  1. Star Division EndUser License Agreement
  2.  
  3. BY OPENING THE CDROM PACKAGE, YOU ARE CONSENTING TO BE BOUND BY AND
  4. ARE BECOMING A PARTY TO THIS AGREEMENT. IF YOU DO NOT AGREE TO ALL OF
  5. THE TERMS OF THIS AGREEMENT, RETURN THE COMPLETE PACKAGE UNOPENED TO
  6. THE PLACE OF PURCHASE FOR A FULL REFUND.

  8. STAR DIVISION STAR OFFICE ENDUSER LICENSE AGREEMENT GRANT.
  9. REDISTRIBUTION NOT PERMITTED.
  10.  
  11. This Agreement has 3 parts.  Part I applies if you have not purchased
  12. a license to the accompanying software (the "Software").  Part II
  13. applies if you have purchased a license to the Software.  Part III
  14. applies to all license grants.  If you initially acquired a copy of
  15. the Software without purchasing a license and you wish to purchase a
  16. license, contact Star Division GmbH ("Star Division") on the Internet
  17. at http:/www.stardivision.de
  18.  
  19. PART I TERMS APPLICABLE WHEN LICENSE FEES NOT (YET) PAID (LIMITED TO
  20. EVALUATION, EDUCATIONAL AND NONPROFIT USE) GRANT.
  21.  
  22. Star Division grants you a nonexclusive license to use the Software
  23. free of charge if (a) you are a student, faculty member or staff
  24. member of an educational institution (K12, junior college, college or
  25. library), a staff member of a religious organization, or an employee
  26. of an organization which meets Star Division's criteria for a
  27. charitable nonprofit organization; or (b) your use of the Software is
  28. for the purpose of evaluating whether to purchase an ongoing license
  29. to the Software.  The evaluation period for use by or on behalf of a
  30. commercial entity is limited to 90 days; evaluation use by others is
  31. not subject to this 90 day limit.  Government agencies (other than
  32. public libraries) are not considered educational, religious, or
  33. charitable nonprofit organizations for purposes of this Agreement. If
  34. you are using the Software free of charge, you are not entitled to
  35. support or telephone assistance.  If you fit within the description
  36. above, you may use the Software in the manner described in Part III
  37. below under "Scope of Grant."
  38.  
  39. DISCLAIMER OF WARRANTY.
  40.  
  41. Free of charge Software is provided on an "AS IS" basis, without
  42. warranty of any kind, including without limitation the warranties of
  43. merchantability, fitness for a particular purpose and
  44. noninfringement. The entire risk as to the quality and performance of
  45. the Software is borne by you.  Should the Software prove defective,
  46. you and not Star Division assume the entire cost of any service and
  47. repair. In addition, the security mechanisms implemented by Star
  48. Division software have inherent limitations, and you must determine
  49. that the Software sufficiently meets your requirements. This
  50. disclaimer of warranty constitutes an essential part of the
  51. agreement. SOME JURISDICTIONS DO NOT ALLOW EXCLUSIONS OF AN IMPLIED
  52. WARRANTY, SO THIS DISCLAIMER MAY NOT APPLY TO YOU AND YOU MAY HAVE
  53. OTHER LEGAL RIGHTS THAT VARY BY JURISDICTION.

  55. PART II TERMS APPLICABLE WHEN LICENSE FEES PAID GRANT. Subject to
  56. payment of applicable license fees, Star Division grants to you a
  57. nonexclusive license to use the Software and accompanying online
  58. documentation ("Documentation") in the manner described in Part III
  59. below under "Scope of Grant."
  60.  
  61. LIMITED WARRANTY.
  62.  
