  3. Binary Code License Agreement
  4.  
  5. READ THE TERMS OF THIS AGREEMENT AND ANY PROVIDED 
  6. SUPPLEMENTAL LICENSE TERMS (COLLECTIVELY "AGREEMENT") 
  7. CAREFULLY BEFORE OPENING THE SOFTWARE MEDIA PACKAGE.  BY 
  8. OPENING THE SOFTWARE MEDIA PACKAGE, YOU AGREE TO THE TERMS 
  9. OF THIS AGREEMENT. IF YOU ARE ACCESSING THE SOFTWARE 
  10. ELECTRONICALLY, INDICATE YOUR ACCEPTANCE OF THESE TERMS BY 
  11. SELECTING THE "ACCEPT" BUTTON AT THE END OF THIS AGREEMENT.  
  12. IF YOU DO NOT AGREE TO ALL THESE TERMS, PROMPTLY RETURN THE 
  13. UNUSED SOFTWARE TO YOUR PLACE OF PURCHASE FOR A REFUND OR, 
  14. IF THE SOFTWARE IS ACCESSED ELECTRONICALLY, SELECT THE 
  15. "DECLINE" BUTTON AT THE END OF THIS AGREEMENT.

  17. 1.  LICENSE TO USE.  Sun grants you a non-exclusive and non-transferable license 
  18. for the internal use only of the accompanying software and documentation and any 
  19. error corrections provided by Sun (collectively "Software"), by the number of 
  20. users and the class of computer hardware for which the corresponding fee has 
  21. been paid.
  22.  
  23. 2.  RESTRICTIONS  Software is confidential and copyrighted. Title to Software 
  24. and all associated intellectual property rights is retained by Sun and/or its 
  25. licensors.  Except as specifically authorized in any Supplemental License Terms, 
  26. you may not make copies of Software, other than a single copy of  Software for 
  27. archival purposes.  Unless enforcement is prohibited by applicable law, you may 
  28. not modify, decompile, or reverse engineer Software.  Software is not designed 
  29. or licensed for use in on-line control of aircraft, air traffic, aircraft  
  30. navigation or aircraft communications; or in the design, construction, operation 
  31. or maintenance of any nuclear facility.  No right, title or interest in or to 
  32. any trademark, service mark, logo or trade name of Sun or its licensors is 
  33. granted under this Agreement. 
  34.  
  35. 3. LIMITED WARRANTY.  Sun warrants to you that for a period of ninety (90) days 
  36. from the date of purchase, as evidenced by a copy of the receipt, the media on 
  37. which Software is furnished (if any) will be free of defects in materials and 
  38. workmanship under normal use.  Except for the foregoing, Software is provided 
  39. "AS IS".  Your exclusive remedy and Sun's entire liability under this limited 
  40. warranty will be at Sun's option to replace Software media or refund the fee 
  41. paid for Software.

  43. 4.  DISCLAIMER OF WARRANTY.  UNLESS SPECIFIED IN THIS 
  44. AGREEMENT, ALL EXPRESS OR IMPLIED CONDITIONS, 
  45. REPRESENTATIONS AND WARRANTIES, INCLUDING ANY IMPLIED 
  46. WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR 
  47. PURPOSE OR NON-INFRINGEMENT ARE DISCLAIMED, EXCEPT TO THE 
  48. EXTENT THAT THESE DISCLAIMERS ARE HELD TO BE LEGALLY 
  49. INVALID.

  51. 5.  LIMITATION OF LIABILITY.  TO THE EXTENT NOT PROHIBITED 
  52. BY LAW, IN NO EVENT WILL SUN OR ITS LICENSORS BE LIABLE FOR 
  53. ANY LOST REVENUE, PROFIT OR DATA, OR FOR SPECIAL, INDIRECT, 
  54. CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES, HOWEVER 
  55. CAUSED REGARDLESS OF THE THEORY OF LIABILITY, ARISING OUT OF 
  56. OR RELATED TO THE USE OF OR INABILITY TO USE SOFTWARE, EVEN 
  57. IF SUN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  
  58. In no event will Sun's liability to you, whether in contract, tort (including
  59. negligence), or otherwise, exceed the amount paid by you for Software under
  60. this Agreement.  The foregoing limitations will apply even if the above stated
  61. warranty fails of its essential purpose.  
  62.  
  63. 6.  Termination.  This Agreement is effective until terminated.  You may 
  64. terminate this Agreement at any time by destroying all copies of Software.  This 
  65. Agreement will terminate immediately without notice from Sun if you fail to 
  66. comply with any provision of this Agreement.  Upon Termination, you must destroy 
  67. all copies of Software.

