  1. Database and XML Toolkit (DbTkXml) SOFTWARE LICENSE AGREEMENT
  2. -------------------------------------------------------------
  3. LICENSE:
  4. You may:
  5. 1. Use the DbTkXml programs on a single computer for up to 15 days without a license.
  6. 2. Use the DbTkXml programs on a single computer beyond the 15 day trial period if you have 
  7.    purchased a DbTkXml license.
  8. 3. Install the DbTkXml License on ONE machine per DbTkXml License using the
  9.    License manager.utility.
  10. 4. Copy the program into any machine readable or printable form for backup in support of the
  11.    program on the single machine.
  12. 5. Modify the program and/or merge it into another program for your use on the single machine.
  13.    Any part of the licensed program merged into another program will continue to be subject to
  14.    the terms of  this agreement.
  15. 6. Freely distribute the DbTkXml setup program (DbtkXml.exe) to any other machine
  16. 7. Request a new registration key after uninstalling DbTkXml from the obsolete machine
  17.    and installing DbTkXml on the new machine or reformat or install a new operating system.
  18.  
  19. You may NOT:
  20. 1. Run the installation process on any other machine than the computer(s) you have licenses for
  21.    unless you purchased another License for that new machine.
  22. 2. use, copy, or modify the program or any copy, modification or merged portion, in whole or in
  23.    part, except as expressly provided for this license.
  24.  
  25. If you transfer possession of any copy, modification, or merged portion of the program not
  26. permitted by this license to another party, your license is automatically terminated.
  27.  
  28. TERM:
  29. This license is effective until terminated. You may terminate it at any time by destroying the
  30. program together with all the copies, modifications, and merged portions in any form.
  31. It will also terminate if you fail to comply with any term or condition of this agreement.
  32. You agree upon such termination to destroy the program together with all copies,
  33. modifications and merged portions in any form.
  34.  
  35. LIMITED WARRANTY:
  36. This program is provided "AS IS" without warranty of any kind, either expressed or implied,
  37. including, but not limited to the implied warranties or merchantability and fitness for a
  38. particular purpose.
  39. The entire risk as to the quality and performance of the program iswith you.
  40. Should the program prove defective, you assume the entire cost of all necessary
  41. servicing, repair and correction.

  43. DbTkXml is delivered via download from it's  Internet site:
  44. http://www.ProfSoftware.com/dbtkxml
  45.  
  46. Professional Software Solutions does not warrant that the functions contained in the program
  47. will meet your requirements or that the operation of the program will be uninterrupted or
  48. error free. Professional Software Solutions will provide support via email and release
  49. updates of the software at its own discretion for free or an upgrade fee, but is under no
  50. obligation to respond to support requests or provide updates.
  51.  
  52. However, Professional Software Solutions warrants the diskettes on which the program is
  53. furnished to be free from defects in materials and workmanship under normal use for a
  54. period of fifteen(15) days from the date of the purchase. If during this 15 days period the
  55. diskettes should become defective and unusable, return them to Professional Software
  56. Solutions for a no-charge replacement.
  57.  
  58. ACKNOWLEDGMENT:
  59. You acknowledge that you have read this agreement, understand it and agree to be bound
  60. by its terms and conditions. You further agree that it is the complete and exclusive 
  61. statement of the agreement between us.
  62.  
  63. REFUNDS:
  64. DbTkXml can be tested and used without any limitation or reduction in functionality for
  65. a period of 15 days before the purchase.
  66. We therefore are NOT issuing any refunds for the purchase of DbTkXml.
  67.  
  68. NOTE:
  69. The original diskettes in recognizable form may be required in order to receive repair
  70. or update releases of this software product.
  71.  
  72. DISCLAIMER:
  73. Burkhard Eichberger and Professional Software Solutions have taken due care in
  74. preparing this manual and the programs and data on the electronic disk media
  75. (if any) accompanying this package including research, development, and testing
  76. to ascertain their effectiveness.
  77. Professional Software Solutions makes no warranties sas to the contents of this package
  78. and specifically disclaims and implied warranties of merchantability or fitness for any
  79. particular purpose. Professional Software Solutions further reserves the right to make
  80. changes to the specifications of the program and the contents of the package without
  81. obligation to notify any person or organization of such changes.