  63. Star Division warrants that for a period of ninety (90) days from the
  64. date of acquisition, the Software, if operated as directed, will
  65. substantially achieve the functionality described in the
  66. Documentation. Star Division does not warrant, however, that your use
  67. of the Software will be uninterrupted or that the operation of the
  68. Software will be errorfree or secure. In addition, the security
  69. mechanisms implemented by Star Division software have inherent
  70. limitations, and you must determine that the Software sufficiently
  71. meets your requirements.  Star Division also warrants that the media
  72. containing the Software, if provided by Star Division, is free from
  73. defects in material and workmanship and will so remain for ninety (90)
  74. days from the date you acquired the Software. Star Division's sole
  75. liability for any breach of this warranty shall be, in Star Division's
  76. sole discretion: (i) to replace your defective media; or (ii) to
  77. advise ou how to achieve substantially the same functionality with the
  78. Software as described in the Documentation through a procedure
  79. different from that set forth in the Documentation; or (iii) if the
  80. above remedies are impracticable, to refund the license fee you paid
  81. for the Software. Repaired, corrected, or replaced Software and
  82. Documentation shall be covered by this limited warranty for the period
  83. remaining under the warranty that covered the original Software, or if
  84. longer, for thirty (30) days after the date (a) of shipment to you of
  85. the repaired or replaced Software, or (b) Star Division advised you
  86. how to operate the Software so as to achieve the functionality
  87. described in the Documentation. Only if you inform Star Division of
  88. your problem with the Software during the applicable warranty period
  89. and provide evidence of the date you purchased a license to the
  90. Software will Star Division be obligated to honor this warranty. Star
  91. Division will use reasonable commercial efforts to repair, replace,
  92. advise or, for individual consumers, refund pursuant to the foregoing
  93. warranty within 30 days of being so notified.

  95. THIS IS A LIMITED WARRANTY AND IT IS THE ONLY WARRANTY MADE BY Star
  96. Division. Star Division MAKES NO OTHER EXPRESS WARRANTY AND NO
  97. WARRANTY OF NON-INFRINGEMENT OF THIRD PARTIES' RIGHTS. THE DURATION OF
  98. IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF
  99. MERCHANTABILITY AND OF FITNESS FOR A PARTICULAR PURPOSE, IS LIMITED TO
  100. THE ABOVE LIMITED WARRANTY PERIOD; SOME JURISDICTIONS DO NOT ALLOW
  101. LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO LIMITATIONS MAY
  102. NOT APPLY TO YOU. NO STAR DIVISION DEALER, AGENT, OR EMPLOYEE IS
  103. AUTHORIZED TO MAKE ANY MODIFICATIONS, EXTENSIONS, OR ADDITIONS TO THIS
  104. WARRANTY. If any modifications are made to the Software by you during
  105. the warranty period; if the media is subjected to accident, abuse, or
  106. improper use; or if you violate the terms of this Agreement, then this
  107. warranty shall immediately be terminated. This warranty shall not
  108. apply if the Software is used on or in conjunction with hardware or
  109. software other than the unmodified version of hardware and software
  110. with which the software was designed to be used as described in the
  111. Documentation.  THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU
  112. MAY HAVE OTHER LEGAL RIGHTS THAT VARY BY JURISDICTION.

  114. PART III  TERMS APPLICABLE TO ALL LICENSE GRANTS
  115.  
  116. SCOPE OF GRANT.
  117.  
  118. You may:
  119. * use the Software on any single computer;
  120. * use the Software on a network, provided that each person accessing
  121.   the Software through the network must have a copy licensed to that
  122.   person;
  123. * use the Software on a second computer so long as only one copy is
  124.   used at a time;
  125. * copy the Software for archival purposes, provided any copy 
  126.   must contain all of the original Software's proprietary notices; or
  127. * if you have purchased licenses for a 10 Pack or a 50 Pack, make up
  128.   to 10 or 50 copies, respectively, of the Software (but not the
  129.   Documentation), provided any copy must contain all of the original
  130.   Software's proprietary notices.  The number of copies is the total
  131.   number of copies that may be made for all platforms.  Additional
  132.   copies of Documentation may be purchased.
  133.  
  134. You may not:
  135.  
  136. * permit other individuals to use the Software except under the terms
  137.   listed above;
  138. * permit concurrent use of the Software;
  139. * modify, translate, reverse engineer, decompile, disassemble
  140.   (except to the extent applicable laws specifically prohibit such
  141.   restriction), or create derivative works based on the Software;
  142. * copy the Software other than as specified above;
  143. * rent, lease, grant a security interest in, or otherwise transfer
  144.   rights to the Software; or
  145. * remove any proprietary  notices or labels on the Software.
  146.  
  147. TITLE.
  148.  
  149. Title, ownership rights, and intellectual property rights in the
  150. Software shall remain in Star Division and/or its suppliers. The
  151. Software is protected by the copyright laws and treaties.  Title and
  152. related rights in the content accessed through the Software is the
  153. property of the applicable content owner and may be protected by
  154. applicable law. This License gives you no rights to such content.
  155.  