  69. 7.  Export Regulations.  All Software and technical data delivered under this 
  70. Agreement are subject to US export control laws and may be subject to export or 
  71. import regulations in other countries.  You agree to comply strictly with all 
  72. such laws and regulations and acknowledge that you have the responsibility to 
  73. obtain such licenses to export, re-export, or import as may be required after 
  74. delivery to you.

  76. 8.  U.S. Government Restricted Rights.  If Software is being acquired by or on 
  77. behalf of the U.S. Government or by a U.S. Government prime contractor or 
  78. subcontractor (at any tier), then the Government's rights in Software and 
  79. accompanying documentation will be only as set forth in this Agreement; this is 
  80. in accordance with 48 CFR 227.7201 through 227.7202-4 (for Department of Defense 
  81. (DOD) acquisitions) and with 48 CFR 2.101 and 12.212 (for non-DOD acquisitions).

  83. 9.  Governing Law.  Any action related to this Agreement will be governed by 
  84. California law and controlling U.S. federal law.  No choice of law rules of any 
  85. jurisdiction will apply.
  86.  
  87. 10.  Severability. If any provision of this Agreement is held to be 
  88. unenforceable, this Agreement will remain in effect with the provision omitted, 
  89. unless omission would frustrate the intent of the parties, in which case this 
  90. Agreement will immediately terminate.  
  91.  
  92. 11.  Integration.  This Agreement is the entire agreement between you and Sun 
  93. relating to its subject matter.  It supersedes all prior or contemporaneous oral 
  94. or written communications, proposals, representations and warranties and 
  95. prevails over any conflicting or additional terms of any quote, order, 
  96. acknowledgment, or other communication between the parties relating to its 
  97. subject matter during the term of this Agreement.  No modification of this 
  98. Agreement will be binding, unless in writing and signed by an authorized 
  99. representative of each party.

  104. PROGRAM DEVELOPMENT AND SERVLET JAR FILE
  105. DISTRIBUTION SUPPLEMENTAL LICENSE TERMS
  106.  
  107. These supplemental license terms ("Supplement")
  108. add to or modify the terms of the Binary Code
  109. License Agreement (collectively, the
  110. "Agreement"). Capitalized terms not defined in
  111. this Supplement shall have the same meanings
  112. ascribed to them in the Agreement.  These
  113. Supplement terms shall supersede any inconsistent
  114. or conflicting terms in the Agreement, or in any
  115. license contained within the Software.
  116.  
  117. 1. License to Develop.
  118.  
  119.     Sun grants you a non-exclusive,
  120.     non-transferable, royalty-free limited
  121.     license to use the Software for the
  122.     development of Java TM compatible servlets
  123.     (the "Programs") and reproduce and distribute
  124.     the Programs to third party end users
  125.     provided that you: (i) do not redistribute
  126.     the Software in whole or in part, either
  127.     separately or included in any Program except
  128.     as authorized for the Servlet JAR Files as
  129.     specified in Section 2 below, and (ii) agree
  130.     to indemnify, hold harmless, and defend Sun
  131.     and its licensors from and against any claims
  132.     or lawsuits, including attorney's fees, that
  133.     arise or result from the use or distribution
  134.     of any and all Programs.

  136. 2. License to Distribute.
  137.  
  138.     Sun grants you a non-exclusive,
  139.     non-transferable, royalty-free limited
  140.     license to reproduce and distribute the
  141.     servlet classes contained in the Software in
  142.     the archive files "servlet.jar" and
  143.     "server.jar" ("Servlet JAR Files") to third
  144.     party end users solely as a component of your
  145.     Programs provided that you: (i) distribute
  146.     the Servlet JAR Files complete and unmodified
  147.     in their original Java Archive file; (ii) do
  148.     not distribute additional software intended
  149.     to replace any component(s) of the Servlet
  150.     JAR Files; (iii) do not remove or alter any
  151.     proprietary legends or notices contained in
  152.     or on the Software; (iv) only distribute the
  153.     Servlet JAR Files pursuant to a license
  154.     agreement that protects Sun's interests
  155.     consistent with the terms contained in the
  156.     Agreement; (v) agree to incorporate the most
  157.     current version of the Servlet JAR Files that
  158.     was available from Sun no later than 180 days
  159.     prior to each production release of your
  160.     Program; and (vi) agree to indemnify, hold
  161.     harmless, and defend Sun and its licensors
  162.     from and against any claims or lawsuits,
  163.     including attorney's fees, that arise or
  164.     result from the use or distribution of any
  165.     and all Programs.

  167. 3. Trademarks and Logos.
  168.  
  169.     You acknowledge as between you and Sun that
  170.     Sun owns the Java trademark and all
  171.     Java-related trademarks, logos and icons
  172.     including the Coffee Cup and Duke ("Java
  173.     Marks") and agree to comply with the Java
  174.     Trademark Guidelines at
  175.     http://java.sun.com/trademarks.html.
