    YaST and SuSE Linux licence terms
    =================================

YaST Copyright (c) 1995 - 98 SuSE GmbH, Furth (Germany)

The object of this licence is the YaST (Yet another Setup Tool)
program, the name YaST, together with SuSE Linux, the Linux
Distribution of SuSE GmbH, all programme derived from YaST and all
works or names derived in full or in part thereof together with the
use, application, archiving, reproduction and passing on of YaST,
all programs derived from YaST and all works derived in full or in
part thereof.  The YaST program and all sources is the intellectual
property of SuSE GmbH within the meaning of the Copyright Law.  The
name YaST is a registered trademark of SuSE GmbH. In the following
SuSE GmbH is the licensor and every user or processor of YaST or
works derived in full or in part thereof, together with every person
who reproduces, distributes or archives YaST or SuSE Linux, is the
licensee of SuSE GmbH.

The following licence terms are recognised as a result of the
processing, use, application, archiving reproduction and
dissemination of YaST.

Only this licence gives the Licensee the right to use reproduce, to
distribute or to amend YaST or works derived from it.  These actions
are forbidden by the copyright act, if this licence is not
recognised. If this licence is recognised and complied with in full,
it is also valid even without the written consent of the Licensee.

1. Usage

YaST and SuSE Linux may be used for personal and commercial purposes
if the copyright and licence terms of the installed packages and
programmes are observed. The use of YaST, even if a modified version
is used, does NOT exempt in particular the Licensee from the duty to
take due care with regard to the licence terms of the packages or
programmes installed through YaST or works based on it.

2. Processing

All programmes derived from YaST and all works derived from it in
full or parts thereof are to be filled on the opening screen with
the clear information "Modified Version". Moreover the operator give
his name on the opening screen, stating that SuSE GmbH is not
providing any support for the "Modified Version" and is excluded
from any liability whatsoever.  Every amendment to the sources which
are not conducted by SuSE GmbH are deemed to be a "Modified
Version". The Licensee is entitled to change his copy from the
sources of YaST, whereby a work based on the YaST programme is
created, provided that the following conditions are satisfied.

a) Every amendment must have a note in the source with date and
operator. The amended sources must be made available for the user in
accordance with section 3) together with the unamended licence.

b) The Licensee is obliged to make all work distributed by him which
is derived as a whole or in part from YaST or parts of YaST to third
parties as a whole under the terms of this licence without
royalties.

c) The amendment of this licence by a Licensee, even in part, is
forbidden.

SuSE GmbH reserves the right to accept parts or all amendments of a
modified version of YaST into the official version of YaST free of
charge.  The Licensee has no bearing on this.

3. Dissemination

It is forbidden to reproduce or distribute data carriers which have
been reproduced without authorisation for payment without the prior
written consent of SuSE GmbH or SuSE Linux.  Distribution of the
YaST programme, its sources, whether amended or unamended in full or
in part thereof, and the works derived thereof for a charge require
the prior written consent of SuSE GmbH.

All programmes derived from YaST, and all works derived thereof as a
whole or parts thereof may only be disseminated with the amended
sources and this licence in accordance with 2b).  Making YaST or
works derived thereof available free of charge together with SuSE
Linux on FTP Servers and mailboxes is permitted if the licences on
the software are observed.

4. Guarantee

No guarantee whatsoever is given for YaST or for works derived from
it and SuSE Linux. The SuSE GmbH guarantee only covers fault-free
data carriers.

SuSE GmbH will provide YaST and SuSE Linux "AS IT IS"  without any
guarantee whatever that it is fit for a specific purpose or use.  In
particular SuSE is not liable for lost profit, savings not made, or
damages from the claims lodged by third parties against the
Licensee. SuSE GmbH is not liable either for other direct or
indirect consequential losses, in particular not for the loss or
production of recorded data.

The observance of the respective licences and copyrights of the
installed software is incumbent solely upon the user of YaST and
SuSE Linux.

