  6. END-USER LICENSE AGREEMENT FOR BoDetect v2.01
  7.  
  8. NOTICE: This End-User License Agreement ("EULA") is a legal agreement between you 
  9. (either an individual or a single entity) and the AUTHOR (Chris Benson) for the 
  10. software product identified above. By installing or using the SOFTWARE PRODUCT, 
  11. you agree to be bound by the terms of this EULA. If you do not agree to the terms 
  12. of this EULA, you may not use the SOFTWARE PRODUCT. This agreement shall be 
  13. governed by the laws of the State of Oregon.

  15. This agreement overrides and takes precedence over any other agreements which 
  16. may have been included in a previous version of the SOFTWARE PRODUCT. 
  17.  
  18. GENERAL TERMS OF THE AGREEMENT:
  19.  
  20. The SOFTWARE PRODUCT is protected by copyright laws and international copyright 
  21. treaties, as well as other intellectual property laws and treaties. The SOFTWARE 
  22. PRODUCT is licensed, not sold.
  23.  
  24. 1. GRANT OF LICENSE. This EULA grants you the following rights:

  26. For the purposes of this EULA, the following definitions apply:
  27. INDIVIDUAL USE - Use of the SOFTWARE PRODUCT by a you, as an individual.
  28.  
  29. BUSINESS USE - Use of the SOFTWARE PRODUCT by a company (whether or not it is for-profit),
  30. corporation, government organization, charitable organization, educational facility, or
  31. any other group not fitting the definition of INDIVIDUAL USE as described. Additionally,
  32. if the SOFTWARE PRODUCT is made available for internal distribution or use from a
  33. storage device, such as a network server, it is deemed to be BUSINESS USE.

  35. ╖ Software. 
  36. - INDIVIDUAL USE
  37. You may install and use the SOFTWARE PRODUCT on an unlimited number of computers 
  38. free of charge, as long as such use conforms to the definition of INDIVIDUAL 
  39. USE as described.
  40.  
  41. - BUSINESS USE
  42. Business use requires the purchase of a license for each computer on which 
  43. the SOFTWARE PRODUCT is installed. Each license grants you the right to use 
  44. the SOFTWARE PRODUCT on ONE computer. You may archive or store an additional copy 
  45. of the SOFTWARE PRODUCT on devices such as network servers or backup media for 
  46. distribution, provided the number of copies of the SOFTWARE PRODUCT in use at 
  47. any time does not exceed the number of licenses you have purchased.

  50. 2. RIGHTS AND RESTRICTIONS.

  52. ╖ Distribution. You may make the SOFTWARE PRODUCT available for public 
  53. download from any web or ftp site provided that you make a reasonable 
  54. attempt to only offer the latest version of the SOFTWARE PRODUCT and 
  55. you do not modify, add, or delete the contents of the zip file containing 
  56. the SOFTWARE PRODUCT.  If you are notified by the AUTHOR that the version 
  57. of the SOFTWARE PRODUCT you are offering for download is not the most 
  58. current, you agree to obtain and post the most current version of the 
  59. SOFTWARE PRODUCT.

  61. ╖ Limitations on Reverse Engineering, Decompilation, and Disassembly. You may 
  62. not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT, except 
  63. and only to the extent that such activity is expressly permitted by applicable 
  64. law notwithstanding this limitation.

  66. ╖ Transfer of License. Licenses may not be transferred.
  67.  
  68. ╖ Sale. The SOFTWARE PRODUCT may not be sold, bundled with other 'for sale' 
  69. products, or made available for download from any site that requires a paid 
  70. subscription for access without the WRITTEN PERMISSION of the AUTHOR.

  72. ╖ Termination. The AUTHOR may terminate this EULA if you fail to comply with 
  73. the terms and conditions of this EULA. In such event, you must destroy all 
  74. copies of the SOFTWARE PRODUCT and all of its component parts.
  75.  
  76. 3. COPYRIGHT. All title and copyrights in and to the SOFTWARE PRODUCT and 
  77. any copies of the SOFTWARE PRODUCT are the intellectual property of and are 
  78. owned by the AUTHOR. The SOFTWARE PRODUCT is protected by copyright laws 
  79. and international treaty provisions.

  82. MISCELLANEOUS

  84. The AUTHOR reserves the right to modify the terms of this agreement at any time.  
  85.  
  86. LIMITED WARRANTY
  87.  
  88. NO WARRANTIES. The AUTHOR expressly disclaims any warranty for the SOFTWARE 
  89. PRODUCT. The SOFTWARE PRODUCT and any related documentation is provided "as is" 
  90. without warranty of any kind, either express or implied, including, without 
  91. limitation, the implied warranties or merchantability, fitness for a particular 
  92. purpose, or noninfringement. The entire risk arising out of use or performance 
  93. of the SOFTWARE PRODUCT remains with you.

  95. NO LIABILITY FOR DAMAGES. In no event shall the AUTHOR be liable for any 
  96. damages whatsoever (including, without limitation, damages for loss of business 
  97. profits, business interruption, loss of business information, or any other 
  98. incidental loss) arising out of the use of or inability to use this product.
