  1. **** Advanced Effect Maker Free Edition License Agreement ****

  3. You should carefully read the following terms and conditions using 
  4. this software. Your use of this software indicates your acceptance 
  5. of this license agreement. This is a legal agreement (this 
  6. "Agreement") between you (either an individual or an entity) and 
  7. Mandomartis Company ("Mandomartis"). This Agreement is part of 
  8. a software package that contains a software (hereby called "THE 
  9. EFFECT MAKER") for creating or generating web effects based on 
  10. Macromedia Flash or JavaScript files (hereby called "THE EFFECTS") 
  11. and certain written materials. THE EFFECT MAKER is packaged 
  12. in a self executable installation program.
  13.  
  14. 1. GRANT OF LICENSE.
  15.  
  16. Mandomartis hereby grants you a personal, non-exclusive, 
  17. non-transferable license to use one copy of this Software and to 
  18. install THE EFFECT MAKER on one or  multiple computers. 
  19.  
  20. Mandomartis hereby grants you a personal, non-exclusive, 
  21. non-transferable license to install THE EFFECTS on an unlimited 
  22. number of web sites or on your computer.
  23.  
  24. You may not decompile, disassemble, or reverse engineer THE EFFECT 
  25. MAKER or THE EFFECTS, and you may not create derivative works of 
  26. the THE EFFECT MAKER, including (without limitation) for the 
  27. purpose of obtaining unauthorized access to THE EFFECTMAKER. You may
  28. modify, translate or adapt the HTML code created by THE EFFECT MAKER
  29. and use THE EFFECT MAKER to create and modify files with the extensions 
  30. SWF and JS. You are not granted any right, title, or interest in the
  31. THE EFFECT MAKER or THE EFFECTS except the right to use it in 
  32. accordance with this Agreement.

  34. 2. REDISTRIBUTION.
  35.  
  36. Redistribution of THE EFFECT MAKER is allowed
  37. by shareware and freeware sites or CDROM media
  38. and similar without the permission of Mandomartis.
  39. Redistribution for commercial purposes or reselling
  40. is not allowed.
  41. Redistribution and reselling of THE EFFECTS 
  42. which are generated by THE EFFECT MAKER is 
  43. allowed together with their necessary
  44. images and sound files.
  45.  
  46. 3. WARRANTY.
  47.  
  48. YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

  50. (a) YOUR USE OF THE EFFECT MAKER AND OF THE EFFECTS IS 
  51. AT YOUR SOLE RISK. THE EFFECT MAKER IS PROVIDED ON AN 
  52. "AS IS" AND "AS AVAILABLE" BASIS. MANDOMARTIS EXPRESSLY 
  53. DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS 
  54. OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED 
  55. WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR 
  56. PURPOSE AND NON-INFRINGEMENT.

  58. (b) MANDOMARTIS MAKES NO WARRANTY THAT (i) THE EFFECT 
  59. MAKER WILL MEET YOUR REQUIREMENTS, (ii) THE EFFECT 
  60. MAKER WILL BE SECURE OR ERROR-FREE, (iii) THE RESULTS 
  61. THAT MAY BE OBTAINED FROM THE USE OF THE EFFECT MAKER 
  62. WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY 
  63. PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL 
  64. PURCHASED OR OBTAINED BY YOU THROUGH THE EFFECT MAKER 
  65. WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN 
  66. THE SOFTWARE WILL BE CORRECTED. 
  67.  
  68. (c) NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, 
  69. OBTAINED BY YOU FROM MANDOMARTIS OR THROUGH OR FROM 
  70. THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY 
  71. STATED IN THIS USER LICENCE AGREEMENT.

  74. 4. COPYRIGHT.
  75.  
  76. THE EFFECT MAKER is owned by Mandomartis 
  77. and is protected by Swedish copyright law and
  78. international treaty provisions.
  79.  
  80. 5. TERMINATION.
  81.  
  82. The license will terminate immediately 
  83. without notice from Mandomartis
  84. if you fail to comply with any provision
  85. of this license. Upon termination,
  86. you must destroy all copies of the software package
  87. and its components on any and all forms of media.
  88.  
  89. 6. LIMITATION OF LIABILITY.
  90.  
  91. IN NO EVENT WILL MANDOMARTIS OR ITS SUPPLIERS BE LIABLE 
  92. FOR ANY LOST REVENUE, PROFIT, OR FOR DIRECT, SPECIAL, 
  93. INDIRECT, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES 
  94. HOW EVER CAUSED AND REGARDLESS OF THEORY OF LIABILITY, 
  95. ARISING OUT OF THE USE OF OR INABILITY TO USE THE 
  96. SOFTWARE PACKAGE, EVEN IF MANDOMARTIS HAS BEEN ADVISED 
  97. OF THE POSSIBILITY OF SUCH DAMAGES.
  98.  
  99. 7. GOVERNING LAW.
  100.  
  101. This agreement is made under, shall be governed
  102. by and construed in accordance with, the
  103. laws of Sweden, court of Flemingsberg.