5. Rights

No other rights to YaST or to SuSE Linux are granted other than
those negotiated in this licence.  An infringement against this
licence automatically terminates the rights of the Licensee.
However the right of third parties who have received copies or
rights under this licence from the Licensee, are not terminated as
long as all parts of his licence are recognised and observed.  If
the Licensee is subject to conditions, or obligations as a result of
a court judgement, patent terms, licence terms, or another reason,
and these conditions or obligations contradict this licence as a
whole or in part, the Licensee shall only be exempted in full or in
part from this licence and its terms with the express prior written
consent of SuSE, SuSE is entitled to withhold its consent without
giving reasons.

6. Additional restrictions.

If the distribution or use of YaST and SuSE Linux or parts of SuSE
Linux is restricted in a state either by patents or by interfaces
protected by copyright, SuSE GmbH can specify an explicit geographic
restriction of the distribution of YaST and SuSE Linux or parts of
SuSE Linux, in which these states are fully or partially excluded
from distribution. In such a case this licence includes the whole or
partial restriction as if it was written down in this licence.

oder auSuSEse abgeleiteten Werke. Das Programm YaST mit allen
Quellen ist im Sinne des Urheberrechts geistiges Eigentum der SuSE
GmbH.  Der Name YaST ist ein eingetragenes Warenzeichen der SuSE
GmbH. Im folgenden tritt die SuSE GmbH als Lizenzgeber auf, und
jeder Benutzer oder Bearbeiter von YaST oder daraus vollstΣndig oder
auSuSEse abgeleiteten Werke sowie jede Person, die YaST oder SuSE
Linux archiviert, vervielfΣltigt und verbreitet, ist Lizenznehmer
der SuSE GmbH.

Durch die Bearbeitung, Benutzung, Verwendung, Archivierung,
VervielfΣltigung und Weitergabe von YaST werden die folgenden
Lizenzbestimmungen anerkannt.

Nur diese Lizenz gibt dem Lizenznehmer das Recht, YaST oder daraus
abgeleitete Werke zu benutzen, zu vervielfΣltigen, zu verteilen oder
zu verΣndern.  Diese Handlungen sind durch das Urheberrecht
untersagt, wenn diese Lizenz nicht anerkannt wird.  Wird diese
Lizenz im ganzen anerkannt und befolgt, ist sie auch ohne
schriftliche Zustimmung des Lizenznehmers gⁿltig.

1) Benutzung

YaST und SuSE Linux dⁿrfen fⁿr private und kommerzielle Zwecke unter
Beachtung der Urheberrechte und Lizenzbestimmungen der installierten
Pakete und Programme genutzt werden.  Die Benutzung von YaST, auch
bei Verwendung einer modifizierten Version, befreit insbesondere den
Lizenznehmer NICHT von der gebotenen Sorgfaltspflicht gegenⁿber den
Lizenzbestimmungen der durch YaST oder darauf basierenden Werken
installierten Pakete und Programme.

2) Bearbeitung

Alle aus YaST abgeleiteten Programme und alle vollstΣndig oder
auSuSEse abgeleiteten Werke sind auf dem Er÷ffnungsbildschirm mit
dem eindeutigen Hinweis `Modifizierte Version' zu versehen.
Desweiteren hat der Bearbeiter seinen Namen, einen Hinweis, da▀ die
SuSE GmbH fⁿr die `Modifizierten Version' keinen Support leistet und
den Ausschlu▀ jedweder Haftung auf dem Er÷ffnungsbildschirm
anzugeben.  Als `Modifizierte Version' gilt jede ─nderung in den
Quellen, die nicht von der SuSE GmbH durchgefⁿhrt wird.  Der
Lizenznehmer hat das Recht, seine Kopie der Quellen von YaST zu
verΣndern, wodurch ein auf dem Programm YaST basierendes Werk
entsteht, vorausgesetzt, da▀ die folgende Bedingungen erfⁿllt sind:

a) Jede ─nderung mu▀ in den Quellen mit Datum und Bearbeiter
vermerkt sein. Die verΣnderten mⁿssen Quellen nach Abschnitt 3),
zusammen mit dieser unverΣnderten Lizenz, dem Benutzer zu Verfⁿgung
gestellt werden.

b) Der Lizenznehmer ist verpflichtet, da▀ jede von ihm verbreitete
Arbeit, die ganz oder teilweise von YaST oder Teilen von YaST
abgeleitet ist, Dritten gegenⁿber als Ganzes unter den Bedingungen
dieser Lizenz ohne Lizenzgebⁿhren zur Verfⁿgung gestellt wird.

c) Die ─nderung dieser Lizenz durch einen Lizenznehmer, auch nur
teilweise, ist untersagt.

