- Wow, that's one horrible story. I recently went through a small court
- case (nothing like this), but I can tell you the two judges (they
- appealed the first trial) were both very perceptive. However, both had
- their quirks, for instance, one would only let you talk in response to a
- specific question from him, so if the defendant said "he then threw it
- on the floor", the judge would turn to me and say "did you then throw it
- on the floor". The other judge let it go a bit more free-form, so
- unless I mentioned their comment on my turn, he might or might not ask
- me to respond, and if I didn't respond on my own, it might make me look
- bad. I know that neither of them liked us to interrupt each other. I
- would suggest 1). Chat with a lawyer for 30 minutes (may be free if
- you're lucky, or maybe $50), 2). Try not to go first in court, I don't
- know how you can get out of it if you are first, but it made a great
- deal of difference to my case to see how the judge reacts, and what
- buttons not to press. 3). Plead NOT GUILTY. Fine or no fine, if you
- believe in your innocence, stick with that, you've got to live with
- yourself in the morning. 4). Don't talk intimidtion or prejudice, just
- tell it the way it happened. Tell the judge you didn't fully
- comprehend the situation until it was too late, the policeman came over
- very quickly and you panicked a little. You had your window closed so
- were not aware of a possible situation going down, you just wanted to
- make the turn and get out of there. Apologize to the cop for spooking
- him, your intent was in no way to disrespect or annoy him.
-
- Just my opinion, please don't take my advise without some real legal
- help, but personally, the way you told it, the judge would have to be
- pretty nasty to find against you. Good luck.
