1. Software AG grants you a nontransferable and non-exclusive license to use the enclosed Software AG software program(s) ("Software") and its documentation, solely for your own internal data processing and computing needs. The Licensee may not use this Software in connection with the sale or leasing of computer services or for the development of software for sale, lease, or other external distribution or to process data on behalf of others without the written permission of Software AG.
ADABAS D Personal Edition Software is defined as Software which may execute on the following platforms, such as, but not limited to: Windows NT and Windows 95. Each ADABAS D Personal Edition Client Software on a multi-user computer or a local area network must have a valid license from Software AG.
This free Personal Edition of ADABAS D is for your personal use only, and is provided to you for the purpose of testing and demonstrating the functionality of ADABAS D, and contains the following restrictions:
(a) Maximum 100 MB database size
(b) Maximum of five (5) concurrent sessions
(c) No distributed functionality
(d) No stored procedures, triggers or dB functions
(e) Limited tool set
Software AG does not provide any support for the installation and usage of this ADABAS D Personal Edition.
2. You may not sublicense, assign, rent, lease or otherwise convey the right to use the Software; any attempt to do so (whether or not successful), terminates this license to use the Software without refund of any fees paid.
3. Software AG further grants you the right to make a back-up archival copy of the Software CD-ROM/Disks as set forth in Paragraph 4. You may not decompile, disassemble, reverse engineer, copy, transfer or otherwise use the Software except as stated in this Agreement. Some documentation for the Software contained on the CD-ROM/Disks may be viewable using a utility called WordView, which is a product of Interleaf GmbH. The usage authorization for backup and archival copyright notification and restrictions granted for the Software also applies to WordView. SOFTWARE AG MAKES NO WARRANTY WHATSOEVER AS TO THE WORDVIEW SOFTWARE, WHICH IS PROVIDED "AS IS".
4. The sealed CD-ROM/Disk Packages, containing the Software, and its associated documentation are proprietary products of Software AG and are protected by copyright laws and international treaties. You must treat the Software like any other copyrighted material, except that you may either make one (1) copy of the Software for backup or archival purposes, or you may place the ADABAS D Server Software on a single server and the ADABAS D Client Software on a single hard disk for each user provided that you keep the original Software solely for backup or archival purposes. Copyright laws prohibit making additional copies of the Software for any other reason. You may not copy the documentation and/or other written materials without the written permission of Software AG.
5. LIMITED WARRANTY/LIMITATION OF REMEDIES: SOFTWARE AG ARE LICENSED "AS IS". SOFTWARE AG MAKES NO WARRANTIES WHATSOEVER, AND SUCH WARRANTY IS IN LIEU OF ANY OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO THE SOFTWARE AND THE ACCOMPANYING DOCUMENTATION. THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THE SOFTWARE IS ASSUMED BY YOU.
IN NO EVENT WILL SOFTWARE AG BE LIABLE TO YOU FOR DIRECT OR INDIRECT DAMAGES, INCLUDING ANY LOSS OF PROFITS OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SOFTWARE EVEN IF SOFTWARE AG OR AN AUTHORIZED SOFTWARE REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
6. Software AG may terminate this License Agreement in the event that Licensee breaches any of the terms and conditions of this Agreement and that the breach is not cured within thirty (30) days after receipt of written notice of the breach from Software AG. Upon receipt of written termination notice, Licensee shall cease using the Software and shall return to Software AG all Software and documentation.
7. If any provision of this Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of the remaining provisions of this Agreement. This Agreement is governed by the laws of the Commonwealth of Virginia.