Die SuSE GmbH behΣlt sich das Recht vor, unentgeltlich Teile oder
alle ─nderungen einer modifizierten Version von YaST in die
offizielle Version von YaST aufzunehmen. Der Lizenznehmer hat darauf
keinen Einflu▀.

3) Weitergabe

Es ist untersagt, ohne vorherige schriftliche Genehmigung der SuSE
GmbH YaST oder SuSE Linux gegen Entgelt zu vervielfΣltigen oder
unberechtigt vervielfΣltigte DatentrΣger zu verbreiten.  Die
Verteilung gegen Entgelt des Programms YaST, dessen Quellen, ob
vollstΣndig oder teilweise verΣndert oder unverΣndert, und der
daraus abgeleiteten Werke bedⁿrfen der vorherigen schriftlichen
Zustimmung der SuSE GmbH.

Alle aus YaST abgeleiteten Programme und alle vollstΣndig oder
auSuSEse abgeleiteten Werke dⁿrfen nach 2b) nur mit den verΣnderten
Quellen und dieser Lizenz weitergegeben werden.  Die kostenfreie
Bereitstellung von YaST oder daraus abgeleiteten Werken zusammen mit
SuSE Linux auf FTP-Servern und Mailboxen ist unter Beachtung der
Lizenzen der Software gestattet.

4) GewΣhrleistung

Fⁿr YaST oder daraus abgeleitete Werke und SuSE Linux ist jegliche
GewΣhrleistung ausgeschlossen.  Die GewΣhrleistung der SuSE GmbH
erstreckt sich nur auf fehlerfreie DatentrΣger.

Die SuSE GmbH stellt YaST und SuSE Linux so zur Verfⁿgung, "WIE ES
IST", ohne jedwede GewΣhrleistung, ohne die Tauglichkeit fⁿr einen
bestimmten Zweck oder die Verwendbarkeit zu garantieren.
Insbesondere haftet SuSE nicht fⁿr entgangenen Gewinn, ausgebliebene
Einsparungen oder SchΣden aus Ansprⁿchen Dritter gegenⁿber dem
Lizenznehmer.  Die SuSE GmbH haftet auch nicht fⁿr sonstige
mittelbare oder unmittelbare FolgeschΣden, insbesondere nicht fⁿr
den Verlust oder die Erstellung aufgezeichneter Daten.

Die Beachtung der jeweiligen Lizenzen und Urheberrechte der
installierten Software obliegt allein dem Benutzer von YaST und SuSE
Linux.

5) Rechte

Es werden keine weiteren Rechte an YaST oder an SuSE Linux als die
in dieser Lizenz behandelten eingerΣumt.  Ein Versto▀ gegen diese
Lizenz beendet automatisch die Rechte des Lizenznehmers. Jedoch
werden die Rechte Dritter, die vom Lizenznehmer Kopien oder Rechte
unter dieser Lizenz erhalten haben, nicht beendet, solange diese
Lizenz in allen Teilen anerkannt und befolgt wird.  Falls der
Lizenznehmer aufgrund eines Gerichtsurteils, Patentbestimmungen,
Lizenzbestimmungen oder aus einem anderen Grund Bedingungen oder
Verpflichtungen auferlegt werden, die dieser Lizenz ganz oder in
Teilen widersprechen, so wird der Lizenznehmer ausdrⁿcklich nur mit
vorheriger schriftlicher Zustimmung der SuSE GmbH von dieser Lizenz
und ihren Bedingungen ganz oder teilweise befreit.  Es ist das Recht
der SuSE GmbH, diese Zustimmung ohne Angabe von Grⁿnden zu
verweigern.

