- The following describes the experience I had with a mail order firm:

- 1. On October 28, 1992 I ordered a Creative Labs Multimedia Upgrade Kit
- from First Computer Systems of Norcross Georgia. I ordered by phone and
- had the sales person verify that the system included all the parts listed
- in their ad for the stated price of $499.00. He said that it did.
- Included in the list is a game "Sherlock Holmes Consulting Detective".
- which I asked about explicitly.
- The ad is on pages 422-423 of the November issue of PC Sources.

- 2. We received the kit on Tuesday November 3. The game was not included.
- When I contacted Daryl by phone he stated that the game was on the same
- media as the Microsoft Bookshelf product (another kit component).
- but he did not know how to access it.

- When I examined the product, I found the following:
- * the package was labeled "Starter Kit", not "Upgrade Kit"
- * no package labeling (inside or out) referred to the game
- * the Microsoft Bookshelf product packaging did not refer to the game
- * the Microsoft Bookshelf product media does not contain the game;
- I examined the entire directory tree.

- 3. On Wednesday November 4 I contacted Daryl, told him of the missing game
- and was told that he would consult with the Sales Manager and call me back.
- After a day of repeated delays he explained that the game was listed i
- in the description of the kit as a "feature" which meant that it was not
- included. That explanation evoked from me an earthy descriptor commonly i
- used to describe cattle manure. I then told him that I wanted the
- missing piece shipped and no more run-around.
- He then told me that they would not do that but I should contact their
- RMA center (at my expense), and ship back the product ($19.00 of my expense).
- (In addition there would be a 15% restocking fee according to the invoice.)

- I talk to other persons in the company and was told that they had the
- right to change prices without notice and that the package as advertised
- now costs $599.00. Further, the word I used to describe their
- explanations proved that I was not good enough to be their customer!
