  1. NOTICE: By installing and using the SOFTWARE you are agreeing to be bound
  2. by the terms of this Agreement. If you do not agree to the terms of this
  3. Agreement, promptly delete the SOFTWARE from your computer.

  5. This Agreement permits you to make and use copies of the files designated
  6. as "PERLPAD3.EXE" (the "SOFTWARE") provided that each such copy      
  7. is used only on a single computer which contains a licensed copy of the
  8. Viotix License Aggrement which has been validly licensed by you. You
  9. must maintain all copyright notices on all copies of the SOFTWARE. You
  10. may not rent or lease the SOFTWARE, but you may transfer the SOFTWARE on
  11. a permanent basis provided you CONTACT VIOTIX, INCOPORATED, retain no copies, include the most recent
  12. update and all prior versions of the PerlPad 3.0 , and the recipient
  13. agrees to the terms of this Agreement. You may not reverse engineer,
  14. decompile, or disassemble the SOFTWARE.

  16. THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. VIOTIX 
  17. DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT 
  18. LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR 
  19. PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL VIOTIX OR ITS SUPPLIERS 
  20. BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES 
  21. FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS 
  22. INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY 
  23. TO USE THE SOFTWARE, EVEN IF VIOTIX HAS BEEN ADVISED OF THE POSSIBILITY 
  24. OF SUCH DAMAGES. BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR 
  25. LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE 
  26. LIMITATION MAY NOT APPLY TO YOU.

  28. The SOFTWARE is provided with RESTRICTED RIGHTS. Use, duplication, or
  29. disclosure by the Government is subject to restrictions as set forth in
  30. subparagraph (c)(1)(ii) of The Rights in Technical Data and Computer
  31. Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of
  32. the Commercial Computer SoftwareùRestricted Rights at 48 CFR 52.227-19,
  33. as applicable.  Manufacturer is Viotix Incorporated
  34. Franklin, VA 23851.

  36. This Agreement is governed by the laws of the State of Virginia.