6) Weitere EinschrΣnkungen

Wenn die Verbreitung oder Benutzung von YaST und SuSE Linux oder
Teilen von SuSE Linux in einem Staat entweder durch Patente oder
durch urheberrechtlich geschⁿtzte Schnittstellen eingeschrΣnkt ist,
kann die SuSE GmbH eine explizite geographische Begrenzung der
Verbreitung von YaST und SuSE Linux oder Teilen von SuSE Linux
angeben, mit der diese Staaten ganz oder teilweise von der
Verbreitung ausgeschlossen werden.  In einem solchen Fall beinhaltet
diese Lizenz die ganze oder teilweise BeschrΣnkung, als wΣre sie in
dieser Lizenz niedergeschrieben.

programme YaST et tous ses codes sources sont, au sens dΘfini par la
loi sur les droits d'auteurs, la propriΘtΘ intellectuelle de SuSE
GmbH. Le nom YaST est une marque dΘposΘe de SuSE GmbH. Dans la suite
de ce document SuSE est dΘsignΘe par le terme "concΘdant de
licence".  Tout utilisateur ou toute personne procΘdant au
traitement de YaST ou des ouvrages qui en sont dΘrivΘs totalement ou
partiellement ainsi que toute personne qui archive, reproduit et
diffuse YaST ou SuSE Linux est "bΘnΘficiaire de licence" de SuSE
GmbH.

Par le traitement, l'utilisation, l'application, l'archivage, la
reproduction et la diffusion de YaST, l'utilisateur reconnait
implicitement les termes de la prΘsente licence.

Seule la prΘsente licence donne au bΘnΘficiaire de licence le droit
d'utiliser, de reproduire, de distribuer ou de modifier YaST ou les
ouvrages qui en sont dΘrivΘs. Ces actions sont interdites par la loi
sur les droits d'auteurs si la prΘsente licence n'est pas reconnue.
Si la prΘsente licence est pleinement reconnue et respectΘe, elle
est valide mΩme sans le consentement Θcrit du concΘdant de licence.

1) Utilisation

YaST et SuSE Linux peuvent Ωtre utilisΘs α des fins privΘes et
commerciales si les droits d'auteurs et les clauses de licence des
paquetages et des programmes installΘs sont observΘs. L'utilisation
de YaST, mΩme lorsqu'il s'agit d'une version modifiΘe, N'EXEMPTE PAS
en particulier le bΘnΘficiaire de licence de l'obligation d'observer
les clauses de licence des paquetages installΘs par l'intermΘdiaire
de YaST ou d'ouvrages se basant sur YaST.

2) Traitement

Tous les programmes dΘrivΘs de YaST et tous les ouvrages qui en sont
dΘrivΘs en totalitΘ ou en partie doivent Ωtre pourvus, sur l'Θcran
de dΘmarrage, de la mention claire 'version modifiΘe'. En outre, la
personne ayant effectuΘ les modifications devra indiquer son nom sur
l'Θcran de dΘmarrage et prΘciser que SuSE GmbH n'offre pas
d'assistance technique pour les 'versions modifiΘes' et que toute
responsabilitΘ est exclue. Toute modification apportΘe aux sources
et n'ayant pas ΘtΘ rΘalisΘe par SuSE GmbH est considΘrΘe comme
'version modifiΘe' et se trouve donc exclue de l'assistance
technique. Le bΘnΘficiaire de licence a le droit de modifier sa
copie de YaST crΘant ainsi un ouvrage basΘ sur le programme YaST, si
les conditions suivantes sont remplies:

a) Toute modification doit Ωtre indiquΘe dans les sources avec la
date et le nom du programmeur ayant rΘalisΘ cette modification. Les
sources modifiΘs doivent Ωtre mis α la disposition de l'utilisateur
conformΘment au paragraphe 3), accompagnΘs de la prΘsente licence
non modifiΘe.

b) Le bΘnΘficiaire de licence a l'obligation de mettre tout ouvrage
qu'il diffuse et qui est dΘrivΘ totalement ou partiellement de YaST
ou de parties de YaST α la disposition de tiers dans sa totalitΘ,
aux conditions fixΘes par la prΘsente licence, sans percevoir de
droits de licence.

c) La modification, mΩme partielle, de la prΘsente licence par un
bΘnΘficiaire de licence est interdite.

