  3. INSTALLING THE WINAUDIO DEMO SOFTWARE:
  4. CAREFULLY READ THE TERMS AND CONDITIONS OF THIS AGREEMENT.
  5. BY INSTALLING THE SOFTWARE, YOU ARE CONSENTING TO BE BOUND BY AND ARE
  6. BECOMING A PARTY TO THIS AGREEMENT. IF YOU DO NOT AGREE TO ALL OF THE
  7. TERMS OF THIS AGREEMENT, YOU MUST IMMEDIATELY REMOVE THE SOFTWARE FROM
  8. YOUR SYSTEM.

  10. 1. Zadok Audio Media Products ("Zadok") grants to you a non-exclusive,
  11. non-sublicensable, License to use this demo version of WinAudio
  12. (the "Software"), in binary executable form for evaluation and trial
  13. use purposes only. This License is personal to you and you agree not
  14. to assign your rights herein. You will not make modifications to the
  15. contents of the Software package, notably involving this License
  16. agreement.

  18. 2. ZADOK AUDIO MEDIA PRODUCTS MAKES NO REPRESENTATIONS ABOUT THE
  19. SUITABILITY OF THIS SOFTWARE FOR ANY PURPOSE.
  20. THE SOFTWARE IS PROVIDED 'AS IS' WITHOUT EXPRESS OR IMPLIED WARRANTIES,
  21. INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR
  22. PURPOSE. THIS SOFTWARE IS PROVIDED GRATUITOUSLY AND, ACCORDINGLY,
  23. ZADOK AUDIO MEDIA PRODUCTS SHALL NOT BE LIABLE UNDER ANY THEORY FOR
  24. ANY DAMAGES SUFFERED BY YOU OR ANY USER OF THE SOFTWARE.
  25. ZADOK AUDIO MEDIA PRODUCTS WILL NOT SUPPORT THIS SOFTWARE AND WILL NOT
  26. ISSUE UPDATES TO THIS SOFTWARE.

  28. 3. While Zadok Audio Media Products intends to distribute a commercial
  29. release of the Software, Zadok reserves the right at any time not to
  30. release a commercial release of the Software or, if released, to alter
  31. prices, features, specifications, capabilities, functions, licensing
  32. terms, dates, general availability or other characteristics of the
  33. release.

  35. 4. Title, ownership rights, and intellectual property rights in and to
  36. Software shall remain in Zadok Audio Media Products and/or its
  37. suppliers.

  39. 5. You agree to abide by the copyright law and all other applicable
  40. international laws. You acknowledge that the Software in source code
  41. form remains a trade secret of Zadok Audio Media Products and/or its
  42. suppliers and you agree not to modify the Software or attempt to
  43. decipher, disassemble or reverse engineer the Software.

  45. 6. Zadok Audio Media Producst may terminate this License at any time
  46. by delivering notice to you and you may terminate this License at any
  47. time by destroying or erasing your copy of the Software.

  49. 7. ZADOK AUDIO MEDIA PRODUCTS OR ITS SUPPLIERS SHALL NOT BE LIABLE FOR
  50. (a) INCIDENTAL, SPECIAL OR INDIRECT DAMAGES OF ANY SORT, WHETHER
  51. ARISING IN CONTRACT OR OTHERWISE, EVEN IF ZADOK HAS BEEN INFORMED OF
  52. SUCH DAMAGES, OR
  53. (b) FOR ANY CLAIM BY ANY OTHER PARTY.
