  4. PLEASE READ THIS LICENSE CAREFULLY BEFORE USING THIS TRIAL
  5. SOFTWARE.  BY CLICKING THE "ACCEPT" BUTTON OR BY USING THIS
  6. TRIAL SOFTWARE, YOU AGREE TO BECOME BOUND BY THE TERMS OF
  7. THIS LICENSE.  IF YOU DO NOT AGREE TO THE TERMS OF THIS
  8. LICENSE, CLICK THE "DECLINE" BUTTON AND DO NOT USE THIS
  9. TRIAL SOFTWARE.

  11. You are interested in receiving from Claris Corporation or
  12. Claris Ireland (collectively referred to as "Claris") the
  13. Claris trial software ("Trial Software") and you agree to
  14. use the Trial Software solely in accordance with the terms
  15. of this License.
  16.  
  17. Please be aware that this Trial Software may be programmed
  18. to cease functioning on a certain date.
  19.  
  20. 1.  License Grant.  This Trial Software is licensed, not
  21. sold, to you by Claris for use only under the terms of this
  22. License, and Claris reserves any rights not expressly
  23. granted to you.  Subject to all the terms and conditions of
  24. this License, Claris grants you a nonexclusive,
  25. nontransferable license to use the Trial Software on a
  26. single computer.  To "use" the Trial Software means that the
  27. Trial Software is either loaded in the temporary memory
  28. (i.e. RAM) of a computer or installed on the permanent
  29. memory of a computer (i.e., hard disk, CD ROM, etc.).  You
  30. may make one (1) copy of the Trial Software in machine
  31. readable form solely for backup purposes.  You must
  32. reproduce on each copy any copyright or other proprietary
  33. notices that were on the original copy supplied by Claris.

  35. 2.  Restrictions.  The Trial Software contains trade secrets
  36. in its human perceivable form and, to protect them, you may
  37. not REVERSE ENGINEER, DECOMPILE, DISASSEMBLE OR OTHERWISE
  38. REDUCE THE TRIAL SOFTWARE TO ANY HUMAN PERCEIVABLE FORM.
  39. YOU MANY NOT MODIFY, ADAPT, TRANSLATE, RENT, LEASE, LOAN,
  40. RESELL FOR PROFIT OR CREATE DERIVATIVE WORKS BASED UPON THE
  41. TRIAL SOFTWARE OR ANY PART THEREOF.

  43. 3.  Termination.  This License is effective until
  44. terminated.  This License will terminate immediately without
  45. notice from Claris or judicial resolution if you fail to
  46. comply with any provision of this License.  Upon such
  47. termination you must destroy the Trial Software, any
  48. accompanying written materials and all copies thereof, and
  49. Sections 2, 4, 5, 6 and 7 will survive any termination.

  51. 4.  Export Law Assurances.  You may not use or otherwise
  52. export or reexport the Trial Software except as authorized
  53. by United States laws and the laws of the jurisdiction in
  54. which the Trial Software was obtained.  In particular, but
  55. without limitation, the Trial Software may not be exported
  56. or reexported (i) into (or to a national or resident of )
  57. any U.S. embargoed country or (ii) to anyone on the U.S.
  58. Treasury Department's list of Specially Designated Nationals
  59. or the U.S. Department of Commerce's Table of Denial Orders.
  60. By using the Trial Software, you represent and warrant that
  61. you are not located in, under control of, or a national or
  62. resident of any such country or on any such list.

  64. 5.  Warranty Disclaimer.  YOU ACKNOWLEDGE THAT THE TRIAL
  65. SOFTWARE MAY NOT SATISFY YOUR REQUIREMENTS OR BE FREE FROM
  66. DEFECTS.  THE TRIAL SOFTWARE IS PROVIDED "AS IS" WITHOUT
  67. WARRANTY OF ANY KIND, AND CLARIS EXPRESSLY DISCLAIMS ALL
  68. IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED
  69. WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR
  70. PURPOSE.  SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF
  71. IMPLIED WARRANTIES OR CONDITIONS, SO THE ABOVE EXCLUSION MAY
  72. NOT APPLY TO YOU.

  74. 6.  Limitation of Remedies and Damages.  CLARIS WILL NOT BE
  75. LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT OR
  76. SPECIAL DAMAGES, WHETHER ARISING IN TORT (INCLUDING
  77. NEGLIGENCE), CONTRACT OR OTHERWISE, THAT STEM FROM ANY USE
  78. OF OR INABILITY TO USE THE TRIAL SOFTWARE OR OTHERWISE
  79. ARISING FROM THIS LICENSE.   CLARIS' LIABILITY FOR ACTUAL
  80. DAMAGES FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM
  81. OF THE ACTION, WILL BE LIMITED TO US$50.00.   THIS
  82. LIMITATION WILL NOT APPLY IN CASE OF DEATH, PERSONAL INJURY
  83. AND LOSS OF, DAMAGE TO OR DESTRUCTION OF TANGIBLE PROPERTY
  84. ORDINARILY INTENDED FOR PRIVATE USE OR CONSUMPTION, ONLY
  85. WHERE AND TO THE EXTENT THAT APPLICABLE LAW REQUIRES SUCH
  86. LIABILITY.  BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE
  87. EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR
  88. INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO
  89. YOU.

  91. 7.  General.  This License will be construed under the laws
  92. of the State of California, except for that body of law
  93. dealing with conflicts of law.  If any provision of this
  94. License shall be held by a court of competent jurisdiction
  95. to be contrary to law, that provision will be enforced to
  96. the maximum extent permissible, and the remaining provisions
  97. of this License will remain in full force and effect.  If
  98. the Trial Software is supplied to the United States
  99. Government, the Trial Software is classified as "restricted
  100. computer software" as defined in clause 52.227-19 of the
  101. FAR.  The United States Government's rights to the Trial
  102. Software are as provided in clause 52.227-19 of the FAR.
