  3.   All software and assets including but not limited to text, graphics, sound,
  4.   data and program files, but excluding plug-ins provided by third parties to
  5.   Auran ("Plug-ins") and assets relating solely to Dark Reign, as contained in
  6.   this site (jointly and severally, "the Assets") remain the property of Auran
  7.   Pty Ltd (ACN 074 468 483) ("Auran") and any downloading, use or reproduction
  8.   of the Assets is subject to the conditions set out here and contained in
  9.   the readme.txt file that is included with all downloads, to be construed
  10.   according to the law of the State of Queensland in the Commonwealth of
  11.   Australia.

  15.    The user is granted a non-exclusive license to download and use the Assets
  16.    contained in this site on the following conditions:-

  18. 1. the Assets downloaded from this site remain the property of Auran;
  19.  
  20. 2. the Assets downloaded form this site, in whole or in part, may be used:-
  21.  
  22. (a)    in other websites; or
  23.  
  24. (b)    in conjunction with other software packages or programs,
  25.  
  26.         provided that:-
  27.  
  28. (c)    such use is not for a commercial purpose or any financial gain; and
  29.  
  30. (d)     the header and this text and/or readme.txt file is included without
  31.         alteration wherever the Assets are reproduced;

  33. 3. Auran cannot warrant the performance or the results obtained from using the
  34.    Assets or Plug-ins contained in this site;
  35.  
  36. 4. Auran makes no warranties, express or implied with respect to the Assets as
  37.    to merchantability or fitness for purpose or non-infringement of third
  38.    parties rights but in the event that any legislation implies terms which
  39.    cannot be lawfully excluded, such terms will apply except that the liability
  40.    of Auran for breach of any such implied term will be limited to replacement
  41.    of the Assets to which the breach relates or the supply of equivalent
  42.    software or assets;

  44. 5. Auran will not be liable for any damages whatsoever including:-
  45.  
  46. (a)     direct, indirect, incidental, consequential damages; or
  47.  
  48. (b)     loss of business profits; or
  49.  
  50. (c)     special damages,
  51.  
  52.    arising from the use of the Assets or Plug-ins contained in this site, even
  53.    if Auran has been notified of the potential for such damages to arise;
  54.  
  55. 6. the user acknowledges:-
  56.  
  57. (a)      they have not made known to Auran any particular purpose for which the
  58.          Assets or Plug-ins contained in this site are required; and
  59.  
  60. (b)     they have not relied on Auran to provide the Assets or Plug-ins as being
  61.         suitable for any such purpose.
