  9.     The trial version of this software may be used for evaluation purposes at 
  10. the user's own risk for a period of 30 days from the date of installation. 
  11. At the end of the trial period, the user must either purchase a license to 
  12. continue using the software, or remove it from his/her system.
  13.  
  14.     The trial version may be freely distributed, provided the distribution 
  15. package is not modified. No person or company may charge a fee for the 
  16. distribution of OrangeCD Suite without written permission from the copyright 
  17. holder.

  20. Licensed Version

  22.     On payment of the appropriate license fee, the user is granted a 
  23. non-exclusive license to use OrangeCD Suite on one computer, for any legal 
  24. purpose, at a time. The registered software may not be rented or leased, but 
  25. may be permanently transferred, if the person receiving it agrees to terms 
  26. of this license. If the software is an update, the transfer must include the 
  27. update and all previous versions.

  29.     Whilst every care has been taken in the construction and testing of this 
  30. software, it is supplied subject to the condition that the user undertakes 
  31. to evaluate the suitability of the control for his/her purposes. Firetongue 
  32. Software makes no representation of the software's suitability for any 
  33. purpose, and the user agrees that Firetongue Software has no responsibility 
  34. for any loss or damage occasioned by the use of this software.

  36.     TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE AND 
  37. DOCUMENTATION ARE PROVIDED "AS IS" AND FIRETONGUE SOFTWARE DISCLAIMS ALL 
  38. OTHER WARRANTIES AND CONDITIONS, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT 
  39. NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A 
  40. PARTICULAR PURPOSE, CONFORMANCE WITH DESCRIPTION, TITLE AND NON-INFRINGEMENT 
  41. OF THIRD PARTY RIGHTS.

  43.     TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 
  44. FIRETONGUE SOFTWARE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, 
  45. SPECIAL OR EXEMPLARY DAMAGES OR LOST PROFITS WHATSOEVER (INCLUDING, WITHOUT 
  46. LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, 
  47. LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF 
  48. THE USE OR INABILITY TO USE THE SOFTWARE PRODUCT, EVEN IF FIRETONGUE 
  49. SOFTWARE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, 
  50. FIRETONGUE SOFTWARE'S CUMULATIVE AND ENTIRE LIABILITY TO YOU OR ANY OTHER 
  51. PARTY FOR ANY LOSS OR DAMAGES RESULTING FROM ANY CLAIMS, DEMANDS OR ACTIONS 
  52. ARISING OUT OF OR RELATING TO THIS AGREEMENT SHALL NOT EXCEED THE PURCHASE 
  53. PRICE PAID FOR THIS LICENSE.

  55.     Should any term of these terms and conditions be declared void or 
  56. unenforceable by any court of competent jurisdiction, such declaration shall 
  57. have no effect on the remaining terms hereof.