  156. TERMINATION.
  157.  
  158. The license will terminate automatically if you fail to comply with
  159. the limitations described herein.  On termination, you must destroy
  160. all copies of the Software and Documentation.
  161.  
  162. EXPORT CONTROLS.
  163.  
  164. None of the Software or underlying information or technology may be
  165. exported or reexported (i) into (or to a national or resident of)
  166. Cuba, Iraq, Libya, Yugoslavia, North Korea, Iran, Syria or any other
  167. country to which the U.S. has embargoed goods; or (ii) to anyone on
  168. the U.S. Treasury Department's list of Specially Designated Nationals
  169. or the U.S. Commerce Department's Table of Denial Orders. By
  170. downloading or using the Software, you are agreeing to the foregoing
  171. and you are representing and warranting that you are not located in,
  172. under the control of, or a national or resident of any such country or
  173. on any such list.
  174.  
  175. LIMITATION OF LIABILITY. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL
  176. THEORY, TORT, CONTRACT, OR OTHERWISE, SHALL STAR DIVISION OR ITS
  177. SUPPLIERS OR RESELLERS BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY
  178. INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY
  179. CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL,
  180. WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER
  181. COMMERCIAL DAMAGES OR LOSSES. IN NO EENT WILL STAR DIVISION BE LIABLE
  182. FOR ANY DAMAGES IN EXCESS OF THE AMOUNT STAR DIVISION RECEIVED FROM
  183. YOU FOR A LICENSE TO THE SOFTWARE, EVEN IF STAR DIVISION SHALL HAVE
  184. BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY
  185. ANY OTHER PARTY. THIS LIMITATION OF LIABILITY SHALL NOT APPLY TO
  186. LIABILITY FOR DEATH OR PERSONAL INJURY TO THE EXTENT APPLICABLE LAW
  187. PROHIBITS SUCH LIMITATION. FURTHERMORE, SOME JURISDICTIONS DO NOT
  188. ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL
  189. DAMAGES, SO THIS LIMITATION AND EXCLUSION MAY NOT APPLY TO YOU.
  190.  
  191. HIGH RISK ACTIVITIES.
  192.  
  193. The Software is not faulttolerant and is not designed, manufactured or
  194. intended for use or resale as online control equipment in hazardous
  195. environments requiring failsafe performance, such as in the operation
  196. of nuclear facilities, aircraft navigation or communication systems,
  197. air traffic control, direct life support machines, or weapons systems,
  198. in which the failure of the Software could lead directly to death,
  199. personal injury, or severe physical or environmental damage ("High
  200. Risk Activities").  Star Division and its suppliers specifically
  201. disclaim any express or implied warranty of fitness for High Risk
  202. Activities.
  203.  
  204. MISCELLANEOUS.
  205.  
  206. If the copy of the Software you received was accompanied by a printed
  207. or other form of "hardcopy" End User License Agreement whose terms
  208. vary from this Agreement, then the hardcopy End User License Agreement
  209. governs your use of the Software.  This Agreement represents the
  210. complete agreement concerning this license and may amended only by a
  211. writing executed by both parties. THE ACCEPTANCE OF ANY PURCHASE ORDER
  212. PLACED BY YOU IS EXPRESSLY MADE CONDITIONAL ON YOUR ASSENT TO THE
  213. TERMS SET FORTH HEREIN, AND NOT THOSE IN YOUR PURCHASE ORDER. If any
  214. provision of this Agreement is held to be unenforceable, such
  215. provision shall be reformed only to the extent necessary to make it
  216. enforceable.  This Agreement shall be governed by Utah law (except for
  217. conflict of law provisions). The application the United Nations
  218. Conventio of Contracts for the International Sale of Goods is
  219. expressly excluded.
  220.  
  221. U.S. GOVERNMENT RESTRICTED RIGHTS.  Use, duplication or disclosure by
  222. the Government is subject to restrictions set forth in subparagraphs
  223. (a) through (d) of the Commercial ComputerRestricted Rights clause at
  224. FAR 52.22719 when applicable, or in subparagraph (c)(1)(ii) of the
  225. Rights in Technical Data and Computer Software clause at DFARS
  226. 252.2277013, or at 252.2117015, or to Star Division's standard
  227. commercial license, as applicable, and in similar clauses in the NASA
  228. FAR Supplement. Contractor/manufacturer is Star Division, Sachsenfeld
