- /* ---------- "Update on Aguilar Payes Case" ---------- */
-
- An update on the judicial cases of Cesar Erazo Cruz and Adolfo
- Aguilar Payes.
-
- On July 21st, Cesar Erazo Cruz was publicly tried and was
- declared innocent of the assasination of Dr. Francisco Jose
- Guerrero. However, he remained in prison on charges of violent
- evasion and subversive association based on the period when he
- had been freed from prison in a raid by the FMLN. Last week he
- received political amnesty for these charges and was released.
-
- The case of Aquilar Payes is proving more difficult. Aguilar
- Payes is charged with the assassination of Edgar Chacon and
- Gabriel Payes. He is considered to be one of the remaining
- political prisoners. The only known evidence against him is an
- extra-judicial confession which was later repudiated by him as
- having been signed under torture.
-
- The case was originally set for July 28th but was abruptly
- suspended. The reason given for the suspension was that the
- publicity over the case had created a negative environment.
-
- It has now been announced that it is to take place by the end of
- this month. Both the defense and the family are very concerned
- that it will not be a clean process. Their concerns are based on
- commentaries that the public trial was suspended because the jury
- had been threatened and for this reason the case had been
- delayed. Other measures that are causing concern include the
- augmenting of security measures related to the jury amd the
- replacing of the glass panes with polarized glass. They are
- also saying that the trial will only be announced five hours
- beforehand in order to avoid publicity and that the number of
- persons that can attend will be limited.
-
- Because of this situation and the valuation that the faxes sent
- before had a positive effect, it is urged that people send faxes
- again.

- We wish to express our concern with the route being taken in the
- judicial trial of Salvadoran citizen Adolfo Aguilar Payes. We
- are concerned that such actions under the new Peace Accords may
- have a damaging affect upon these Accords.
