  1. Since you're about to use Art Plus software application,
  2. you must read and accept the following -

  4. Art Plus EasyNoter End User License Agreement
  5.  
  6. IMPORTANT READ CAREFULLY: This Art Plus End-User License
  7. Agreement (EULA) is a legal agreement between you (either
  8. an individual or a single entity) and  Art Plus Marketing &
  9. Publishing for the Art Plus software. By installing, copying,
  10. or otherwise using the Software you agree to be bound by
  11. the terms of this EULA. If you do not agree to the terms of
  12. this Agreement, you are not authorized to use the Software.
  13.  
  14. The Software is protected by copyright laws and international
  15. copyright treaties, as well as other intellectual property
  16. laws and treaties. The Software is licensed, not sold.
  17.  
  18. Art Plus EasyNoter and Art Plus EasyNoter PRO are Trademarks
  19. of Art Plus Marketing & Publishing, Zagreb, Croatia.

  26. 1. Definitions:
  27.  
  28. (a) "Art Plus Software" means the software program covered by 
  29.     this Agreement, and all related updates supplied by 
  30.     Art Plus Marketing & Publishing.
  31.  
  32. (b) "Art Plus Product" means the Art Plus Software and any 
  33.     related documentation, models and multimedia content 
  34.     (such as animation, sound and graphics), and all related 
  35.     updates supplied by Art Plus Marketing & Publishing.
  36.  
  37. Upon acceptance of this agreement, Art Plus grants to you
  38. a non-exclusive license to use the Software, provided 
  39. that you agree to the following:

  41. 2. License Grant:
  42.  
  43. You may install the Software on a hard disk or other storage 
  44. device; install and use the Software on a file server for use
  45. on a network for the purposes of (i) permanent installation 
  46. onto hard disks or other storage devices or (ii) use of the 
  47. Software over such network; and make backup copies of the 
  48. Software.
  49.  
  50. You may make and distribute unlimited copies of the Software, 
  51. excluding copies for commercial distribution, as long as each 
  52. copy that you make and/or distribute is subject to this 
  53. Agreement, and the same copyright and other proprietary 
  54. notices pertaining to this Software that appear in the 
  55. Software. If you download the Software from the Internet or 
  56. similar on-line source, you must include the Art Plus
  57. copyright notice for the Software with any on-line 
  58. distribution and on any media you distribute that includes 
  59. the Software.
  60.  
  61. This License does not entitle you hard copy documentation, 
  62. support or telephone assistance. Art Plus reserves the right 
  63. at any time not to release a commercial release of the 
  64. Software or, if released, to alter prices, features, 
  65. licensing terms, or other characteristics of the commercial 
  66. release.
  67.  
  68. COPYRIGHT. All title and copyrights in and to the Software
  69. and any copies thereof are owned by Art Plus or its suppliers.

  72. 3. Restrictions:
  73.  
  74. You agree not to modify, adapt, translate, reverse engineer,
  75. decompile, disassemble or otherwise attempt to discover the
  76. source code of the Software (except and solely to the extent an 
  77. applicable statute expressly and specifically prohibits such 
  78. restrictions). You may not modify, rent, lease, resell for 
  79. profit, distribute or create derivative works based upon the 
  80. Art Plus Product or any part thereof.  You may not grant a 
  81. security interest in, or otherwise transfer rights to the 
  82. Software.  You may not remove any proprietary notices or 
  83. labels on the Software.

  86. 4. Disclaimer of Warranty:
  87.  
  88. This software is provided on an "as is" basis, without 
  89. warranty of any kind from Art Plus. Any use of the Software
  90. is at your own risk. To the maximum extent permitted by
  91. applicable law, Art Plus and its suppliers disclaim all
  92. warranties and conditions, either express or implied,
  93. including, but not limited to, implied warranties of
  94. merchantability, fitness for a particular purpose, and 
  95. non infringement.

  97. The entire risk as to the quality and performance of the
  98. software is borne by you. Should the software prove defective
  99. in any respect, you and not Art Plus or its suppliers assume
  100. the entire cost of any service and repair. 
  101.  
  102. This disclaimer of warranty constitutes an essential part of 
  103. the agreement. No use of the software is authorized hereunder 
  104. except under this disclaimer.
  105.  
  106. In no event will Art Plus be liable to you for consequential, 
  107. incidental, special or exemplary damages arising out of a 
  108. breach of this agreement or warranty or your use of the 
  109. software, including but not limited to lost profits or loss 
  110. of business, even if Art Plus has been apprised of the 
  111. likelihood of such damages occurring.

  113. Art Plus shall have no obligation to you with respect to any 
  114. claim of infringement based upon your use of the software in 
  115. combination, operation or otherwise with the data or 
  116. materials not supplied by Art Plus.
  117.

  119. 5. Termination:
  120.  
  121. This Agreement and the license granted hereunder will 
  122. terminate automatically if you fail to comply with the 
  123. limitations described herein. Upon termination, you must 
  124. destroy all copies of the Software and Documentation.

  126. 6. Privacy:
  127.  
  128. By accepting this software, you hereby authorize Art Plus
  129. to use the information in your registration form when
  130. selecting advertisements for you. 
  131. Art Plus will use the information in the registration form
  132. provided by you solely for the purpose of selecting which
  133. commercials may, in Art Plus opinion, interest you most.
  134. Art Plus will not resell this information to third parties.
  135.  
  136. By downloading the Art Plus Product, you are confirming your
  137. acceptance of the Software and agreeing to be bound by the
  138. terms of this Agreement.
  139.  
  140. 7. General:
  141.  
  142. This Agreement shall be governed by the laws of the Republic
  143. of Croatia. This Agreement contains the complete agreement 
  144. between the parties with respect to the license granted 
  145. hereunder and supercedes all prior or contemporaneous 
  146. agreements or understandings, whether oral or written.
  147. This Agreement may be amended only by a writing signed by an 
  148. authorized officer of Art Plus.
  149.  
  150. If any provision of this Agreement is held to be void and 
  151. unenforceable, it will not affect the validity of the balance
  152. of the Agreement.  Such provision shall be reformed only to
  153. the extent necessary to make it enforceable. This Agreement 
  154. shall be governed by Croatian law, excluding conflict of law 
  155. provisions (except to the extent applicable law, if any, 
  156. provides otherwise).
