  24.    DELAWARE CITY, Del., Aug. 13 /U.S. Newswire/ -- The Natural
  25. Resources Defense Council and Delaware Audubon Society today won a
  26. ruling from a federal court against Texaco Refining and Marketing
  27. Inc. (TRMI) for continuous pollution of the Delaware River.
  28.   The judge found that TRMI had committed hundreds of violations
  29. under the Clean Water Act, and ordered Texaco to pay a $1.68 million
  30. penalty to the U.S. Treasury.  The judge also ordered Texaco to
  31. comply with the water pollution laws, and to improve its water
  32. pollution investigation practices.
  33.    "The judge's decision is a stunning affirmation of the importance
  34. of citizen's suits in enforcing the Clean Water Act against big
  35. corporate polluters," said Kit Kennedy, NRDC senior project attorney.
  36. "Despite the fact that TRMI committed hundreds of violations over a
  37. nine-year period, they were allowed to keep polluting without paying
  38. a penny in fines until NRDC and Audubon won this decision."
  39.    The suit, originally filed in 1988, accused TRMI's oil refinery of
  40. polluting the Delaware River since 1983.  The illegal pollution
  41. discharges included toxic pollutants such as phenol and ammonia.
  42. Some of the violations were as much as 2000 percent over the legal
  43. limit.
  44.    The $1.68 million penalty is one of the largest levied ever in a
  45. citizen's enforcement suit under the Clean Water Act against a
  46. corporate polluter.  TRMI must now comply with the water pollution
  47. laws or face court sanctions.
  48.    Judge Jane Roth, of the U.S. District Court for the District of
  49. Delaware, said in the ruling that TRMI's internal investigation
  50. procedures were "inconsistent and less than thorough" when assessing
  51. the source of water pollution problems.  She found that Texaco relied
  52. on "supposition" rather than thorough investigations.  Roth found
  53. that a court order enjoining TRMI from further violations was
  54. necessary to vindicate the public interest.
