  8. License to Distribute or sell KittyHawk Software, Inc.'s "Paper Animal
  9. Workshop" Limited Version.

  11. This document (LICENSE.TXT) is the only terms in which we, KittyHawk 
  12. Software, Inc., ("KittyHawk") allow Commercial Distribution of "Paper 
  13. Animal Workshop" Limited Version(the "Software").
  14.  
  15. To "commercially distribute" means to distribute for money or other 
  16. consideration.  It includes copying onto magnetic disks, CD-ROMs or any 
  17. other tangible medium now or subsequently known, and distribution by 
  18. retail rack, direct mail, catalog, advertisement, or trade show.  It 
  19. does not include distribution by any not for profit organization, by any 
  20. hobby, user or computer interest group to its members, or electronically 
  21. by any BBS or Internet site.

  23. "Paper Animal Workshop" means version 1.0 and all of the related 
  24. files distributed by us under the mark "Paper Animal Workshop Limited 
  25. Edition."

  27. A. OWNERSHIP:  Except to the extent expressly licensed by us, we have 
  28. and reserve the exclusive copyright and other right, title and interest 
  29. to distribute the Program, and the right to use the Trademark in 
  30. connection with them.

  32. B. THINGS YOU MUST DO: You may Commercially Distribute the
  33. Program under this License so long as you:

  35. [1]  Clearly market it as limited using "try before you buy" or similar 
  36. words,
  37. [2]  Try to sell only the most current version of it,
  38. [3]  Make distribution copies only from master copies received directly 
  39. from us,
  40. [4]  Distribute the Software complete including all of its related

  55. copies you have in stock.  Sections A, E and the Warranty will survive 
  56. the termination of this License.

  58. E. MISCELLANY You may not reverse engineer, decompile, disassemble, or 
  59. create derivative works from the Software.  You will hold KittyHawk, our 
  60. contractors, employees and agents harmless from damage, loss and expense 
  61. arising directly or indirectly from your acts and omissions in copying 
  62. and distributing the Software.  With respect to every matter arising 
  63. under this License, you consent to the exclusive jurisdiction and venue 
  64. of the state and federal courts sitting in Tucson, Arizona, USA, or as 
  65. otherwise permitted by law.

  74. FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SOFTWARE AND THE 
  75. ACCOMPANYING WRITTEN MATERIALS.  THIS LIMITED WARRANTY GIVES YOU 
  76. SPECIFIC LEGAL RIGHTS.  YOU MAY HAVE OTHERS, WHICH VARY FROM 
  77. STATE/JURISDICTION TO STATE/JURISDICTION.

  79. NO LIABILITY FOR CONSEQUENTIAL DAMAGES. IN NO EVENT SHALL KITTYHAWK OR

  81. LIMITATION, PERSONAL INJURY, DAMAGES FOR LOSS OF BUSINESS PROFITS, 
  82. BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY 
  83. LOSS) ARISING FROM THE USE OR THE INABILITY TO USE THIS KITTYHAWK 
  84. PRODUCT, EVEN IF KITTYHAWK HAS BEEN ADVISED OF THE POTENTIAL OF SUCH 
  85. DAMAGES.  BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION 
  86. OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE 
  87. LIMITATION MAY NOT APPLY TO YOU.
