into (or to a national or resident of) Cuba, Iraq, Libya, 
  79. Yugoslavia, North Korea, Iran, Syria or any other country to which 
  80. the U.S. has embargoed goods; or 
  81.  
  82. b.  to anyone on the U.S. Treasury Department's list of Specially 
  83. Designated Nationals or the U.S. Commerce Department's Table of 
  84. Deny Orders. 
  85.  
  86. By downloading or using the Software, you are agreeing to the 
  87. foregoing and you represent and warrant that you are not located 
  88. in, under the control of, or a national or resident of any such 
  89. country or on any such list.