SuSE se rΘserve le droit d'inclure dans la version officielle de
YaST tout ou partie des modifications apportΘes α YaST sans avoir α
verser aucune redevance. Le bΘnΘficiaire de licence ne peut pas s'y
opposer.

3) Diffusion

Il est interdit, sans accord prΘalable donnΘ par Θcrit par SuSE
GmbH, de reproduire, α titre onΘreux, YaST ou SuSE Linux ou de
diffuser des supports de programmes reproduits sans autorisation.
La distribution, α titre onΘreux du programme YaST et de ses
sources, qu'il s'agisse d'une version modifiΘe totalement,
partiellement ou ne comportant aucune modification ainsi que la
distribution des ouvrages qui en sont dΘrivΘs nΘcessitent
l'autorisation prΘalable et Θcrite de SuSE GmbH.

Tous les programmes dΘrivΘs de YaST et tous les ouvrages qui en sont
dΘrivΘs totalement ou partiellement ne peuvent Ωtre diffusΘs,
conformΘment au paragraphe 2b), qu'accompagnΘs des sources modifiΘs
ainsi que de la prΘsente licence. La mise α disposition gratuite de
YaST ou d'ouvrages qui en sont dΘrivΘs sur serveurs FTP ou boεtes α
lettres est autorisΘe si les termes de la licence sur les logiciels
sont respectΘs.

4) Garantie

Aucune garantie contractuelle n'existe pour YaST ou les ouvrages
dΘrivΘs, ni pour la distribution SuSE Linux. La garantie accordΘe
par SuSE GmbH ne couvre que les supports de programmes (CD ROM et
disquettes).

SuSE GmbH fournit YaST et SuSE Linux "TELS QUELS" sans aucune
garantie et sans rΘpondre ni de leur adΘquation α un usage prΘcis,
ni de leur utilitΘ pratique. En particulier, SuSE n'est nullement
responsable de pertes de bΘnΘfices, d'Θconomies non rΘalisΘes ni de
dommages rΘsultant de revendications formulΘes par des tiers α
l'encontre du bΘnΘficiaire de licence. SuSE GmbH n'est pas non plus
responsable de dommages directs ou indirects, en particulier de
perte ou de crΘation de donnΘes enregistrΘes.

L'observation des licences respectives, des copyrights et des rΦgles
d'utilisation des logiciels installΘs incombe entiΦrement α
l'utilisateur de YaST et de SuSE Linux.

5) Droits

Aucun droit autre que ceux dΘfinis par la prΘsente licence n'est
accordΘ sur YaST ou SuSE Linux. Toute infraction aux rΦgles de la
prΘsente licence entraεne l'extinction automatique des droits
accordΘs au bΘnΘficiaire de licence. Toutefois, les tiers ayant
obtenu du bΘnΘficiaire de licence des copies ou des droits au titre
de la prΘsente licence ne voient pas leurs droits annulΘs tant que
la prΘsente licence est reconnue et respectΘe dans tous ses termes.

Si le bΘnΘficiaire de licence se voit imposer des conditions ou
obligations rΘsultant d'une dΘcision de justice ou dΘcoulant de
clauses de brevets, de clauses de licences, ou pour toute autre
raison, et si ces conditions et obligations contredisent totalement
ou partiellement celles de la prΘsente licence, le bΘnΘficiaire de
licence ne sera expressΘment dΘgagΘ, totalement ou partiellement,
des obligations liΘes α la prΘsence licence et α ses conditions que
par accord prΘalable de SuSE GmbH donnΘ par Θcrit. SuSE GmbH a le
droit de refuser son accord sans avoir α exposer les raisons de son
refus.

6) Autres restrictions

Si la distribution ou l'utilisation de YaST et de SuSE Linux ou de
parties de SuSE Linux est restreinte dans un pays, soit par des
brevets, soit par des interfaces protΘgΘes par copyright, SuSE GmbH
peut spΘcifier explicitement des limitations gΘographiques α la
distribution de YaST et de SuSE Linux ou parties de SuSE Linux,
excluant ces pays partiellement ou totalement de la distribution. La
prΘsente licence inclut, dans un tel cas, la restriction totale ou
partielle comme si elle avait ΘtΘ spΘcifiΘe par Θcrit dans le texte
de la prΘsente licence.
