  14. Possession or use of radio capable of sending or receiving police messages
  15. restricted; penalty; enforcement

  17. 4) Nothing contained in this section shall prohibit the possession
  18.    of a radio by:
  19.  
  20.    a) An individual who is a retailer or wholesaler...ect
  21.  
  22.    b) A commercial or education radio or television station, licensed by
  23.       the F.C.C.
  24.  
  25. -->c) An individual who posses such a radio, provided it is capable of
  26.       receiving radio transmissions only and is not capable of sending or
  27.       transmitting radio messages, at his place of residence; licensed
  28.       commercial auto towing trucks; newspaper reporters and photographers;
  29.       disaster and emergency services personnel authorized in writing by
  30.       the state director of disaster and emergency service (for state personnel)
  31.       or the chief executive of the city or county (for their respective
  32.       personnel); a person holding a valid license issued by the F.C.C.
  33.       in the amateur radio service; peace officers authorized in writing
  34.       by the head of their law enforcement agency, Commonwealth's
  35.       attorneys and their assistants, county attorneys and their assistants,
  36.       except that it shall be unlawful to use such radio to facilitate
  37.       any criminal activity or to avoid apprehension by law enforcement
  38.       officers.  Violation of this section shall, in addition to any other
  39.       penalty prescribed by law, result in a forfeiture to the local law
  40.       enforcement agency of such radio.

  42. This is the new scanner law provision that includes us Amateurs.  I have
  43. discussed this section with some local attorneys and they feel the way
  44. I do about this new section:  The law lets us have a scanning radio in our
  45. vehicles but that radio better not be able to transmit no matter what the
  46. frequency is being used.  If you don't get this message try re-reading
  47. the first 3 lines in section "C".  No matter if one is using the local
  48. repeater, if that radio can scan it better not be able to transmit.

  50. Something else I noticed in this law comes under Paragraph 3.
  51. We all know that if convicted the radio equiptment is forfeited and/or
  52. destroyed.  Well, even if you are not convicted of a violation, the
  53. equiptment may still be ordered destroyed, forfeited, or escheated
  54. that stinks.
