  1.                    SOFTWARE LICENSE AGREEMENT

  6. 3D Construction Company grants you a non-transferable, non-exclusive
  7. license to use only this copy of the 3D BUILDER program and its
  8. accompanying materials according to the following terms:
  9.  
  10. LICENSE
  11. a) You may use the program on only one computer at a time.
  12. b) You may make one copy of the program only for backup purposes,
  13.    provided that you reproduce all  proprietary notices on the copy.
  14. c) You may transfer the program onto your hard disk only for use as
  15.    described above providing that you can prove ownership of the 
  16.    original disks.
  17. d) You may physically transfer the program from one computer to
  18.    another provided that the program is used on one computer at a  
  19.    time.
  20. e) You may NOT use the program in a network unless you pay for a
  21.    separate license for each terminal or workstation from which the 
  22.    program will be accessed.
  23. f) You may NOT reverse engineer, decompile, dissemble, modify,
  24.    translate, or create derivative works based on, or copy the program
  25.    or accompanying materials(except for the backup copy listed above).
  26. g) You may NOT transfer, rent or grant any rights to the program in
  27.    any form or accompanying materials to any person or company 
  28.    without the prior written consent of 3D Construction Company.
  29. h) You may NOT remove any of the proprietary notices, or labels, or
  30.    marks on the program or accompanying materials. This license is
  31.    not a SALE. Title and copyrights to the program, all or any 
  32.    accompanying materials, and any copy made by you remain the
  33.    property of 3D Construction Company.

  35. TERMINATION
  36.   Any unauthorized copying of  the 3D BUILDER program (alone or 
  37.   merged with any other software) or any of the accompanying 
  38.   materials, or failure to comply with the above restrictions
  39.   will result in the automatic termination of this license and
  40.   will make available to 3D Construction Company other legal
  41.   recourse and action.

  43. WARRANTY AND DISCLAIMER
  44.   "As Is". The 3D BUILDER program and all accompanying materials
  45.    are provided to you "as is" without warranty of any kind,
  46.    either express or implied, including, but not limited to, the
  47.    implied warranties or merchantability and fitness for a particular
  48.    purpose. 3D Construction Company does not warrant that the
  49.    functions and/or performance of this program will meet your
  50.    requirements or that the operation will be uninterrupted or
  51.    error free.  The risk as to the use, performance, and/or quality
  52.    of the program and any/all accompanying materials is entirely
  53.    with you.  Should the program prove defective, you, and not 3D
  54.    Construction Company assume the entire cost of any/and all
  55.    necessary repairs. 3D Construction Company does warrant the 
  56.    diskettes on which 3D BUILDER is furnished to be defect free
  57.    in workmanship and materials  under normal use for a period of
  58.    30 days from the date of delivery to you as evidenced by a copy
  59.    of your receipt. The duration of any implied warranties is limited
  60.    to the period stated above.  3D Construction Company's entire
  61.    liability will be the replacement of the diskettes.

  64. LIMITATION OF LIABILITY 
  65.   Under no circumstances will 3D Construction Company be liable
  66.   for any damages, including loss of data, lost profits, cost of
  67.   cover or other special, consequential or indirect damages arising
  68.   from the us of 3D BUILDER or any or all of its accompanying
  69.   materials.  You acknowledge that the license fee reflects this
  70.   allocation of risk.
